..Title Authorizing the Commissioner of Public Property, on behalf of the City of Philadelphia, to accept title to all or portion of the parcels that constitute the Waverly Street Community Garden, located in the area bounded by 12th Street, Waverly Street, South Quince Street, and Pine Street; and amending Chapter 15-200 of The Philadelphia Code, entitled "Fairmount Park System," to include the Waverly Street Community Garden among the areas designated as part of the Fairmount Park System and to make technical changes; all under certain terms and conditions. ..Body THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS: SECTION 1. The Commissioner of Public Property is hereby authorized to accept title from the Philadelphia Redevelopment Authority and other parties to all or a portion of the parcels that constitute the Waverly Street Community Garden, located in the area bounded by 12th Street, Waverly Street, South Quince Street, and Pine Street, and authorizing the Commissioner of Public Property and the Commissioner of Parks and Recreation to execute all other documents necessary or appropriate for the purposes of accepting title to the Waverly Street Community Garden. SECTION 2. The City Solicitor is hereby authorized to review and approve all the instruments and documents necessary to effectuate this Ordinance, which instruments and documents shall contain such terms and conditions as the City Solicitor shall deem necessary and proper to protect the interest of the City of Philadelphia and carry out the purpose of this Ordinance. SECTION 3. Chapter 15-200 of The Philadelphia Code is hereby amended to read as follows: CHAPTER 15-200. FAIRMOUNT PARK SYSTEM. §15-201 Jurisdiction Areas. The following areas are part of the Fairmount Park System and shall be under the care and jurisdiction of the Department of Parks and Recreation: * * * 2140 Market Street, [1114-18 Locust Street ("] Sartain Community Garden [")], [1127-31] Waverly Street Community Garden [("Waverly Garden")], [831-839] South Street Garden [("South Street Garden")], and other areas which by ordinance have been or will be designated as part of that System. SECTION 4. Section 3 of this Ordinance shall not take effect until the City has taken title to the Waverly Street Community Garden parcels.
