..Title Amending Title 14 of The Philadelphia Code, entitled "Zoning and Planning," by amending Section 14-405, entitled "SP-ENT, Entertainment (Special Purpose) District," by revising certain provisions relating to setback, parking requirements, parking lots, and off-street loading, all under certain terms and conditions. ..Body WHEREAS, Bill No. 110717 (approved December 14, 2011) amended certain provisions of Chapter 14-400 (Commercial Entertainment District) of Title 14 of The Philadelphia Code, entitled "Zoning and Planning" (Former Zoning Code); and WHEREAS, Bill No. 110845 (approved December 22, 2011) repealed the Former Zoning Code and replaced it with a new Title 14 of The Philadelphia Code, entitled "Zoning and Planning" (Current Zoning Code); and WHEREAS, The provisions of Bill No. 110717 were not carried over to the Current Zoning Code which became effective August 22, 2012; and WHEREAS, Council wishes to incorporate the provisions of Bill No. 110717 into the Current Zoning Code; now therefore THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS: SECTION 1. Title 14 of The Philadelphia Code is hereby amended to read as follows: TITLE 14. ZONING AND PLANNING. * * * CHAPTER 14-400. BASE ZONING DISTRICT. * * * §14-405. SP-ENT, Entertainment (Special Purpose) District. * * * (3) Area Regulations. * * * (e) Yards. * * * (.2) Waterfront setback * * * (.b) The Commission may reduce this waterfront setback requirement for all or part of a site if site-specific conditions warrant such reduction, but in no case will the waterfront setback at any spot be less than 30 ft. total, including the pedestrian and bicycle right-of-way. Foundations or structures supporting exterior open spaces shall be permitted within the 50-foot waterfront setback, provided that any encroachment will not reduce the 20 foot minimum width of the pedestrian and bicycle right-of-way. * * * (6) Parking Design. * * * (a) Layout and Access Conditions. * * * (.1) Except for interim facilities with 1700 or fewer gaming positions and facilities with structured parking in which the deck of the highest parking floor is at a height not exceeding 90 feet above grade (parapet walls, stair and elevator towers and light fixtures may be above 90 feet), up to 10% of all parking spaces in an SP-ENT district may be provided in parking lots. This includes required handicapped spaces, bus parking, limousine parking, cabstands, loading spaces and delivery spaces; and * * * (7) Off-Street Loading. (a) Off-street loading must be provided in accordance with [residential district] the loading requirements of Table 14-806-1 in §14-806 (Off-Street Loading) for "Residential Districts except RMX-3 for Office, Hospital, Civic and Institutional, or Visitor Accommodation." * * * SECTION 2.
