..Title Amending Chapter 10-200 of The Philadelphia Code, entitled "Ethnic Intimidation and Institutional Vandalism," to clarify and revise its scope and related penalties, all under certain terms and conditions. ..Body THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS: SECTION 1. Chapter 10-200 of The Philadelphia Code is hereby amended to read as follows: CHAPTER 10-200. ETHNIC INTIMIDATION AND INSTITUTIONAL VANDALISM. § 10-201. Definitions. * * * (2) Institutional vandalism is the intentional desecration, as defined in Section 5509 of the Crime Code (18 Pa. C.S. § 5509), vandalizing, defacing, defiling or otherwise damaging (including by application of stickers or any other material) of: * * * (f) any property located in any facility set forth in subsections 2(a), 2(b) or 2(c), including, but not limited to, any headstone, grave marker, or gravesite; * * * § 10-203. Penalties. (1) Violation of any provision of this Chapter is subject to the monetary fines established for a Class III offense and, upon the third successive violation, imprisonment of up to thirty (30) days. Section 1-112 ("Notices of Violation") shall not be applicable to this Chapter. Each act of ethnic intimidation and each act of institutional vandalism, including each act of vandalizing an individual headstone, grave marker, or gravesite, shall constitute a separate violation. * * * ___________________________________ Explanation: Italics indicate new matter added. ..End
