..Title Calling upon the Managing Director's Office of Philadelphia to promptly comply with Council Bill 1156 passed on February 25, 1987 by: (i) transferring fee simple title to 451 South University Avenue from the Department of Public Property to PIDC; and (ii) requesting that PIDC transfer fee simple title to 451 South University Avenue and the land upon which it is located to The Consortium for nominal consideration as soon as practicable. ..Body WHEREAS, The Consortium has been providing drug and alcohol counseling services at 451 South University Avenue for over four decades, seeing hundreds of clients each day; and WHEREAS, As the Opioid Crisis escalates, The Consortium continues to provide excellent care to its clients, regardless of their ability to pay; and WHEREAS, On February 25, 1987, City Council approved Bill No. 1156 (the "Ordinance") which, Mayor Goode later approved, authorizing the Commissioner of Public Property to convey 451 South University Avenue to the Philadelphia Industrial Development Corporation ("PIDC") for no consideration, with the understanding that property would be leased for nominal consideration to The Consortium; and WHEREAS, The transfer of 451 South University Avenue was structured in order to meet the requirements of the Home Rule Charter, which preclude the direct transfer of City property to a private entity without consideration; and WHEREAS, For over thirty years, the City has failed to transfer 451 South University Avenue consistent with the Ordinance, forcing The Consortium to serve some of the City's neediest residents in a facility the City has failed to maintain satisfactorily; and WHEREAS, The Managing Director's Office has failed to take action to effectuate the transfer consistent with the Ordinance to date; and WHEREAS, The ownership of 451 South University Avenue by The Consortium will allow it to make necessary renovations, ensuring that its clients receive care in a safe environment; and WHEREAS, The completion of other renovations cannot occur without the transfer of title of 451 South University Avenue to PIDC consistent with the Ordinance; now, therefore, be it RESOLVED, THAT THE COUNCIL FOR THE CITY OF PHILADELPHIA, Calls upon the Managing Director's Office of Philadelphia to promptly comply with Council Bill 1156 passed on February 25, 1987 by: (i) transferring fee simple title to 451 South University Avenue from the Department of Public Property to PIDC; and (ii) requesting that PIDC transfer fee simple title to 451 South University Avenue to The Consortium for nominal consideration as soon as practicable. ..End
