..Title Amending Title 2 of The Philadelphia Code to provide for the powers and duties of the Department of Prisons created under Section 3-100 of the Home Rule Charter; and further amending Title 20 of The Philadelphia Code to provide for the salary of the Commissioner of Prisons, all under certain terms and conditions. ..Body THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS: SECTION 1. Chapter 2-100 of The Philadelphia Code is hereby amended to read as follows: CHAPTER 2-100. CITY-COUNTY CONSOLIDATION * * * § 2-104. Board of Inspectors of the Philadelphia County Prison. (1) The Board of Inspectors of the Philadelphia County Prison is abolished. (2) All powers and duties previously exercised and performed by the former Board of Inspectors of the Philadelphia County Prison are transferred to [the Board of Trustees of Philadelphia Prisons.] the Department of Prisons. * * * § 2-107. [Board of Trustees of Philadelphia Prisons. (1) There is hereby created a Board of Trustees of Philadelphia Prisons which shall be a departmental board attached to the Department of Public Welfare. It shall consist of seven persons appointed by the Mayor and shall be organized and shall function as other departmental boards under the Charter. (2) The Board of Trustees of Philadelphia Prisons shall exercise all the powers and perform all the duties previously exercised and performed by the Board of Inspectors of the Philadelphia County Prisons.] Reserved. * * * § 2-112. City Commissioners. * * * (5) The following powers, duties and functions of the office of the City Commissioners are transferred as follows: * * * (b) All matters relating to payment to the Commonwealth for the care of prisoners, to the Department of [Public Welfare;] Prisons; SECTION 2. Effective Date. This Ordinance shall be effective upon approval by the voters, at the Special Election of November 4, 2014, of the amendment to The Philadelphia Home Rule Charter proposed in Resolution 140035. ..End
