..Title Amending Section 2 of Bill No. 050952, approved December 22, 2005, entitled "An Ordinance authorizing and directing the revision of lines and grades on a portion of City Plan No. 271 by placing on the City Plan Florist Street from a point on 2nd Street approximately 131' north of the north side of Race Street to a point on 3rd Street approximately 157' north of the north side of Race Street, under certain terms and conditions, including the dedication to the City, free and clear of all encumbrances, of the bed of Florist Street", by revising the terms and conditions stated therein and extending the period for compliance. ..Body WHEREAS, Bill No. 050952, approved December 22, 2005, specified certain terms and conditions required to be complied with, WHEREAS, the said Ordinance was conditional upon the said terms and conditions being complied with within two (2) years from the date of approval, NOW THEREFORE, THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS: SECTION 1. Section 2 of Bill No. 050952, approved December 22, 2005, is hereby amended to read as follows: SECTION 2. This authorization is conditional upon compliance with the following requirements [within two (2) years from the date this Ordinance becomes law.] by December 22, 2009: a) The filing of an agreement, satisfactory to the Law Department, by the owner or owners of property affected thereby, to release the City from all damages or claims for damages which may arise by reason of the City Plan changes authorized herein; in lieu thereof, only after the party in interest has demonstrated best efforts [to locate any owners or owners of property affected and has been unable to do so] to obtain such agreements and such efforts are unsuccessful, the party in interest shall file an agreement and bond with corporate surety, satisfactory to the Law Department, to indemnify the City as aforesaid. * * * SECTION 2. This Ordinance shall not become effective unless the sum of two-hundred dollars ($200.00), toward costs thereof, is paid into the City Treasury within one-hundred twenty (120) days after this Ordinance becomes law. ___________________________________ Explanation: [Brackets] indicate matter deleted.
