..Title Authorizing the revision of lines and grades on a portion of City Plan Nos. 240 and 296 by placing on the City Plan River Road from the existing northwesterly terminus of Nixon Street to a point approximately ten feet southeast of the Philadelphia-Montgomery County Line; by placing on the City Plan a right-of-way for drainage purposes, water main purposes, gas main purposes, public utility purposes, and emergency access purposes extending from the northwesterly terminus of River Road to the Philadelphia-Montgomery County Line; and by placing on the City Plan a right-of-way for drainage purposes and a pumping station on the southwesterly side of the proposed River Road approximately two-thousand one-hundred fifty-nine feet northwest of the existing terminus of Nixon Street; authorizing the opening of the unopened portions of the proposed River Road and the vacating of certain portions of the existing River Road (also known as Nixon Street); and authorizing the acquisition of the said required rights-of-way by condemnation or agreement; all under certain terms and conditions. ..Body THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS: SECTION 1. Pursuant to Section 11-402 of The Philadelphia Code, the Board of Surveyors of the Department of Streets is hereby authorized to revise the lines and grades on a portion of City Plan Nos. 240 and 296 by: (a) Placing on the City Plan River Road from the existing northwesterly terminus of Nixon Street to a point approximately ten feet southeast of the Philadelphia-Montgomery County Line, the lines of said proposed River Road to conform as closely as practical to the physical location of the existing River Road (also known as Nixon Street). (b) Placing on the City Plan a right-of-way for drainage purposes, water main purposes, gas main purposes, public utility purposes, and emergency access purposes extending from the northwesterly terminus of River Road to the Philadelphia-Montgomery County Line. (c) Placing on the City Plan a right-of-way for drainage purposes and a pumping station, approximately thirty feet by thirty feet, on the southwesterly side of proposed River Road approximately two-thousand one-hundred fifty-nine feet northwest of the existing terminus of Nixon Street. SECTION 2. The opening of the unopened portions of River Road as proposed to be placed on the City Plan by authority of this Ordinance and described in Section 1(a) herein is hereby authorized. SECTION 3. The Board of Surveyors of the Department of Streets is hereby authorized to adopt a resolution vacating those portions of the existing River Road (also known as Nixon Street), legally opened by the Court of Quarter Sessions on April 8, 1811, but not on the City Plan, laying outside the lines of River Road as proposed to be placed on the City Plan by authority of this Ordinance. SECTION 4. The City of Philadelphia is hereby authorized to acquire by purchase, dedication, donation, condemnation, or agreement in lieu of condemnation the unopened portions of the proposed River Road as described in Section 1(a) of this Ordinance and the required rights-of-way as described in Sections 1(b) and 1(c) of this Ordinance. SECTION 5. The following provisions of The Philadelphia Code shall not apply to River Road as affected by this Ordinance: (a) Section 14-2104(3)(g), relating to dead end streets. (b) Section 14-2104(4), relating to cul-de-sac streets. (c) Section 14-2104(5), relating to the widths of streets. (d) Section 14-2104(6), relating to the alignment of streets. SECTION 6. The City Solicitor is hereby authorized to review and to approve all instruments and documents necessary to effectuate this Ordinance, which instruments and documents shall contain such terms and conditions as the City Solicitor shall deem necessary or appropriate to protect the interests of the City. ..End 2
