..Title Authorizing the revision of lines and grades on a portion of City Plan No. 278 by striking from the City Plan and vacating Delaware Avenue from Robbins Street to Levick Street, reserving and placing on the City Plan a right-of-way for sewer and drainage purposes, water main purposes, and public utility purposes within the lines of Delaware Avenue being stricken, placing on the City Plan a right-of-way reserved for drainage purposes extending from the southeasterly side of Delaware Avenue, southwest of Levick Street, southeastwardly to the Pierhead Line of the Delaware River, and relocating the curblines of Levick Street, from Barnett and Elbridge Streets to Delaware Avenue, thereby increasing the cartway width of said Levick Street; all under certain terms and conditions. ..Body THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS: SECTION 1. Pursuant to Section 11-405 of The Philadelphia Code, the Board of Surveyors of the Department of Streets is hereby authorized to revise the lines and grades on a portion of City Plan No. 278 by: (a) Striking from the City Plan and vacating Delaware Avenue from Robbins Street to Levick Street. (b) Reserving and placing on the City Plan a right-of-way for sewer and drainage purposes, water main purposes, and public utility purposes within the lines of Delaware Avenue being stricken. (c) Placing on the City Plan a certain right-of-way reserved for drainage purposes extending from a point on the southeasterly side of Delaware Avenue, approximately two-hundred thirty-three feet southwest of Levick Street, southeastwardly to the Pierhead Line of the Delaware River. (d) Relocating the southwesterly curbline of Levick Street, from Barnett and Elbridge Streets to Delaware Avenue, three feet southwestwardly and relocating the northeasterly curbline of said Levick Street, from Barnett and Elbridge Streets to Delaware Avenue, seven feet northeastwardly, thereby increasing the width of the cartway of said Levick Street from thirty-four feet to forty-four feet. SECTION 2. The striking and vacating of Delaware Avenue, as authorized in Section 1(a) herein, shall be conditional upon the execution of an agreement between the City and the Philadelphia Authority for Industrial Development (PAID), as owner of a portion of the bed of said Delaware Avenue and of the property abutting the southeast side of said Delaware Avenue, granting to the City the aforesaid right-of-way for sewer and drainage purposes, water main purposes, and public utility purposes authorized in Section 1(b) herein. The agreement shall provide that no changes in grades shall be made and that no fences, buildings, or other structures, either overhead, underground, or upon the surface, shall be constructed within the lines of the right-of-way or abutting thereon, unless the plans for such structures shall first be submitted to and approved by the Water Department and any other public utility which maintains facilities within the said right-of-way. The agreement shall also grant the right-of-access and occupation at any and all times to the officers, agents, employees, and contractors of the City and any public utility which maintains facilities within the said right-of-way for the purpose of construction, reconstruction, maintenance, alterations, repairs, and inspection of present and future facilities and structures. ..End
