..Title Proposing an amendment to the Philadelphia Home Rule Charter providing for a mandatory annual appropriation for the Housing Trust Fund; and providing for the submission of the proposed amendment to the electors of Philadelphia. ..Body WHEREAS, Under Section 6 of the First Class City Home Rule Act (53 P.S. �13106), an amendment to the Philadelphia Home Rule Charter may be proposed by a resolution of the Council of the City of Philadelphia adopted with the concurrence of two-thirds of its elected members; now, therefore, be it RESOLVED, BY THE COUNCIL OF THE CITY OF PHILADELPHIA: SECTION 1. That the following amendment to the Philadelphia Home Rule Charter is hereby proposed and shall be submitted to the electors of the City of Philadelphia on an election date designated by ordinance: ARTICLE II LEGISLATIVE BRANCH The Council - Its Election, Organization, Powers and Duties * * * CHAPTER 3 LEGISLATION * * * � 2-300. The Annual Operating Budget Ordinance. * * * (4) In every annual operating budget ordinance: * * * (g) An amount equal to at least one half of one percent (0.5%) of the City's total General Fund appropriations in such ordinance shall be appropriated for expenditure out of the Housing Trust Fund as established pursuant to the Act of July 14, 2005, P.L. 280, No. 49, 53 Pa. C.S. � 6001, et seq. and Chapter 21-1600 of The Philadelphia Code ("Housing Trust Fund"), for expenditure for the same general purposes as provided for under such laws. Such appropriation shall be in addition to any appropriation the source of funding of which is the receipt of recording fees authorized for expenditure pursuant to such laws. Such amount shall not be subject to a transfer pursuant to paragraph (6) of this Section unless the Director of Finance certifies that without such a transfer there will be a material disruption in City services or that the appropriations are needed to fund emergency programs necessary to protect the health, safety or welfare of City residents and that it would be fiscally imprudent to seek emergency appropriations pursuant to Section 2-301(a). * * * APPENDIX * * * CHAPTER A-2 � A-200. Schedule. This charter shall become effective on the first Monday of January, 1952, except in the following particulars: * * * ( ) The amendments to this Charter adding subsection 2-300(4)(g) shall first take effect with respect to the operating budget ordinance for Fiscal Year 2023. * * * Italics indicates matter added to the Charter by these amendments. ..End 2
