..Title Authorizing the vacating of a portion of Sheaff lane, from a point approximately one thousand five hundred and fifty-three (1553) feet south of Penrose avenue to a point approximately eight hundred and sixty-six (866) feet southwardly therefrom, under certain terms and conditions. ..Body THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS: SECTION 1. The Board of Surveyors of the Department of Streets is authorized and directed to adopt a resolution to vacate Sheaff lane, from a point approximately one thousand five hundred and fifty-three (1553) feet south of Penrose avenue to a point approximately eight hundred and sixty-six (866) feet southwardly therefrom, provided that the following requirements are complied with within one (1) year from the date this Ordinance becomes law: (a) The filing of an agreement, satisfactory to the Law Department, by the owner or owners of property affected thereby, to release the City from all damages or claims for damages which may arise by reason of vacating the aforesaid Sheaff lane, provided that, only after the party in interest has demonstrated best efforts to obtain such agreement and such efforts are unsuccessful, in lieu thereof, the party in interest shall file an agreement and bond with corporate surety, satisfactory to the Law Department, to indemnify the City as aforesaid. (b) The filing of an agreement, satisfactory to the Law Department, by the party in interest, to release, indemnify and defend the City from all damages or claims for damages, which may arise by reason of vacating the aforesaid portion of Sheaff lane. SECTION 2. This Ordinance shall not become effective unless the sum of two hundred (200) dollars, toward costs thereof, is paid into the City Treasury within sixty (60) days after the approval of this Ordinance. ..End
