..Title Amending Section 9-201 of The Philadelphia Code, entitled "Curb Markets," by adding and clarifying the special provisions for the South 9th Street Curb Markets. ..Body THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS: SECTION 1. Section 9-201 of The Philadelphia Code ("Curb Markets") is amended to read as follows: § 9-201. Curb Markets. (1) Definitions. In this Section, the following definitions apply: * * * (10) Special Provisions for South 9th Street Curb Market. * * * (a) Beginning January 1, 2014, the Department is authorized to issue a single curb market license governing multiple curb market spaces as defined in this Section in the area defined in subsection 9-201(2)(c). Eligibility for such license shall be limited to business associations associated with that vending area and shall be awarded based on ability to manage the allocation of vending spaces. Licensees that have individual licenses to spaces not included within a license governing multiple curb market spaces shall be permitted to retain their separate individual licenses provided they continue to comply with licensing requirements. (b) Such association shall be responsible for allocating the spaces designated in the license among vendors who seek to use such spaces. Preference shall be given to persons holding licenses before January 1, 2014, and who have regularly occupied or vended at the licensed location. Remaining spaces shall be distributed in an equitable manner, such as first-come first-serve, a lottery or other equitable system. An association that has received a license governing multiple curb spaces shall, by June 1, 2015, submit a list of all individuals of whom the association is aware who had licenses under this section before January 1, 2014. * * * (f) Notwithstanding the provisions of subsection 9-201(3), the holder of any individual license who was also a licensee before January 1, 2014 may be issued licenses for more than two stands. ___________________________________ Explanation: [Brackets] indicate matter deleted. Italics indicate new matter added. ..End
