..Title Authorizing the revision of lines and grades on a portion of City Plan Nos. 163 and 310 by revising the curb lines and grades on a portion of School House Lane from Henry Avenue to Cresson Street, by placing on the City Plan School House Lane from Cresson Street to Ridge Avenue, by revising the lines and grades of Ridge Avenue from a point approximately one hundred and twenty (120) feet southeast of School House Lane to a point approximately five hundred (500) feet northwest of School House Lane, by vacating that portion of the open and traveled School House Lane lying between the existing open and traveled lines and the lines as proposed to be placed under the authority of this Ordinance, and by reserving and placing on the City Plan a right-of-way for drainage purposes, water main purposes and public utility purposes within the bed of Ridge Avenue and a portion of the open and traveled School House Lane, under certain terms and conditions. ..Body THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS: SECTION 1. Pursuant to Section 11-405 of The Philadelphia Code, the Board of Surveyors of the Department of Streets is authorized to revise the lines and grades on a portion of City Plan Nos. 163 and 310 by: (a) revising the curb lines and grades on a portion of School House Lane from Henry Avenue to a point approximately two hundred and fifty (250) feet south of Henry Avenue by: (1) Relocating the westerly curb line approximately two (2) feet eastwardly; (2) Relocating the easterly curb line approximately eight (8) feet westwardly; (b) Revising the curb lines and grades on a portion of School House Lane from a point approximately two hundred and fifty (250) feet south of Henry Avenue to a point approximately one thousand five hundred (1,500) feet south of Henry Avenue by: (1) Relocating the westerly curb line approximately four (4) feet eastwardly; (2) Relocating the easterly curb line approximately eight (8) feet westwardly; (c) Revising the curb lines and grades on a portion of School House Lane from a point approximately one thousand five hundred (1,500) feet south of Henry Avenue to a point approximately one thousand six hundred and thirty one (1,631) feet south of Henry Avenue by: (1) Relocating the westerly curb line a variable distance eastwardly; (2) Relocating the easterly curb line a variable distance eastwardly and westwardly; (d) Revising the curb lines and grades on a portion of School House Lane from a point approximately one thousand six hundred and thirty one (1,631) feet south of Henry Avenue to a point approximately two hundred and twenty (220) feet south of Gypsy Lane as it exists east of School House Lane by: (1) Relocating the westerly curb line approximately fourteen (14) feet eastwardly; (2) Relocating the easterly curb line approximately two (2) feet westwardly; (e) Revising the curb lines and grades on a portion of School House Lane from a point approximately two hundred and twenty (220) feet south of Gypsy Lane as it exists east of School House Lane to Cresson Street by: (1) Relocating the westerly curb line a variable distance eastwardly; (2) Relocating the easterly curb line two feet eastwardly; (f) Placing on the City Plan School House Lane forty (40) feet wide from Cresson Street, southwardly and westwardly to Ridge Avenue. (g) Revising the lines and grades of Ridge Avenue from a point approximately one hundred and twenty (120) feet southeast of School House Lane to a point approximately five hundred (500) feet northwest of School House Lane by: (1) Relocating the northerly curb line a variable distance southwardly; (2) Relocating the southerly curb line a variable distance southwardly; (3) Relocating the northerly house line a variable distance southwardly; (4) Relocating the southerly house line a variable distance southwardly; (h) Vacating that portion of the open and traveled School House Lane lying between the existing open and traveled lines of School House Lane and the lines of School House Lane as proposed to be placed under the authority of this Ordinance. (i) Reserving and placing on the City Plan a right-of-way for drainage purposes, water main purposes and public utility purposes (variable width) within the area between the present confirmed northerly house line of Ridge Avenue and the northerly house line of Ridge Avenue as proposed to be placed under authority of this Ordinance, and the present northerly open and traveled line of School House Lane and the northerly house line of School House Lane, as proposed to be placed under authority of this Ordinance, lying along and near the line of contiguous limit between Ridge Avenue and the open and traveled School House Lane to the intersection of the open and traveled School House Lane with School House Lane as proposed to be placed under authority of this Ordinance. (j) By declaring that portion of Ridge Avenue, being relocated under the authority of this Ordinance, wholly within the lands of the City of Philadelphia, to be legally open. SECTION 2. This authorization is conditional upon compliance with the following requirements: (a) The dedication to the City, without cost and free and clear of all encumbrances, of those certain portions of ground wholly within the lands now held by the Philadelphia Housing Authority and lying within the bed of School House Lane as proposed to be placed on the City Plan by the authority of this Ordinance. (b) The filing of an agreement by the owner or owners of property affected thereby, granting to the City the aforesaid right-of-way for drainage purposes, water main purposes and public utility purposes in Section 1(i) of this Ordinance. The agreement shall provide that no changes in grades shall be made and that no fences, buildings or other structures, either overhead, underground or upon the surface shall be constructed within the lines of the right-of-way or abutting thereon, unless the plans for such structures shall first be submitted to and approved by the Philadelphia Water Department and other municipal or public utility authorized by this ordinance to occupy the utility right-of-way. The agreement shall also grant the right-of-access and occupation at any and all times to the officers, agents, employees and contractors of the City and other municipal or public utility authorized by this Ordinance to occupy the utility right-of-way for the purpose of construction, reconstruction, maintenance, alterations, repairs and inspection of present and future facilities and structures. SECTION 3. The provisions of The Philadelphia Code, Section 14-2104 relating to the width of streets, shall not apply to School House Lane. SECTION 4. This Ordinance shall become effective upon approval and confirmation of the Board of Surveyors. ..End
