..Title Authorizing the President of the Fairmount Park Commission to execute a ground lease and license agreement with the Philadelphia Museum of Art corporation ("Corporation") under which the Corporation would (1) construct a parking garage and related improvements in East Fairmount Park in the vicinity of the Philadelphia Museum of Art to primarily serve patrons of the Museum, (2) construct and operate a sculpture garden above the garage, (3) pay all costs to construct, operate, maintain, repair, replace and improve the garage, sculpture garden, and related improvements, (4) construct a new surface parking lot in East Fairmount Park, and (5) make other improvements for the benefit of the City; all under certain terms and conditions. ..Body THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS: SECTION 1. The President of the Fairmount Park Commission is authorized to enter into a Ground Lease and License Agreement ("Agreement") with the Philadelphia Museum of Art corporation ("Corporation") under which the Corporation would (1) construct a parking garage and related improvements to primarily serve patrons of the Philadelphia Museum of Art, (2) construct and operate a sculpture garden above the garage, (3) pay all costs to construct, operate, maintain, repair, replace and improve the garage, sculpture garden, and related improvements, (4) construct a new surface parking lot in East Fairmount Park, and (5) make other improvements for the benefit of the City. SECTION 2. The Agreement must be substantially in the form set forth in the document attached as Exhibit "A" to this ordinance, with changes that the City Solicitor deems necessary or desirable to protect the interests of the City. ..End
