..Title Amending Section 1(a) and (c) of an Ordinance (Bill No. 030344) approved July 31, 2003, entitled "An Ordinance granting permission to Ride the Ducks International LLC, to remove an existing wood and metal newsstand located on the west sidewalk of South Independence Mall West (formerly 6th Street) between Ranstead and Chestnut Streets and erect a new prefabricated metal ticket booth kiosk with signage, including an electrical conduit with an electrical service line and a telecommunications conduit with a telephone service line in and under the public rights of way for the purpose of supplying electrical service and telephone service to the ticket booth kiosk, under certain terms and conditions," by enlarging the ticket booth kiosk with the conditions stated therein. ..Body WHEREAS, Ride the Ducks International LLC, P.O. Box 1837, Branson, MO 65615 is the owner of the "Ride the Ducks" sightseeing tours located on the west sidewalk of South Independence Mall West between Ranstead and Chestnut Streets; and WHEREAS, Ride the Ducks International LLC, has requested permission to construct, own and maintain a new prefabricated metal ticket booth kiosk with signage, removal of the ticket booth kiosk previously approved by Ordinance # 030344, located on the west public sidewalk South Independence Mall West (formerly 6th Street) between Ranstead and Chestnut Streets, and the erection of a new larger prefabricated metal structure. The use of the kiosk will now include the retail sale of "Ride the Duck" merchandise along with the retail sale of tickets accessory to the "Ride the Ducks" sightseeing tour; now, therefore, THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS: SECTION 1. Section 1(a) and (c) of an Ordinance (Bill No. 030344) approved July 31, 2003 is hereby amended to read as follows: SECTION 1. Permission is hereby granted to Ride the Ducks International LLC, P.O. Box 1837, Branson, MO 65615 owner of the "Ride the Ducks" sightseeing tours located on the west sidewalk of South Independence Mall West between Ranstead and Chestnut Streets to construct, use and maintain: (a) Kiosk- The new prefabricated metal structure is approximately thirteen feet (13') long by five feet six inches (5'-6") wide by nine feet three inches (9'-3") high. The revised centerline of the structure is located approximately eighty-one feet six inches (81'-6") north of the north curbline of Chestnut Street. The eastside of the structure offset varies from approximately three feet (3') west of the west curbline of South Independence Mall West to one foot (1') west of the west curbline of South Independence Mall West. The clear unobstructed footway distance to the westside of the kiosk is approximately eleven feet six inches (11'-6"). All signage, previously approved in Ordinance # 030344, will be reused on the new kiosk. (c) Ticket Sales / Passenger Loading- Due to the increased kiosk width, the "tensa" barriers will be altered to provide a continuous seven feet five inch (7'-5") unobstructed clear footway. These portable barriers, removed during periods of non-operation, channelize "Ride the Ducks" patron activity at the kiosk. SECTION 2. This Ordinance shall not become effective unless the sum of two hundred dollars ($200.00), toward the costs thereof, is paid into the City Treasury within sixty (60) days after this Ordinance becomes law. ..End ?? ?? ?? ??
