..Title Amending Chapter 11-200 of The Philadelphia Code, entitled "Openings and Excavations in the Streets," to impose additional penalties on violators of underground permitting requirements, under certain terms and conditions. ..Body THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS Section 1. Chapter 11-200 of The Philadelphia Code is amended to read as follows: TITLE 11. STREETS * * * CHAPTER 11-200. OPENINGS AND EXCAVATIONS IN THE STREETS * * * � 11-203. Sewer and Water Pipe and Other Underground Service. * * * (11) No permit shall be issued to [any person] an applicant who has violated this Chapter until all charges, fines and penalties have been paid. This paragraph shall not apply to any public utility, as defined by Section 102 of the Pennsylvania Public Utility Code, 66 Pa. C.S. � 102, but shall apply to their contractors. * * * � 11-204. Underground Wires. * * * (4) No permit shall be issued to an applicant who has violated this Chapter until all charges, fines and penalties have been paid. This paragraph shall not apply to any permittee who is party to an existing right-of-way agreement or franchise with the City or to any public utility, as defined by Section 102 of the Pennsylvania Public Utility Code, 66 Pa. C.S. � 102, but shall apply to contractors of said permittees and public utilities. ...[(4)] (5) Any person who has been permitted to lay underground wires shall relocate such wires upon the written request of the Department of Streets or any other City agency, when they will interfere with proposed construction. * * * � 11-205. Penalties. (1) The maximum penalty for violation of Sections 11-203 and 11-204 shall be four hundred fifty dollars ($450) for each offense. Each day the violation continues is a separate offense.
