..Title Authorizing the paving of Parker Avenue from a point approximately one-hundred fifty-six feet southwest of Matthias Street to a point approximately one-hundred eighty-six feet further southwestwardly therefrom, under certain terms and conditions. ..Body THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS: SECTION 1. As necessitated by new residential development in the area, the Procurement Commissioner, pursuant to the provisions of Sections 11-502 and 11-503 of The Philadelphia Code, is hereby authorized to enter into a contract for the paving of Parker Avenue from a point approximately one-hundred fifty-six feet southwest of Matthias Street to a point approximately one-hundred eighty-six feet further southwestwardly therefrom. SECTION 2. In lieu of the provisions of Section 1, the party in interest shall file an agreement and such bonds with corporate surety, satisfactory to the City Solicitor and in amounts determined by the Streets Department, to cover (a) the cost of the work required to completely pave the said portion of Parker Avenue and (b) such other costs or potential costs associated with the paving of Parker Avenue as the City Solicitor determines is appropriate, all the foregoing at such party in interest's sole cost and expense and in accordance with the specifications and requirements of the City of Philadelphia. SECTION 3. No contract or agreement for the paving work authorized herein shall be entered into unless and until the following requirements have been met: (a) The dedication to the City by the owner or owners of property affected thereby, without cost and free and clear of all encumbrances, of the bed of said Parker Avenue as proposed to be paved under authority of this Ordinance. SECTION 4. This Ordinance shall not become effective unless the sum of two hundred dollars ($200.00), toward the cost thereof, is paid into the City Treasury within one hundred and twenty (120) days after this Ordinance becomes law. ..End 1
