..Title Setting forth the procedure that will govern Council's approval or disapproval of requests for approval of permits to sell malt or brewed beverages for consumption off premises in Philadelphia. ..Body WHEREAS, Act No. 39 of 2005 amended the Pennsylvania Liquor Code to require licensees who wish to sell malt or brewed beverages for off-premises consumption in Philadelphia to obtain a special permit from the Pennsylvania Liquor Control Board; and WHEREAS, Act No. 39 further requires that applications for such special permits must be accompanied by a copy of the approval of such request given by Council, which must render a decision by ordinance or resolution within forty-five days of receipt of a request for such approval; and WHEREAS, Council by adoption of this Resolution wishes to specify the procedures that will govern how Council approval must be requested, and how Council will resolve such requests for approval; and WHEREAS, Council by adoption of this Resolution also wishes to ratify certain related actions taken by the Council President to implement Act No. 39 while Council was in recess; now, therefore, RESOLVED, BY THE COUNCIL OF THE CITY OF PHILADELPHIA, THAT Council hereby adopts the "Rules Governing Requests For Approval Of Permits To Sell Malt Or Brewed Beverages For Consumption Off Premises In Philadelphia," attached as Exhibit "1", as the procedures that will govern requests to Council for approval of a permit to sell malt or brewed beverages for consumption off-premises in Philadelphia. FURTHER RESOLVED, THAT This Resolution shall be effective as of September 1, 2005, and shall be construed as a continuation of the "Temporary Rules Governing Requests For Approval Of Permits To Sell Malt Or Brewed Beverages For Consumption Off Premises In Philadelphia" issued by the Council President on September 1, 2005. Council hereby ratifies those "Temporary Rules" issued by the Council President, and Council further ratifies all actions taken pursuant to those Temporary Rules. ..End
