..Title Amending Chapter 9-600 of the Philadelphia Code, entitled, Service and Other Businesses, to add a definition of fitness centers and provide a limited exception to the curfew permitting earlier hours of operation in the Seventh and Eighth Councilmanic Districts, all under certain terms and conditions. ..Body THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS: Section 1: Title 9 of The Philadelphia Code is hereby amended as follows: TITLE 9. REGULATION OF BUSINESSES, TRADES AND PROFESSIONS * * * CHAPTER 9-630. SEVENTH DISTRICT COMMERCIAL BUSINESS HOUR RESTRICTION. (1) Definitions. * * * (b) Fitness Facility. A commercial establishment primarily engaged in offering space, equipment, and programs for physical exercise, conditioning, and general health and wellness activities. Typical activities include cardiovascular training, strength training, group fitness classes, and similar physical activities. Fitness Facilities do not include medical treatment facilities, sports stadiums, or youth-oriented instructional programs that are regulated under separate provisions. * * * (2) Prohibited Conduct. Notwithstanding any other provision of this Code, no Commercial Establishment shall be open to the public between 11 p.m. and 6 a.m. within the Seventh Councilmanic District. (a) Exceptions. (.1) A Fitness Facility may be open to the public beginning at 5:00 a.m. (3) Penalties. The penalty for a violation of this Section shall be a fine of one thousand dollars ($1,000) for each offense for each day the violation continues. * * * CHAPTER 9-645. EIGHTH DISTRICT COMMERCIAL BUSINESS HOUR RESTRICTION (1) Definitions. (a) Commercial Establishment. As defined in Section 9-630. (b) Fitness Facility. A commercial establishment primarily engaged in offering space, equipment, and programs for physical exercise, conditioning, and general health and wellness activities. Typical activities include cardiovascular training, strength training, group fitness classes, and similar physical activities. Fitness Facilities do not include medical treatment facilities, sports stadiums, or youth-oriented instructional programs that are regulated under separate provisions. (2) Prohibited Conduct. Notwithstanding any other provision of this Code, no Commercial Establishment shall be open to the public between 11 p.m. and 6 a.m. within the Eighth Councilmanic District. (a) Exceptions. (.1) A fitness facility may be open to the public beginning at 5:00 a.m. (3) Penalties. The penalty for a violation of this Section shall be a fine of one thousand dollars ($1,000) for each offense for each day the violation continues. (4) Sunset Provision. The provisions of this Section 9-645 shall expire December 31, 2030.
