..Title Approving the Agreement of Agency Designation pursuant to the Redevelopment Cooperation Law between the Philadelphia Redevelopment Authority and the Philadelphia Housing Authority for the purpose of considering the acquisition of property by the Philadelphia Housing Authority to support its Blumberg Project. ..Body WHEREAS, The Philadelphia Housing Authority ("PHA") is considering undertaking a project (the "Blumberg Project") for the revitalization of an area of Philadelphia located in the vicinity of 19th street to the east, 27th street to the west, College avenue to the south, and Cecil B. Moore avenue to the north (the "Project Site"); and WHEREAS, The Blumberg Project will promote the health and welfare of the citizens of Philadelphia by providing safe and sanitary dwelling accommodations for persons of low-income through construction of new housing and will provide for related mixed-use development, all as authorized by the Housing Authorities Law; and WHEREAS, In order to assemble the land for the Blumberg Project, PHA would have to acquire certain properties within the Project Site; and WHEREAS, Pursuant to § 6.1 of the Redevelopment Cooperation Law, Act of May 24, 1945, P.L. 982, § 6.1; added by the Act of January 19, 1968, P.L. (1967) 987, § 2; 35 P.S. § 1746.1, PHA may designate and appoint the Philadelphia Redevelopment Authority ("PRA") its agent to perform any specified activity that PHA is authorized by law to perform, so long as such activity is in furtherance of the public purposes specified in the Urban Redevelopment Law (the "URL"); and WHEREAS, PRA and PHA desire to enter into an Agreement of Agency Designation (the "Agency Agreement") wherein PHA will designate PRA as PHA's agent to perform the activities necessary to allow PHA to consider acquisition of properties needed to proceed with the Blumberg Project; and WHEREAS, The Blumberg Project furthers the public purposes specified in the URL and, therefore, the Redevelopment Cooperation Law authorizes the Agency Agreement; and WHEREAS, The Redevelopment Cooperation Law requires that the Council of the City of Philadelphia approve the Agency Agreement; and WHEREAS, The City of Philadelphia ("City") shall expend no City funds for the activities to be performed under the Agency Agreement; and WHEREAS, No debt or liability shall be incurred by or on behalf of the City nor shall the credit of the City be pledged in any way with respect to the Agency Agreement; and WHEREAS, PHA shall bear all costs and expenses incurred by PRA which are attributable or allocable to PRA's activities under the Agency Agreement; now, therefore, be it RESOLVED, BY THE COUNCIL OF THE CITY OF PHILADELPHIA, That the Agreement of Agency Designation (the "Agency Agreement") pursuant to the Redevelopment Cooperation Law between the Philadelphia Redevelopment Authority and the Philadelphia Housing Authority for the purpose of considering the acquisition of property in the name of the Philadelphia Housing Authority in connection with Philadelphia Housing Authority's Blumberg Project is hereby approved; provided, however, that the Agency Agreement provide that no funds of the City of Philadelphia shall be expended, no debt or liability shall be incurred by or on behalf of the City of Philadelphia, the credit of the City of Philadelphia shall not be pledged in any way with respect to the Agency Agreement and the Philadelphia Housing Authority shall bear all costs and expenses incurred pursuant to the Agency Agreement. FURTHER RESOLVED, That the City Solicitor may review the Agency Agreement for the purpose of determining that the Agency Agreement complies with this Resolution as it relates to pledging funds or the credit of the City of Philadelphia or incurring debt by the City of Philadelphia. ..End
