..Title Authorizing the Commissioner of Public Property, on behalf of the City, to acquire fee simple title, or a lesser interest in real estate, by purchase, dedication, donation, condemnation, agreement in lieu of condemnation, or otherwise, in parcels of land along the Schuylkill River and the Wissahickon Creek for public recreational purposes, under certain terms and conditions. ..Body WHEREAS, the City would like to acquire fee simple or lesser interest in real estate, by purchase, dedication, donation, condemnation, agreement in lieu of condemnation or otherwise, in parcels of land along the Schuylkill River and the Wissahickon Creek for public recreational purposes; and WHEREAS, the portions of land the City desires to acquire fee simple or lesser interest in real estate connects to City of Philadelphia park land along the Wissahickon Creek; now, therefore THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS: SECTION 1. The Commissioner of Public Property, on behalf of the City, is authorized to acquire by purchase, dedication, donation, condemnation, agreement in lieu of condemnation or otherwise, fee simple title or a lesser interest in real estate, in some or all of the parcels of land identified in Section 2 of this Ordinance along the Schuylkill River and the Wissahickon Creek, needed for the purpose of making, enlarging, extending, operating and maintaining public parks for public recreation use. SECTION 2. The lands subject to this Ordinance include the land along the Wissahickon Creek and the Schuylkill River bounded as follows: 1. on the NORTH by southside of Ridge Avenue and continuing on Main Street; and 2. on the WEST by the southside of Pencoyd Bridge; and 3. on the EAST, following the course of the Wissahickon Creek; and 4. on the South, following the course of the Schuylkill River. SECTION 3. The City Solicitor is authorized to review and approve all documents necessary to complete the acquisitions authorized by this Ordinance. The City Solicitor is further authorized to include in those documents provisions that the City Solicitor deems necessary and desirable to protect the interests of the City. ..End
