..Title Authorizing the City of Philadelphia to install, own, and maintain right-of-way encroachments on the 7600, 7700, and 7800 blocks of Ogontz Avenue, all under certain terms and conditions. ..Body THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS: SECTION 1. The City is hereby authorized to install and maintain right-of-way encroachments (collectively, the "Encroachment") in the locations more fully described in Exhibit A, pursuant to standards and procedures established by the Department of Streets by regulation. SECTION 2. The Encroachments authorized by this Ordinance include, but are not limited to, benches, planters, banners, lighting, and decorative fixtures, all for the purpose of the 2026 Semiquincentennial celebrations. SECTION 3. Permission to install and maintain any such Encroachments is subject to existing laws of the City concerning encroachments generally and the Department of Streets shall incorporate such terms in implementing regulations as the Department of Licenses and Inspections, the Law Department, and the Art Commission shall deem necessary to protect the interests of the City. SECTION 4. Permission to install and maintain any such Encroachments in the right-of-way adjacent to private property shall require authorization of the abutting property owner as may be required by law. SECTION 5. The City's responsibility for ownership, construction, use, and maintenance of the Encroachments shall only be extinguished by the permanent removal of the Encroachments or by termination of any agreement between the City and the owner of the property where an Encroachment is located. SECTION 6. The City shall not install any new Encroachments pursuant to this Ordinance after December 31, 2026. After that date, the City may only maintain, replace, or remove Encroachments that were installed for the 2026 Semiquincentennial celebrations pursuant to this Ordinance on or before December 31, 2026. SECTION 7. This Ordinance is effective immediately.
