An ordinance amending Chapter 19-2600 of the Philadelphia Code entitled "Business Privilege Taxes," by excluding from definition of receipts certain receipts of eating and drinking establishments that provide a smoke-free environment by giving a credit against business privilege taxes to certain eating and drinking establishments that incur losses directly attributed to providing a smoke-free environment by providing a credit against business privilege taxes eating, drinking and lodging establishments that incur in construction costs in connection with INTRODUCTION OF BILLS AND RESOLUTIONS creating separate smoking facilities and by providing certain other exclusions from receipts and certain other tax credits.

And Bill No. 010417 entitled an ordinance authorizing the Director of Commerce, the Commissioner of Public Property on behalf of the City of Philadelphia to execute and deliver the consenting to the execution and delivery by Philadelphia Authority for Industrial Development of the agreements with the Commonwealth which shall provide upon the occurrence of certain events described in this ordinance which would permit the use or occupancy of said baseball ballpark facility or said football stadium facility by or for certain professional baseball and football teams which now or hereafter conduct their home games elsewhere in the Commonwealth of Pennsylvania. REPORTS FROM COMMITTEES And Bill No. 010418 entitled an ordinance authorizing transfers in appropriation for FY 2002 from the General Fund, the Director of Finance contribution to the School District to the Grants Revenue Fund. And Bill No. 010419 entitled an ordinance amending Chapter 19-1300 of the Philadelphia Code entitled "Real Estate Taxes," and amending Chapter 19-1800 of the Philadelphia Code entitled "School Tax Authorization." I just want to make it clear for the record that at this point in time I shouldn't be counted in the category of supporting this bill at the present. But I do SECOND READING AND FINAL PASSAGE CALENDAR commend Councilman Nutter for his efforts to amend the bill and will be supporting the amendments. I think it's important that the Members of Council who are right now not supporting 000314AA which will soon become 000314AAA should recognize that these amendments in the event that Councilman Nutter gets the needed number of votes to pass it finally are amendments will help the bar and restaurant owners. It will provide some level of protection both as a tax incentive, but also a way out of the whole prohibition on smoking altogether if in fact they can show that it has hurt their business. So while at this point in time I'm not supporting the overall concept of the bill, will be supporting the amendments because I do believe that these amendments represent a protection to the bar owners and restaurant owners ultimately if this bill is passed. But as long as it's not a voluntary bill, it infringes on other people's rights. You know, we complain around here when the Administration sends us bills down at the last hour, and I know Councilman Nutter just worked this out and he was forthright with everything he's saying, but what's the rush?

Thank you, Madam President. I would like to echo Councilman Kenney's comments. I think the amendments should be viewed at least at the minimum as a bridge between the two worlds and the amendments at the end of the day help the particular community that would be adversely affected, and that is the restaurant community.
Madam President, as someone who has been very involved in this process along with Councilman Nutter, although I'm not very happy about that, but unfortunately I put myself in the middle of this many months ago. Councilman Nutter and I had a very long meeting yesterday with Mike Driscol who is the president of the Tavern Owners Association in Philadelphia and he is bringing back a copy of these amendments to the industry folks for their review. Again, I think Councilman Kenney is correct. Although we're in support of the amendments, that doesn't necessarily mean that we would be support of the bill. We're waiting for a response from the industry. My guess SECOND READING AND FINAL PASSAGE CALENDAR is that they will be quite pleased with most of what is being presented to them, but I also believe that they probably come back with some requests for adjustments and moderations or alterations to the amendments. So it's a work in progress, as far as I'm concerned. And I guess beside Councilman Nutter, I don't think anybody else has been closer to this bill than I have been. Thank you, Madam President.

Think Councilman DiCicco is right. And I think one of the problems here is the forthrightness of Councilman DiCicco and even Councilman Kenney and Reynolds on this issue is that we're being told different things from the people in this industry and that is I think the reason why maybe the Councilman will hold this for another week until we find out exactly what the supporters or opponents -- you know, we're being told one thing and then I'm getting calls from something else. I promised these people I would stand with them on bill. I haven't been contacted by the aforementioned people that Councilman DiCicco SECOND READING AND FINAL PASSAGE CALENDAR talked about. So I would call for a roll call vote. And if he wants to run it today and the amendments pass, fine.
Madam President, to offer another point of view, I'm basically opposed to these amendments, but I'm prepared to support them in the interest of moving forward on what is a very important health issue, and that's the basic substance of the bill sponsored by Councilman Nutter. So if there is a vote, I will be voting in favor of the amendments, although I'm against in general principles the various abatements that are being offered and would only consider them because if they're necessary as a tool to obtain this very important no smoking bill. Madam President, I'm always going to be as accommodating as possible to all of my colleagues. I think that moving forward today actually moves forward the discussion. Councilman Clarke and I had have had an opportunity to talk about some of the concerns that he has. I think they can be addressed. These are, again, just amendments to the bill. It is one small step in a very long process. I think it at least does complete a portion of the bill that was left undone, quite honestly, when it was introduced and was not given much discussion even during the year long period of time that we've been dealing with this SECOND READING AND FINAL PASSAGE CALENDAR particular issue. I think it helps complete the bill, it forwards the discussion. I would at least like to have, I think as Councilman Kenney said, 000314AAA as a newly printed document with these items as a part of it. So I would like to move forward the amendments, at least.

As someone who signed onto the bill and I kind of echo most of the comments that were made today, both pro and con, and I think it's time for us to receive an update of information from the industry. I think the amendments will help those business people that may be impacted if this bill ever got passed. Earlier today in the Caucus Room, I commented on some of the articles that appeared in today's paper concerning proposed wall wrap legislation and I spoke to some of the -- what gave me this idea, basically when I was Europe a couple years and I saw where they take public buildings, even private buildings that are undergoing extensive renovations that require scaffolding to the building. Robin Schatz will be circulating a copy of three of the photographs that were taken in Rome so that folks can look at this over the summer months. I have a rough draft of the wall wrap legislation this upcoming week for people, again, to make comments and review over the summer months. And I won't do anything with the bill, obviously, SPEECHES until the fall. But I'm available for comments. I'm available for discussions. I appreciate everyone taking a looking at this. And by the way, two of the photographs are historical buildings that the wall wraps were placed in Rome, so it's not just an individual owners taking an opportunity to generate revenue for his or her building. These were publicly-owned buildings in Rome that the government has allowed certain types of advertising on scaffolding on a temporary basis. So Robin Schatz will be circulating them for your review. Thank you, Madam President. Madam President, in recent years, the incredible talents of Tiger Woods and the dynamic duo sisters Serena and Venus Williams have ignited an unprecedented amount of interest in the sports of golf and tennis, respectively. In addition, these extraordinary young athletes have brought true meaning to the old saying, "If you can see it work, work hard for it and believe it, you can achieve it." SPEECHES With all of this in mind, I am truly disgusted when the ills of cultural ignorance and bigotry rear their heads in our society in an attempt to discredit the honor and success of anyone. However, ignorance and bigotry are just what we got a whiff of when Syd Rosenberg, the new sports reporter for the Don Imus show stated that, and I quote, he can't stomach either of the Williams sisters and called Venus an animal. He said he couldn't even watch the sisters play any more because he finds them disgusting. Furthermore, when one of Rosenberg's friends jokingly quipped that he should cool down his venom for the Williams sisters because one day the sisters may be in Play Boy, Rosenberg responded that Venus and Serena have a better shot at posing nude for National Geographic than Play Boy. While I doubt that these distinguished and learned sisters would even entertain the thought of doing such a thing, Rosenberg's comments were tasteless and dim-witted. I am pleased to note that Syd Rosenberg was fired from the Don Imus show. And since SPEECHES Rosenberg got the boot hours after making his outlandish remarks, maybe the next time he'll think twice before putting his foot in his mouth. For the record, we should all know that after being fired Rosenberg said that he is not a racist. However, I hope that he has learned like Fuzzy Zoeller, that a man's words and actions are a true reflection of who he is and what he represents. And I'd like to read this quote. I was reading the quotes of Dr. Martin Luther King for a speech I'm going to make on Saturday, but I thought it was appropriate to read after my comments. And I quote. "There is little hope for us until we become tough-minded enough to break loose from the shackles of prejudice, half-truths and downright ignorance." Thank you very much. (Applause.)

Thank you, Madam President. First, I just want to commend my colleague Councilwoman Tasco for, as they say, bringing it home and keeping it real. I really appreciate what you just said and the message that SPEECHES you carry. Madam President, I wanted to share a little bit of information, probably having what some might refer to as somewhat of a middle-aged moment. There are a couple of us around here who are right about at the middle point, with the exception of Councilman Cohen, who have a number of years before us and a number of years behind us and we're kind of -- and so from time to time I do reflect on some things that seem to have happened a long time ago. And I'd like to go back to 1983, which for me personally, was an incredible year of great joy and great sadness, and a number of things happened to me during that year and thoughts of a couple of things that happened this year reminded me of them. In somewhat chronological order, in May of 1983, 18 years ago, the City nominated in the democratic primary the person who was subsequently to become the first black Mayor of the City of Philadelphia, and his son is now our colleague, W. Wilson Goode, Jr. That was an exciting year for the City. It was the first kind of big political campaign that I worked on for a former colleague of SPEECHES many of the Councilmembers here today, the late Councilman-at-Large John C. Anderson. It was the first campaign I worked on. The Councilman was a Councilman-at-Large running for reelection in a primary election that had 57 Council-at-Large candidates. Councilman Anderson in that reelection campaign actually came in first, having nothing to do with my campaign knowledge. Actually, I had none, which the Councilman reminded me on a number of occasions. But it was an exciting time for me and crystallized for me my interest in politics. And 18 years later, I'm here in this Body. Shortly after that election, my son was born, and that was also a great time of joy. Later on that year, later on into June, the Philadelphia 76ers won the NBA Championship and there was a great parade in this City. And because of Councilman Anderson, I actually had an opportunity to participate in the parade and ride along in one of the trucks or floats. And as a very young person, it, again, was a very exciting time. Unfortunately, later that year, great tragedy struck and Councilman Anderson passed away and the City has suffered a loss since that time. SPEECHES Eighteen years later, the young boy who was born in May of 1983 is now 18, two weeks from today will graduate from high school. We also find that our Philadelphia 76ers are in the finals. They played an incredible game last night in great Philadelphia tradition. They never blinked. I think almost all of the game they led the way and shocked the Los Angeles fans. And then when we couldn't put it away in regulation, we toughed it out, we grinded it out and won in overtime. And I'm sure the rest of the games will be exiting. But I want to commend the 76ers. They have continued to thrill us, and I'm looking forward to participating in another parade 18 years later with the Philadelphia 76ers. Thank you, Madam President.

Yes, Madam President, just one more brief statement about the photographs that I circulated and a comment, again, on the article that appeared in a paper, the one that shows "place your ad here" on the base of the ADJOURNMENT Tower William Penn. I certainly would never want to do anything to degrade this magnificent building. Anyone who knows me knows how much I care about this City and the historical buildings and all the other things that we're proud of. But understand while you're reviewing these materials over the summer months that it's not unusual for us to do some very unique things with this building. William Penn has had the Phillies uniform on, the Flyers uniform on, and I'm hoping and praying that he will be wearing a 76ers jersey next week. So I don't find that degrading. We've done things with this building in the past and I'm hopeful we'll do them in the future. Thank you, Madam President.
