..Title Authorizing the Commissioner of Public Property, on behalf of the City of Philadelphia, to accept one or more deeds to parcels of land, located at 1114-18 Locust Street, 1127-31 Waverly Street, 831-839 South Street; amending Chapter 15-200 of The Philadelphia Code, entitled "Fairmount Park," to include the gardens under the jurisdiction of the Department of Parks and Recreation; and authorizing the Commissioner of the Department of Parks and Recreation to enter into an agreement to lease out such property. ..Body THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS: SECTION 1. The Commissioner of Public Property is hereby authorized to accept the deed(s) from PRA and other parties that convey title to the City to 1114-18 Locust Street ("Sartain Community Garden"), 831-839 South Street ("South Street Garden"), and 1127-31 Waverly Street ("Waverly Garden"), in Philadelphia, Pennsylvania, and authorizing the Commissioner of Public Property to execute all other documents necessary or appropriate for the purposes of accepting title to the Parcels. SECTION 2. Chapter 15-200 of The Philadelphia Code is hereby amended to read as follows: CHAPTER 15-200. FAIRMOUNT PARK §15-201. Jurisdictional Areas. The following areas shall be under the care and jurisdiction of the Fairmount Park Commission: * * * (i)1114-18 Locust Street ("Sartain Community Garden") (ii) 1127-31 Waverly Street ("Waverly Garden") (iii) 831-839 South Street ("South Street Garden") and other areas which by ordinance have been or will be placed under the care and jurisdiction of that Commission. * * * SECTION 3. Section 2 of this Ordinance shall not take effect until the City has acquired the Gardens pursuant to all other documents necessary or appropriate for the purposes of accepting title to the Parcels. The remainder of this Ordinance shall take effect immediately. SECTION 4. The Commissioner of the Department of Parks and Recreation is hereby authorized to enter into a lease agreement with a term length of up to 10 years, under certain terms and conditions that the City Solicitor deems necessary and prudent, to lease to the Washington West Civic Association, either directly or through a lease with an authority and sublease to Washington West Civic Association. SECTION 5. The City Solicitor is hereby authorized to review and approve all the instruments and documents necessary to effectuate this Ordinance, which instruments and documents shall contain such terms and conditions as the City Solicitor shall deem necessary and proper to protect the interest of the City of Philadelphia and carry out the purpose of this Ordinance. ..End 2
