..Title Authorizing the Streets Commissioner, on behalf of the City, to enter into an agreement with the Norfolk Southern Railway Company for the establishment and construction of public at-grade crossings of the tracks of the said Railway Company at the southwesterly side of the Manayunk Canal by proposed extensions of Cotton Street and Lock Street. ..Body WHEREAS, The City has undertaken a project to renovate, redevelop, and improve the Venice Island Recreation Center; WHEREAS, In order to better provide for public access to the redeveloped recreation center, the City has proposed to extend Cotton Street and Lock Street as public streets from their current termini at the northeast side of the Manayunk Canal, southwest of Main Street, across the Canal to Venice Island; WHEREAS, The Norfolk Southern Railway Company owns track and operates freight service within an easement extending along the southwesterly side of the Canal (formerly known as the Venice Branch of the Philadelphia and Reading Railway); and WHEREAS, The proposed extensions of Cotton and Lock Streets require the establishment of public at-grade crossings of the said Railway Company's track; now, therefore THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS: SECTION 1. The Streets Commissioner, on behalf of the City of Philadelphia, is hereby authorized to enter into an agreement with the Norfolk Southern Railway Company for the establishment and construction of public at-grade crossings of the tracks of the said Railroad Company at the southwesterly side of the Manayunk Canal by proposed extensions of Cotton Street and Lock Street. SECTION 2. The City Solicitor is hereby authorized to review and to approve the said agreement and any other instruments and documents necessary to effectuate this Ordinance, and shall include in such agreement, instruments, and documents such terms and conditions as may be deemed necessary or appropriate to protect the interests of the City. ..End
