..Title Authorizing the Commissioner of Public Property, on behalf of the City of Philadelphia, to grant to the Pennsylvania Department of Transportation, an easement on a portion of the parcel or parcels of land in and about the area bounded by Market Street, 24th Street, Spruce Street and the Schuylkill River, under certain terms and conditions. ..Body THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS: SECTION 1. The Commissioner of Public Property, on behalf of the City of Philadelphia, is hereby authorized to enter into a temporary construction easement agreement for the purpose of constructing transportation improvements, and a permanent aerial easement for the accommodation of an elevated highway, with the Pennsylvania Department of Transportation for a portion of the parcel or parcels of land in and about the area bounded by Market Street, 24th Street, Spruce Street and the Schuylkill River, commonly known as a portion of the Schuylkill River Trail, as more fully described in Exhibit A. SECTION 2. The City Solicitor is hereby authorized to review and to approve all instruments and documents necessary to effectuate this Ordinance, which instruments and documents shall contain such terms and conditions as the City Solicitor shall deem necessary and proper to protect the interest of the City of Philadelphia and to carry out the purposes of this Ordinance. ..End
