..Title Authorizing the Commissioner of Public Property, on behalf of the City of Philadelphia, to acquire by purchase, condemnation, or other means, that certain parcel of land commonly known as 4815 Smick street and 200 Fountain street and, upon completion of the City's acquisition of the parcel, incorporating the parcel into Germany Hill Park and placing the parcel under the jurisdiction of the Fairmount Park Commission under The Philadelphia Code, Title 15, Section 15-201. ..Body THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS: SECTION 1. The Commissioner of Public Property, on behalf of the City of Philadelphia, is authorized to acquire by purchase, condemnation, or other means, a certain parcel of land (the "Property") commonly known as 4815 Smick street and 200 Fountain street, and generally described as follows: ALL THAT CERTAIN lot or piece of ground, situate in Manayunk in the Twenty-first Ward of the City of Philadelphia as described as follows: BEGINNING at a point a corner formed by the intersection of the Northeasterly side of Smick street (50 feet wide) with the Northwesterly side of Fountain street (as now opened, 50 feet wide). CONTAINING in front or breadth on the said Fountain street 483 feet 6-1/4 inches and extending in length or depth of that width Northwestwardly 75 feet, the Southwesterly line running along the Northeasterly line of Smick street, the Northeasterly line thereof running along ground now or late of Harry Miller. BEING 200 Fountain street. ALSO ALL THAT CERTAIN land and premises situate in the Twenty-first Ward of the City of Philadelphia, and Commonwealth of Pennsylvania, the Northeast side of Smick street, 75 feet Northwest of Fountain street, thence extending along the northeast side of Smick street and extending partly into the bed of Cinnaminson street North 38 degrees 20 minutes 45 seconds West 318 feet 8-7/8 inches, thence partly crossing bed of Cinnaminson street, North 61 degrees 38 minutes 19 seconds East, 126 feet 7-1/2 inches, thence South 38 degrees 20 minutes 45 seconds, 305 feet 3-5/8 inches, thence South 55 degrees 33 minutes 25 seconds West 125 feet to the place of beginning. BEING 4815 Smick street. SECTION 2. The City Solicitor is hereby authorized to include in the deed or other document or documents to be executed, accepted, or filed by the Commissioner of Public Property in connection with acquisition of the Property such terms and provisions as the City Solicitor shall deem necessary or appropriate to protect the interests of the City. The City Solicitor may take any action necessary or desirable to carry out the purpose of this Ordinance. SECTION 3. Upon completion of the City's acquisition of the Property, the Property shall automatically be incorporated into Germany Hill Park and be under the jurisdiction of the Fairmount Park Commission under The Philadelphia Code, Title 15, Section 15-201. ..End
