..Title Amending Chapter 14-400 of The Philadelphia Code, entitled "Commercial Entertainment District," by providing that no ordinance designating a Commercial Entertainment District may be enacted unless a Neighborhood Improvement District has first been created that includes within its service area the proposed Commercial Entertainment District, all under certain terms and conditions. ..Body THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS: SECTION 1. Chapter 14-400 of The Philadelphia Code is hereby amended to read as follows: CHAPTER 14-400. COMMERCIAL ENTERTAINMENT DISTRICT. * * * §14-403. Procedures for the Establishment of a Commercial Entertainment District. (1) Council shall designate, by ordinance, such Commercial Entertainment Districts in such areas as Council deems appropriate. For each such District, such designations shall become effective upon the adoption of an ordinance designating the district boundaries; the enactment into law of an ordinance establishing a neighborhood improvement district as detailed in subsection (2); and the approval by Council of a Plan of Development for the District. Upon the designation becoming effective, the underlying zoning classification for all lots within the District shall be superseded, and no permits shall issue for any use within the District other than as permitted by the approved Plan of Development and this Chapter. (2) Adoption of a Neighborhood Improvement District. Council shall not enact an ordinance designating a Commercial Entertainment District unless it has first enacted into law an ordinance establishing a Neighborhood Improvement District, pursuant to the Community and Economic Improvement Act, 53 P.S. § 18101 et. seq., which includes, within its service area, the boundaries of the Commercial Entertainment District sought to be established, provided that the service area of the Neighborhood Improvement District may be larger than the boundaries of the Commercial Entertainment District. The failure of the Council to enact into law an ordinance establishing such a Neighborhood Improvement District shall act as an absolute bar to the enactment of an ordinance designating a Commercial Entertainment District.
