..Title Amending Title 12, entitled "Parking Regulations and Penalties," of The Philadelphia Code, by adding new rules and penalties for persons who offer for sale or sell, lease, reserve or facilitate the reserving of any parking space located on a street, roadway, cartway, or portion thereof, owned or controlled by the City of Philadelphia, all under certain terms and conditions. ..Body THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS: SECTION 1. Title 12 is hereby amended as follows: § 12-1401. Traffic Violation Notices; Parking Violation Notices. (1) A notice of violation of any provision of this Title (other than any provision relating to parking) may be issued by any police officer by handing such notice to the offender or affixing the notice securely in a prominent place on the vehicle. Notices of violation shall be serially numbered, and shall include the license number and type of vehicle, the date, time, place and nature of the violation, and a space which can be filled out by the driver of such vehicle in the event he waives hearing of and acknowledges commission of the violation charged. (2) The original and first copy of such notice of violation shall be transmitted to the Traffic Court, the second copy shall be retained by the Police Department, and the third copy shall be handed or mailed to the offender or affixed securely in a prominent place on the vehicle. (3) Such traffic violation notice forms shall be in the form prescribed and approved by the Chief Magistrate. (4) Parking violation notices and violation notices issued pursuant to § 12-3101 shall be prepared, issued and transmitted in accordance with the provisions of Chapter 12-2800 of this Title. * * * CHAPTER 12-3100. SELLING, LEASING, OR RESERVING OF PARKING SPACES ON PUBLIC STREETS PROHIBITED. § 12-3101. Prohibiting the Selling, Leasing, or Reserving of Public Parking Spaces. (1) No person or other entity, other than the City and its designees, shall sell, lease, or reserve any space located in any street, roadway or cartway, or portion thereof, under the control of the City. (2) No person or other entity, other than the City and its designees, shall assist or conspire with any person or entity to sell, lease or reserve of any space located in any street, roadway or cartway, or portion thereof, under the control of the City. (3) Any violation of this Section is punishable by a $250.00 fine for each violation. Each sale, lease or reservation of any space, or offer to perform such, shall constitute a separate violation.
