..Title Amending Title 6 (Health Code), Title 17 (Contracts and Procurement), and Title 20 (Officers and Employees) all of The Philadelphia Code, by replacing references to "mental retardation" with references to "intellectual disability;" all under certain terms and conditions. ..Body THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS: SECTION 1. Title 6 is hereby amended to read as follows: TITLE 6. HEALTH CODE. * * * CHAPTER 6-700. MAINTENANCE AND OPERATION OF DISTRICT HEALTH CENTERS. * * * §6-701. The Council makes the following findings: * * * 11. District Health Centers have arrangements with other City services, programs and agencies to welcome persons with multiple health needs and other persons who historically have only limited access to doctors' offices and hospital outpatient programs: chronically mentally ill persons, persons with [mental retardation] an intellectual disability, homeless persons, drug and alcohol using persons, persons with AIDS and persons with communicable diseases including sexually transmitted diseases and tuberculosis. * * * §6-703. Operation and Function of District Health Centers. * * * (1) The Health Department shall continue at a minimum to maintain and directly operate a system of at least nine (9) District Health Centers at which each of the following services shall be offered, except one may provide only Sexually Transmitted Disease services, in a manner that makes available to all citizens of the City the following services: (a) a Family Medical Care Program providing the following pediatric and internal medicine ambulatory services to all enrollees: * * * (.8) mental health, [mental retardation] intellectual disability, drug and alcohol and social Services on-site by referral; * * * CHAPTER 6-800. LEAD PAINT DISCLOSURE. * * * §6-801. The Council makes the following findings: * * * (4) Environmental exposure to even low levels of lead increases a child's risk of developing permanent learning disabilities, reduced concentration and attentiveness, and behavior problems which may persist and adversely affect the child's chances for success in school and life. Exposure to higher levels of lead can cause [mental retardation] an intellectual disability, seizures and death. * * * SECTION 2. Title 17 is hereby amended to read as follows: TITLE 17. CONTRACTS AND PROCUREMENT. * * * CHAPTER 17-1400. NON-COMPETITIVELY BID CONTRACTS; FINANCIAL ASSISTANCE * * * §17-1406. Sole Source Contracts, Emergencies, and Other Exceptions: * * * (8) The provisions of § 17-1402(1)(a) and (1)(c) shall not apply to contracts with not-for-profit entities awarded by the Office of Housing and Community Development, the Department of Human Services, the Health Department, the Recreation Department, the Office of Emergency Shelter and Services, the [Office of Behavioral Health and Mental Retardation] Office of Behavioral Health and Intellectual Disability Services, the Office of Adult Services, the Mayor's Office of Community Services, the Philadelphia Prisons, the Commission on Disabilities, the Commission on Aging, or the Office of the District Attorney. All other provisions of this Chapter shall apply to such contracts, except that the disclosures required by § 17-1402(1)(b) need not be filed until fourteen days after a contract is executed. * * * SECTION 3. Title 20 is hereby amended to read as follows: TITLE 20. OFFICERS AND EMPLOYEES. * * * CHAPTER 20-300. COMPENSATION AND BENEFITS. * * * §20-304. Compensation for Members of Boards, Commissions, Committees and Councils . * * * (23) Mental Health and [Mental Retardation] Intellectual Disability Board. Each member of the Mental Health and [Mental Retardation] Intellectual Disability Board shall receive thirty (30) dollars compensation for each meeting of the Board which he attends; provided, that the total compensation paid to each member in any year shall not exceed three hundred sixty (360) dollars. * * * SECTION 4 This Ordinance shall become effective immediately. __________________________ Explanation: [Brackets] indicate matter deleted.
