..Title Amending Section 14-1600 of The Philadelphia Code, entitled "Miscellaneous," by adding a new Section entitled, "Prohibition on licensed gaming facilities," prohibiting the erection, construction, alteration, or use of licensed gaming facilities and providing that no variance may be granted from such prohibition, all under certain terms and conditions. ..Body THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS: SECTION 1. Chapter 14-1600 of The Philadelphia Code is hereby amended to read as follows: CHAPTER 14-1600. MISCELLANEOUS. * * * §14-1632. Prohibition on licensed gaming facilities. (1) The erection, construction, alteration, or use of any licensed gaming facility as authorized by the Commonwealth of Pennsylvania, pursuant to 4 Pa. C.S., Part II, the "Pennsylvania Race Horse Development and Gaming Act," is prohibited within all zoning classifications. (2) The Zoning Board of Adjustment shall not grant variances from the provisions of § 14-1632(1) except where the denial of a variance would effect an unconstitutional taking. SECTION 2.
