..Title Authorizing the Legislative Oversight Committee to conduct public hearings to examine the Executive branches enforcement of Bill No. 100011-A "Lead Paint Disclosure" ..Body WHEREAS, The Legislative Oversight Committee is responsible for all matters related to the legislative acts of Council. It is to check with the Executive and Judicial branches on the enforcement of laws passed by Council, on the carrying out of projects voted by the Council, the budgetary expenditures as allowed in the various budget funds and matters relating to the Pennsylvania Convention Center; and WHEREAS, Bill No. 100011-A required a certification from a landlord that a property is lead free or lead safe before it may be rented to a tenant; and WHEREAS, Bill No. 100011-A was originally introduced in City Council by Councilwoman Reynolds Brown and Councilwoman Tasco on January 28th, 2010; and WHEREAS, Bill No. 100011-A was reported favorably from the Committee on Public Health and Human Services on November 30th, 2011; and WHEREAS, Bill No. 100011-A was amended on the floor of City Council on December 8th, 2011; and WHEREAS, Bill No. 100011-A was passed by City Council on December 15th, 2011; and WHEREAS, Bill No. 100011-A was signed by the Mayor on December 21st, 2011; and WHEREAS, Bill No. 100011-A was to take effect one year after adoption; and WHEREAS, The long-term health effects of lead poisoning can result in damage to the kidneys, the nervous system, the cardiovascular system and circulation, behavior, digestion, bones and muscles; and WHEREAS, According to a NBC 10 investigation, since the lead law went into effect the City's health department has certified 1596 rental properties lead free or lead safe; and WHEREAS, According to the homeowner's association of Philadelphia there are roughly 248,000 rental properties in the City; and WHEREAS, According to the health department, there have not been any cases where there's been a fine issued for the lead landlord law; now, therefore, be it RESOLVED, BY THE COUNCIL OF THE CITY OF PHILADELPHIA, That the Legislative Oversight Committee is hereby authorized to conduct public hearings to examine the Executive branches enforcement of Bill No. 100011-A "Lead Paint Disclosure". ..End
