..Title Authorizing the revision of lines and grades on a portion of City Plan No. 119 by placing on the City Plan Marvine street from Poplar street to Harper street, Cambridge street from Percy street to Eleventh street and George street from Percy street to Tenth street; by widening Percy street four feet, six inches (4'-6") on the westerly side between Poplar street and Harper street and striking from the City Plan and abandoning two (2) rights-of-way for drainage purposes, under certain terms and conditions including the dedication to the City, free and clear of all encumbrances, of the beds of Marvine street, Cambridge street, George street and the widened portion of Percy street. ..Body THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS: SECTION 1. Pursuant to Section 11-405 of The Philadelphia Code, the Board of Surveyors of the Department of Streets is authorized to revise the lines and grades on a portion of City Plan No. 119 by: (a) Placing on the City Plan Marvine street approximately one hundred seventy-seven (177) feet east of Twelfth street, extending from Poplar street to Harper street. (b) Placing on the City Plan Cambridge street approximately one hundred fourteen (114) feet south of Harper street, extending from Percy street to Eleventh street. (c) Placing on the City Plan George street approximately one hundred eighty-one (181) feet north of Poplar street, extending from Percy street to Eleventh street. (d) Widening Percy street four feet, six inches (4'-6") on the westerly side between Poplar street and Harper street. (e) Striking from the City Plan and abandoning a certain right-of-way reserved for drainage purposes which lies between Eleventh street and Twelfth street extending from Harper street southwardly to Poplar street. (f) Striking from the City Plan and abandoning a certain right-of-way reserved for drainage purposes which lies between Tenth street and Eleventh street extending from Harper street to a point three hundred feet (300') southwardly therefrom. SECTION 2. This authorization is conditional upon compliance with the following requirements within two (2) years from the date this Ordinance becomes law: (a) The filing of an agreement, satisfactory to the Law Department, by the owner or owners of property affected thereby, to release the City from all damages or claims for damages which may arise by reason of the City Plan changes authorized herein; in lieu thereof, only after the party in interest has demonstrated best efforts to obtain such agreement and such efforts are unsuccessful, the party in interest shall file an agreement and bond with corporate surety, satisfactory to the Law Department, to indemnify the City as aforesaid. (b) The filing of an agreement, satisfactory to the Law Department, by the party in interest, to release, indemnify and defend the City from all damages or claims for damages, which may arise by reason of the City Plan changes authorized herein. (c) The dedication to the City, without cost and free and clear of all encumbrances, of the beds of Marvine street, Cambridge street, George street and the widened portion of Percy street as proposed to be placed on the City Plan under authority of this Ordinance. (d) The payment by the party in interest of the cost of advertising the public hearing by the Board of Surveyors on the City Plan changes authorized by this Ordinance. SECTION 3. This Ordinance shall not become effective unless the sum of two hundred dollars ($200.00), toward costs thereof, is paid into the City Treasury within sixty (60) days after this Ordinance becomes law. ..End
