January 18, 2022 TO THE PRESIDENT AND MEMBERS OF THE COUNCIL OF THE CITY OF PHILADELPHIA: I am hereby returning without my signature Bill No. 210865, which was passed by Council at its session on December 9, 2021. Bill No. 210865 amends the "/FNE, Far Northeast Overlay District," to prohibit eligibility for floor area, height, and dwelling unit bonuses and to increase minimum parking requirements. The Philadelphia City Planning Commission (PCPC) reviewed this legislation and recommended against approval. The PCPC noted that this bill may reduce the ability to construct new by-right housing in part of the City where demand is growing and the one parking space per one unit ratio does not support a walkable commercial corridor. It further noted that the prohibition of bonuses will hinder Citywide initiatives to manage stormwater and support housing programs. While my Administration shares the concerns of the PCPC, I understand that the bill sponsor intends to introduce additional legislation addressing these concerns.
