..Title Approving a Substantial Amendment to the Consolidated Plan 2022-2026 and Annual Action Plan 2022-2023 to add $163,204,000 in Community Development Block Grant - Disaster Recovery ("CDBG-DR") funding, all under certain terms and conditions. ..Body WHEREAS, In accordance with Council's adoption of Bill No. 220509 (approved June 23, 2022), the City has filed applications for various forms of United States Department of Housing and Urban Development ("HUD") funding, as set forth in the City's Consolidated Plan 2022-2026 and Annual Action Plan 2022-2023; and WHEREAS, Congress appropriated Community Development Block Grant - Disaster Recovery (CDBG-DR) funds through the Disaster Relief Supplemental Appropriations Act, 2022 (Public Law 117-43) and the Continuing Appropriations Act, 2023 (Public Law 117-180) to HUD to address housing, infrastructure, and economic revitalization needs resulting from disasters and to implement mitigation strategies to prevent damage from future disasters; and WHEREAS, On May 24, 2022, HUD allocated $98,701,000 in CDBG-DR funds and on January 18, 2023, HUD allocated an additional $64,503,000 in CDBG-DR funds for a total of $163,204,000 in CDBG-DR funds to the City of Philadelphia to advance long term disaster recovery after the remnants of Hurricane Ida; and WHEREAS, The City has prepared a Draft CDBG-DR Action Plan in accordance with CDBG-DR guidance (attached hereto as Exhibit "A"), now, therefore, THE COUNCIL OF THE CITY OF PHILADELPHIA HEEBY ORDAINS: SECTION 1. A Substantial Amendment to the Consolidated Plan 2022-2026 and Annual Action Plan 2022-2023 to add $163,204,000 in Community Development Block Grant - Disaster Recovery ("CDBG-DR") funding, as set forth and more fully described in Exhibit "A" attached hereto, is hereby approved. Exhibit A City of Philadelphia Substantial Amendment to the Consolidated Plan 2022-2026 and Annual Action Plan 2022-2023 CDBG-DR Allocation BACKGROUND The U.S. Department of Housing and Urban Development (HUD) allocated the City of Philadelphia a total of $163,204,000 in Community Development Block Grant-Disaster Recovery (CDBG-DR) funds through the publication of the Federal Register, Vol. 87, No. 100, May 24, 2022 and Federal Register, Vol. 88, No. 11, January 18, 2023. This allocation was made available through the Disaster Relief Supplemental Appropriations Act, 2022 (Public Law 117-43) and the Continuing Appropriations Act, 2023 (Public Law 117-180). CDBG-DR funding is designed to address needs that remain after all other assistance has been exhausted. To fulfill the requirements of this allocation, the City was required to submit a Draft CDBG-DR Action Plan that identifies its unmet recovery and mitigation needs. This Draft CDBG-DR Action Plan outlines proposed uses of CDBG-DR funds and eligible activities available to assist impacted areas in meeting unmet housing, infrastructure, planning, and economic revitalization needs resulting from Hurricane Ida's impacts. Specifically, this plan aims to promote and ensure fair access to housing for low-to-moderate income residents and strengthen neighborhoods impacted by the disaster by investing in housing, infrastructure, public facilities, along with public services and planning. In addition, the Draft CDBG-DR Action Plan describes how CDBG-DR funds will be targeted toward and meet the needs of vulnerable communities, including those with low to moderate income, limited English proficiency, racially and ethnically concentrated communities, and individuals experiencing homelessness. The City published the Draft CDBG-DR Action Plan on its website on July 14, 2023. City staff received over 80 public comments during the 30-day public comment period ending on August 15, 2023, all of which are addressed in the Draft CDBG-DR Action Plan submitted to HUD. Per the Federal Register's approach for CDBG-DR grantees with allocations under $500 million, the City convened two public hearings on August 8, 2023. The City submitted its Draft CDBG-DR Action Plan to HUD on August 21, 2023.
