..Title Authorizing the Commissioner of Public Property, on behalf of the City of Philadelphia, to exchange fee simple title to approximately 292 square feet of certain Fairmount Park land with the improvements thereon located Northeast of the Manayunk Canal and approximately 260 feet to the Northwest of Fountain Street, in consideration for fee simple title to a certain portion of a parcel of land with the improvements thereon located at 116 Fountain Street, which land, upon acquisition by the City, shall be under the jurisdiction of the Fairmount Park Commission, all under certain terms and conditions. ..Body THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS: SECTION 1. The Commissioner of Public Property, on behalf of the City of Philadelphia, is hereby authorized to exchange fee simple title to approximately two-hundred ninety-two (292) square feet of Fairmount Park land together with the improvements thereon, situated Northeast of the Manayunk Canal and approximately 260 feet Northwest of Fountain Street, and legally described in attached Exhibit "A," in consideration for fee simple title to approximately one thousand (1000) square feet of a certain parcel of land together with the improvements thereon, situated on a parcel of land known as 116 Fountain Street, and legally described in attached Exhibit "B," owned by Fountain Street Partners, L.L.P. SECTION 2. Upon acquisition by the City, the parcel described in Exhibit B is incorporated into the Manayunk Canal Towpath under the jurisdiction of the Fairmount Park Commission. SECTION 3. The City Solicitor is hereby authorized to review and to approve all instruments and documents necessary to effectuate this Ordinance, which instruments and documents shall contain such terms and conditions as the City Solicitor shall deem necessary and proper to protect the interests of the City. SECTION 4. The Chief Clerk of City Council shall keep on file the documents referred to as Exhibits A and B and shall make them available for inspection by the public during regular office hours. ..End
