..Title Amending Sections of an Ordinance (Bill No. 080383) approved June 5, 2008, entitled "An Ordinance authorizing Arch Street Hotel Partners, LLC to construct, own and maintain various encroachments at 1421 Arch Street, all under certain terms and conditions," by extending the period for compliance and revising the extent of the encroachment, all under certain terms and conditions. ..Body THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS: SECTION 1. Section 1 of the Ordinance (Bill No. 080383) approved June 5, 2008 is hereby amended to read as follows (additions in italics, deletions in brackets): * * * Decorative [Awning] Canopy: The structure projects [approximately seventeen feet (17')] towards the curbline at distance not exceeding sixteen feet (16') onto the right-of-way, and is approximately twenty-one feet (21') in width with a minimum clearance of approximately seventeen feet (17') above Arch Street. * * * SECTION 2. Section 5 of the Ordinance (Bill No. 080383) approved June 5, 2008 is hereby amended to read as follows: SECTION 5. The permission granted to Arch Street Hotel Partners, LLC to construct, own and maintain various encroachments described in Section 1 shall expire without any further action by the City of Philadelphia if Arch Street Hotel Partners, LLC have not entered into an Agreement and satisfied all requirements of the Agreement that are listed in Section 3 of this Ordinance within [one (1) year] two (2) years after this Ordinance becomes law. * * * SECTION 3. Section 6 of the Ordinance (Bill No. 080383) approved June 5, 2008 is hereby amended to read as follows: SECTION 6. This Ordinance shall not become effective unless the sum of two hundred dollars ($200), toward costs thereof, is paid into the City Treasury [within ninety (90) days after the date this Ordinance becomes law] by February 27, 2009.
