..Title Authorizing the President of the Fairmount Park Commission, the Executive Director of Fairmount Park, and the Public Property Commissioner, on behalf of the City of Philadelphia, to enter into a ground lease with the School District of Philadelphia under which the School District will lease from the City certain land in West Fairmount Park in order to construct, maintain, and operate a high school; all under certain provisions and conditions. ..Body THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS: SECTION 1. The President of the Fairmount Park Commission, the Executive Director of Fairmount Park, and the Public Property Commissioner, are authorized by this Ordinance to enter into a ground lease ("Lease"), including exhibits identified in the Lease, with the School District of Philadelphia ("District"), under which the City would lease certain land in West Fairmount Park identified in the Lease ("Premises") to the District, which will; (1) construct, maintain, and operate a high school ("High School") on the Premises; (2) improve and maintain athletic fields in West Fairmount Park for use by the High School and the general public; (3) permit the general public and the Fairmount Park Commission to use facilities in the High School building; and (4) pending authorization under a separate ordinance, transfer to the City for incorporation into Fairmount Park certain land approximately equal in size and usefulness as the Premises. SECTION 2. The Lease, and all the exhibits to the Lease, must be substantially in the form set forth in Exhibit A to this Ordinance. The City Solicitor is authorized to include in the Lease and the exhibits to the Lease such other provisions as the City Solicitor deems necessary and appropriate to protect the interests of the City. SECTION 3. The Chief Clerk of City Council must keep on file and make available to the public for inspection during regular office hours the exhibit referred to in this Ordinance. ..End ?? ?? ?? ??
