I don't remember.
It's been some months.
I don't remember exactly.
If you had the opportunity, Mr. Biles, to testify,
would you adopt my testimony as your own?
And that's true and correct.
Thank you, Mr. Biles.
questions from the board
yeah what are i'll go ahead mike no no go ahead what are the number of bedrooms on each of the
floors that are going to be proposed uh we're going to keep the two bedrooms on the second
floor and there'll be two bedrooms on the first floor is there going to be a similar layout to
the second floor yes except on the first floor to the left uh there's going to be a another half
bath in the back in the back of the building uh this diagram here was prepared by an
And this diagram here was prepared by an architect because there was a make-safe payment, excuse me, make-safe permit required for the rear wall.
And the architect only went this far, and that's why my client had to draw those handmade plans that I presented.
Not what I usually like to present, but that's what we were left with.
So to answer your question, two bedrooms on the first floor.
The handmade plans are also trying to report on existing conditions and not proposed.
Well, basically, this is existing, and the proposed will be two bedrooms and a kitchen similar to up here.
I guess my question is around the division between the commercial space and the current residence,
and how does the current resident
get to the second floor residential space?
Okay, so there is the front door
and then it would come down the hallway
to the stairs
and the stairs will bring you up to the second floor
and there's going to be a door
at the top of the stairs.
So what's the separation
for the commercial space?
this right right now you're showing a waiting room and then the hallway for the commercial space
i would have to walk through it to get to the stairway to get to the residential unit so how
are we separating these two legally separating these two residential units so that the two
tenants um one person isn't walking through the other person's apartment can i can i talk
Yeah, the first door is the main door that both they go inside,
and it's a little hallway.
And on the left side is the door that you go to the first floor,
and in the front is the door that you go upstairs.
So is this existing?
Because you're speaking about it.
Existing.
It's an existing vestibule that's not shown in this diary.
Yeah, it's existing, yes.
And then does the existing doctor's office already have
like a kitchenette or something that has has a water access yes where is that kitchenette
can you no that is not kitchen only only uh only a half bath that's all it's only a half bath
currently in the office correct yes where what so what is your plan for like the kitchen for this
new apartment?
We're going to
demo the interior
and build
the kitchen, build it
in the back.
Where the bathroom
is? Correct. Near to
the bathroom. Near to the bathroom.
It's going to be the same layout like the
second floor. Same layout.
And the
second floor is
is already laid out as an apartment correct correct um do you have photos of the second floor yes
this is the the front bedroom the second floor this is the middle bedroom this is the hallway
so one photograph was of the front one photograph was all of the bedroom there
went the wrong way sorry kitchen
two shots of the kitchen and then the bathroom and and then now i'm back to the first floor so
there are the four or five photographs from the second floor so where's the living room
of the apartment on the second floor there is no living room there's no living room in a two-bedroom
apartment correct just two bedroom apartments and one kitchen it was an existing so it's like him
all right so so henry um i i think what we need to do with this we we need to go back to the
drawing board a little bit and um i i know you we had a little bit of a hard time here with
an architect or whatever but i i think he's got to do the drawings better that will express what
the first floor is going to look like and then what's on the second floor and and i i do think
it's kind of hard to say well i got a two-bedroom apartment but there's no living room so i i think
you got to go back and take a look at everything you have and come back for a resumptive hearing
and then and then present it again that's fair i think specifically you need to show how you're
getting light and air into the bedrooms because the photos you showed don't look like they meet
current code. Okay. Will do. Understand.
will do
I understand
we're going to have a resumptive hearing on 8-19
at 9-30 a.m
and I appreciate
you hearing this case
thank you
thank you
I have one more case I want to hear before you

MI 2025

1507 West Tioga Street
Joseph Consul is the attorney.
Okay, they should be coming back in as a panelist now, sir.
Good afternoon.
Mr. Consul, could you please state your name and spell for the stenographer?
Yes, it's Joseph Consul, J-O-S-E-P-H, last name C-O-N-S-O-L-E.
Do you swear we're referring to tell the truth, the whole truth, nothing but the truth?
Mr. Consul, could you identify your client, a relationship to this property?
My client is Harrington Holdings, LLC.
Its principal representative, Igor Avrantiner, is going to be on the call.
and could you um our vice chair has just a few questions good afternoon counsel do you agree to
waive the read another refusal or stipulate to attack proceed yes have you emailed in all the
required documents and exhibits that's needed to proceed with this case five days in advance of
this hearing yes thank you counsel please proceed please proceed all right that should be my packet
for 1507 West Tioga Street.
My client, Harrington Holdings LLC,
purchased this property in 2024.
The property is not occupied.
However, if you go back into the record,
you'll see that in 1951,
the property was approved for, built,
and got a CO for three units.
There's no further updates in the record since then.
That's the only thing that this property has ever been approved for.
However, with the lack of keeping up with any rental license and the property being zoned as RSA 3, in order to re-legalize the three-unit use, we need to get this refusal.
And by virtue of it being RSA 3, it also generated a second refusal regarding an off-street parking space.
but as you'll see in in the photos there's no that that's not something that is able to be
created here so our request is to approve the three unit space here we went in front of the
nice town tioga rco we got their full support they issued a number of things they called provisos
though i don't believe they're enforceable but i i do believe to the extent we can we've we've
worked with all of their requests
it's a proof of mailing
is the outside of the property see it's got a small alley uh that leads to the back but um
nothing that could accommodate a motor vehicle
another angle
is that a three-story home right yes okay you can see the third story yeah yep thank you and
it matches the other properties
our tax clearance certificate um these are some things we had sent to the rco regarding the
request they made to clean up the yard coming along. And here's
interior photos. These are mockups. They wanted to see
proposed finished interiors. And we kind of my client used what
was there and sort of mocked it up as to how he envisions it.
looking upon approval and completion, but these are the actual
rooms just with some additional post finishes.
Here's the layout.
RCO really wanted stacked washer dryers in each unit, and this is the plan we sent them
that points out my client has plans that anticipate including them in each unit and where they are.
plans that anticipate including them in each unit and where they are. We've got a ground floor unit
with two bedrooms, living room, kitchen. Second floor unit, two bedrooms, living room, kitchen.
Third floor is one bedroom, living room, and kitchen in it. There's a small roof deck off
the back of the third floor. The basement has no living in it.
and these are a few least things we had sent to the rco that is not really relevant for
the zba today they wanted us to us to install motion sensor lights my client did that
they're the property manager information we did that as well we tried to just really go down their
list and comply with everything here's the side alley looks leading into the backyard that i'll
obviously be um touched up and made nicer upon my clients work being performed here's the deed
showing harrington holdings llc took possession i'm sorry it's the end of 2023 i said 2024 that was my
mistake. Tax clearance. And just some things from our application. We already showed that.
We showed the tax clearance. All right. With that, I'll call my client, Igor, to raise his hand.
They should be coming back into the panel as well.
hi sir could you please state your name and spell for the stenographer
sure igor avrotner i-g-o-r-a-v-r-a-t-i-n-e-r do you swear or affirm to tell the truth the
whole truth nothing but the truth yes sir please proceed counsel mr avrotner did you hear my
testimony just now regarding your property at 1507 West
Tioga Street? Yes. Do you adopt it as your own?
Yes. I have nothing further. Questions from the
board.

Igor? So the trash is going to be on the side of the house.
I can. Yes.
uh we had a better alley photo when he's gonna get to it sorry to make everyone sick this that
might do it go and we'll have the um trash uh lockers essentially for the for the three units
