..Title Amending Title 14 of The Philadelphia Code, entitled "Zoning and Planning," by amending Chapter 14-1500 entitled "Area Surrounding Airports" by adding a new Section 14-1503 entitled "Procedures for the Development or Use of City-Owned Airport Property" requiring City Council approval under certain circumstances for the construction of new City-owned or operated facilities or for the use of City-owned property, under certain terms and conditions. ..Body WHEREAS, under the provisions of the Home Rule Charter, the Council of the City of Philadelphia has the power to change the zoning designation of any City-owned property; and WHEREAS, under the provisions of the Home Rule Charter, the Council of the City of Philadelphia also has the power to revise the Philadelphia Zoning Code; and WHEREAS, it occasionally becomes necessary for the City of Philadelphia in developing or leasing City-owned airport property to appeal to the Zoning Board of Adjustment for variances from the provisions of the Zoning Code; and WHEREAS, under such circumstances it is difficult if not impossible for an applicant to the Zoning Board of Adjustment to meet the legal burden of the showing of hardship to the land; now therefore THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS: SECTION 1. Title 14 of The Philadelphia Code, entitled "Zoning and Planning" is hereby amended by adding a new §14-1503 entitled "Procedures for the Development or Use of City-Owned Airport Property" to read as follows: TITLE 14. ZONING AND PLANNING. * * * CHAPTER 14-1500. AREA SURROUNDING AIRPORTS. * * * §14-1503. Procedures for the Development or Use of City-Owned Airport Property. (1) No City-owned or operated facility located on the grounds of the Philadelphia International Airport or the Northeast Philadelphia Airport shall be constructed nor shall the use of any City-owned land be permitted when the proposed use of the property would otherwise require approval by the Zoning Board of Adjustment. Such plans shall be referred to the City Council for the appropriate rezoning of the property in question or for necessary amendments to the Zoning Code. SECTION 2.
