..Title Authorizing and directing the placing upon City Plan No. 350 of a certain 50' wide and a certain 60' wide right-of-way for Water Main purposes and drainage purposes in the area northeast of Susquehanna Road and northwest of Verree Road, under certain terms and conditions. ..Body THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS: SECTION 1. The Board of Surveyors of the Department of Streets is authorized and directed to place upon City Plan No. 350 a 50' wide and a 60' wide right-of-way for Water Main purposes and drainage purposes, described as follows: Beginning at a point on the northeasterly side of Susquehanna Road (60' wide), said point being measured N-49°48'04"-W the distance of 1022.423' from the northwesterly end of a curve having the radius of 15' which connects the northeasterly side of said Susquehanna Road with the northwesterly side of Verree Road (80' Wide); thence continuing from said point of beginning N-49°48'04"-W along the northeasterly side of said Susquehanna Road the distance of 50.721' to a point; thence extending N-49°52'19"-E the distance of 785.434' to a point; thence extending S-40°07'40.70"-E the distance of 1060.654' to a point on the northwesterly side of said Verree Road; thence extending S-49°52'19.30"-W along the northwesterly side of said Verree Road the distance of 60'; thence extending N-40°07'40.70"-W the distance of 1010.654' to a point; thence extending S-49°52'19"-W the distance of 716.911' to the first mentioned point and place of beginning. Said parcel being a proposed 50' wide and a 60' wide Right-of-Way for Water Main purposes and drainage purposes. SECTION 2. This authorization is conditional upon compliance with the following requirements within two (2) years from the date this Ordinance becomes law. (a) The filing of an agreement, satisfactory to the Law Department, by the owner or owners of property affected thereby, to release the City from all damages or claims for damages which may arise by reason of the City Plan changes authorized herein; in lieu thereof, only after the party in interest has demonstrated best efforts to locate any owner or owners of property affected and has been unable to do so, the party in interest shall file an agreement and bond with corporate surety, satisfactory to the Law Department, to indemnify the City as aforesaid. (b) The filing of an agreement, satisfactory to the Law Department, by the party in interest, to release, indemnify and defend the City from all damages or claims for damages, which may arise by reason of the City Plan changes authorized herein. (c) The filing of an agreement by the owner or owners of property affected thereby, granting to the City the aforesaid right-of-way for Water Main purposes and drainage purposes in Section 1 of this Ordinance. The agreement shall provide that no changes in grades shall be made and that no fences, buildings or other structures, either overhead, underground or upon the surface shall be constructed within the lines of the right-of-way or abutting thereon, unless the plans for such structures shall first be submitted to and approved by the Philadelphia Water Department. The agreement shall also grant the right-of-access and occupation at any and all times to the officers, agents, employees and contractors of the City for the purpose of construction, reconstruction, maintenance, alterations, repairs and inspection of present and future facilities and structures. (d) The payment by the party in interest of the cost of advertising the public hearing by the Board of Surveyors of the City Plan changes authorized by this Ordinance. SECTION 3. This Ordinance shall not become effective unless the sum of two hundred dollars ($200.00), toward costs thereof, is paid into the City Treasury within one hundred and twenty (120) days after this Ordinance becomes law. ..End
