..Title Authorizing Norris Street Holdings, LLC to install, own, and maintain a Streetery in the Right-of-Way adjacent to 2401 E. Norris Street, Philadelphia, PA 19125-2913, under certain terms and conditions. ..Body THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS: SECTION 1. Permission is hereby granted to Norris Street Holdings, LLC (the "Owner"), to install, own, and maintain a Streetery in the Right-of-Way adjacent to 2401 E. Norris Street, Philadelphia, PA 19125-2913 (the "Streetery") as follows: Property: 2401 E. Norris Street, Philadelphia, PA 19125-2913 (the "Property") Streetery Description: A Streetery, occupying the parking lane of the cartway directly in front of the Property and comprising of the following: Two (2) structures, six (6) tables, and twenty (20) seats will be located adjacent to the curb line of 2401 E. Norris Street in the parking lane and will encroach a distance of approximately six feet (6'-0") towards the west, along the east side of the cartway of Cedar Street starting from a point approximately fifty-three feet (53'-0") north of the E. Norris Street north curbline to a point approximately forty-two feet eight inches (42'-8") farther north. SECTION 2. The construction, use, and maintenance of the Streetery described and listed in Section 1 shall be in accordance with the laws, rules and regulations of the City of Philadelphia, and specifically those of the Department of Licenses and Inspections, the Department of Streets, and the Art Commission. SECTION 3. Notwithstanding the authorized location of this Streetery, nothing in this ordinance shall act as a waiver of any requirement of Section 9-215 of the Philadelphia Code for maintenance or use of a Streetery. SECTION 4. Before exercising any rights or privileges under this Ordinance, Owner must first obtain or have its contractor(s) obtain all required permits, licenses and approvals from all appropriate departments, boards, agencies or commissions. No such department, board, agency or commission shall be required to issue any such permit, license or approval solely because this Ordinance has been enacted, it being the express intent of this Ordinance not to supersede any other provision of law governing the issuance of such permits, licenses or approvals. In addition, before exercising any rights and privileges under this Ordinance, Owner shall obtain a Streetery License and comply with the terms and conditions therein. SECTION 5. The permission granted to Owner to install, own, and maintain the Streetery described in Section 1 shall expire without any further action by the City of Philadelphia: (1) if Owner has not obtained a Streetery License within one (1) year after this Ordinance becomes law; (2) if a Department of the City finds a violation of Section 9-215 of the Philadelphia Code prior to issuance of the Streetery License; (3) upon the sale or other conveyance of the business holding the Streetery License for the Property; or (4) if the Property's Streetery license expires without renewal. SECTION 6. This Ordinance shall become effective immediately. ..End
