To give our invocation this morning, the Chair recognizes Pastor Douglas Carpenter of Philadelphia Prayer, Praise and Worship Center. He is here today as the guest of Councilman Green. First of all, thank you for this privilege and this opportunity. My Bible tells me, First Timothy, Chapter 2, that we ought to have prayer and intercession and giving of thanks for all people, for kings and for all those that are in authority, that we may lead a quiet and peaceable life in Stated Meeting February 9, 2017 So, God, we come today that you might bless this Council, bless this President, the Councilmembers, and the staffs; that they might be able to govern as you would have them; that the City would be more blessed because you have made a way for them to be who they are; and that they represent a diverse population, but their assignment is one to bring unity to the community. So, God, we pray that you might use them and guide them in everything that needs to be done today; that at the end of the day they could all sleep at night; at the end of the day everybody will in fact be blessed; at the end of the day everybody will still be included; that this would still become a great city, a safe city, and a blessed city. So we thank you right now for what you've called them to do. It's more than a job. It's an assignment. It's a calling. It's a ministry. Good morning.

This is an official decree of the people and it must be acted upon immediately. This Council's only consistencies are its violations of the rule of law and passing of needless resolutions, hypocritically calling out other public servants as un-American, unfit for office, buying votes for a bag of weed and a 40, and undermining faith in America's democratic institutions, constitutional values, individual rights. As a republic, our public servants are oath-bound to obey laws and constitutions. The Fifth Amendment: Nor be deprived of life, liberty or property without due process, nor shall private Stated Meeting February 9, 2017 property be taken without just compensation. This Council and other oath-bound public servants, in my opinion, have violated constitutions and laws - 42 USC 1982, 1983, 85, 86, 87, 18 USC 241, 242, 2381, 2384, PA Constitution, Article I, Section 1 through 11, 26 PA 703, 708, 709, 712, 713, 716, and many other laws listed in SCOTUS 15-8965. I again call for the federal and Commonwealth governments to perform their constitutional obligations to investigate and prosecute all involved in the theft, illegal deed transfer, and deprivation of 42 USC 1982 property rights for 23 years of my home, 1038 West Wyoming. Immediate remedy is required by the Constitution. A just government must comply with the rule of law. This color of law government must have its charter to govern revoked until a constitutionally compliant government is installed. Stated Meeting February 9, 2017 2/9/17 - STATED - 2ND READING Civil servants cannot refuse their sworn duty any more than a fireman can refuse to fight a fire. You can't speak truth to power when you are the power with unclean hands that commit fraud and theft. I remind Council, it takes a lot of cooperation to create and allow monumental corruption.

Councilman Oh? Stated Meeting February 9, 2017 2/9/17 - STATED - 2ND READING

I would like to say a few words. Thank you. I do not support the Muslim ban. I want to be clear. I don't think it's a good idea. However, I don't know that it's unconstitutional. There was a judge in Massachusetts, a federal judge, who found that it was constitutional, one in Washington who found that it was not constitutional. That issue is going to be resolved hopefully in a higher court. For that reason, I am not going to vote for this resolution. Thank you.

You're voting no. Let the record reflect that. Let the record reflect that Councilman O'Neill is voting no. And the Chair now recognizes Councilman Taubenberger.

I'd like to be very clear on this. I also will be voting no on this. To be very Stated Meeting February 9, 2017 2/9/17 - STATED - 2ND READING blunt, I will also say the fact that they're -- one, as Councilman Oh said, it's in the court system. Two, we need to take a look at the countries that are listed. Only one, only one has a functioning government. So I think until the courts decree on this, I am voting no. Thank you very much.

And the record shall reflect that Councilman Taubenberger is voting no. Councilman Jones, can I do this? Since we're in the middle of the vote, we have taken a vote on ayes and nay, can I conclude the vote and then you can be recognized to speak?

Mr. President, there's a question of constitutionality, and that will reside in the courts, but there's a question of right and wrong. And often history will reflect people justifying hiding behind a law book, hiding behind a question of who should decide, but right is right and wrong is wrong. And when we as a country -- I am a proud citizen, but let the record reflect we didn't always get it right. We didn't get it right when we herded Native Americans onto reservations and doing that in an unjust manner. We were wrong again when we did internment camps for people who might have maybe been, because of the way they looked or the way they spoke, enemies of this country, many of whom's relatives died defending this country. So as we move into the current day and this Administration, let us not hide behind constitutionality or the courts. They will decide that, but in Stated Meeting February 9, 2017 2/9/17 - STATED - 2ND READING these Chambers, right is right and wrong is wrong, and let the record reflect that. Thank you, Mr. President.

Thank you very much. I have great respect for my colleague Councilman Curtis Jones, Jr., and I certainly understand where he comes and -- from where he comes, and I support that. However, somebody is right and somebody is wrong. That is kind of oftentimes subjective and different. I happen not to disagree with Councilman Curtis Jones. However, I do think that we have a process in this country of ours that at this time it is very important to adhere to. We have a separation of powers, federal government, state government, and local government. We have a separation of branches between the Stated Meeting February 9, 2017 2/9/17 - STATED - 2ND READING executive, the legislative, and the judiciary. And I think that the details of this are such that while people may feel very strongly about certain issues and while courts do get it wrong, so do legislators and others. So I don't want to disagree with my colleague on the morality or the issues that he's saying. However, I will say that I do think that it is not a matter of hiding behind. It is a matter of clarity, that there is an issue of constitutionality that will be determined in the courts. I have my opinion, but likewise, for example, with our Mayor, there are things about what the Mayor does that I don't support, but I support the fact that he is the Mayor. He was duly elected and he should have an ability to make certain types of orders. But that will be determined in the courts, and I'd rather these things be determined in the courts than a new trend about threatening folks who you don't Stated Meeting February 9, 2017 2/9/17 - STATED - 2ND READING agree with with cutting off their funds. One day it is one issue; the next day it's another issue. This train can continue as we disagree with each other over right and wrong and have the moral high ground to de-fund folks we don't like. I respect the opinions of my colleagues that raise the issue of constitutionality in reference to this issue and the Executive Order issued by the current occupant of Pennsylvania Avenue. However, my concern when you also look at the issue of constitutionality is some of the challenges in reference to freedom of religion in the Executive Order that is to me challenging, the establishing Stated Meeting February 9, 2017 2/9/17 - STATED - 2ND READING clause of religion in the Constitution. When you have a ban in certain countries, though the majority Muslim countries, but also in that Executive Order you have certain preferences to other religions in the Executive Order, that's what causes the constitutionality perspective from my concern. That's why I support this resolution. I can respect the issue that this should be debated in the court system, which it will be, but my concern is in reference to the establishment issue of religion in the Executive Order which puts a preference on some religions over others.

I wanted to put a silver lining on this. On Friday, I was joined by the Mayor, Senator Sharif Street, and State Stated Meeting February 9, 2017 2/9/17 - STATED - 2ND READING Representative Jason Dawkins at the Muslim Society, one of the largest mosques in my district. And, you know, the message -- it was an inter-faith ceremony, and the message was one of unity, one of peace. And I think that one of the things that has happened with all of this is that people understand that we really have to come together at this particular time. But the most profound piece of that ceremony for me was the children in the room, the children in the room who the Mayor addressed, who when questioned by the press said, I feel safer today, because the Mayor said and the police officers that have joined us at the ceremony has said that I am going to be safer. And so in our messaging, it's very important to recognize that people are fearful, people are scared, and as legislators and as leaders, we have to reassure folks that we're going to be Stated Meeting February 9, 2017 2/9/17 - STATED - 2ND READING okay. And we're going to be okay, and this has helped us enlighten folks about the value of what this nation was founded on. And so the silver lining is people are coming together. Thank you.

So let me just say, I'm not clear, I didn't get the memo. Did Donald Trump read the Constitution since he was elected? I don't know. That was a question once before. But whether you are the President, which I respect his presidency, I'm here to tell you that; however, right is right and wrong is wrong. Stated Meeting February 9, 2017 2/9/17 - STATED - 2ND READING FDR, a democrat, did internment camps, and he was wrong. Ulysses S. Grant, March of Sorrows or how they moved Native Americans, he was wrong. He was a republican, by the way. And Donald Trump is equally wrong even though he holds the office. The five countries he's banning and he cites 9/11 as the reason, well, if that's true, why aren't we banning folk from Saudi Arabia? Oh, because they have business interests with Donald Trump. And so the countries that he has -- so there's at least a question in my mind. If it is not constitutionally right, it is damn sure self-serving. And so if you bring this up in this Chamber, we're going to deal with it in this Chamber, because truth is truth, as you said, right is right and wrong is wrong. And I just want you to know that if he continues on this path, I'm not as optimistic, I am not as optimistic as my colleague Sanchez. Yes, it's bringing Stated Meeting February 9, 2017 2/9/17 - STATED - 2ND READING good people together, but it's causing divisions even in this Council, and we have to be careful about just because the bully became the President of the student body doesn't make the bully and bullying right. Today we had some inclement weather. The schools were closed. But I think a special thanks ought to be to those men and women that are out there plowing and salting our streets and roads and keeping them open. Also to our Fire Department for their valiant efforts in always being on duty and of course for the Police as well for being outside, because you know what, it's really nice and warm in here, and I want to thank also the custodian staff as well, but the fact is they're doing a lot of good work in keeping our City functioning in actually a very Stated Meeting February 9, 2017 would like to commend them very, very, very much. Thank you.

Thank you very much. I wanted to point out that the estimations of the revenues generated by the cigarette tax in 2015 was $63.4 million, but we got 13.2 million less than projected. In the following year, 2016, 77.5 million was the projected revenue from the cigarette tax, but we got 18.8 million less than that. And this year there's a projected $75 million from the cigarette tax, but at the six-month period, we only got $25 million, and so the Controller projects $50 million, which means a $25 million deficit from the projection. So the School District each year of the cigarette tax has an Stated Meeting February 9, 2017 money that they projected that they would receive. That money has to be made up. For that reason, I do think it is important to relook at the cigarette tax in terms of what is the maximum rate of revenue that will be generated from this tax. The second thing that I want to point out is that in this regard, the need for revenues is a very pressing problem for our City, as not only the Administration has talked about cutting off funds to our City but people in Harrisburg. When I listen to the radio and I read the news and even listen to elected officials, they have consistently said this is a republican-generated issue, and I would say that is not true. It's also, I think, problematic. The republicans have won the national election. That's true for the next four years. So we are all going to have to deal with the fact that we need to work as best we can with Washington, Stated Meeting February 9, 2017 Harrisburg for the most part as it affects our City, and we're going to have to work with Harrisburg as best we can for the time being and maybe beyond that. There are republicans who do support our City, and when I hear people say the republicans did this, I think about all the democrats who voted for those bills, and every one of the bills that we have spoken about, democrats have voted in favor of those bills and democrats from Philadelphia have voted in favor of de-funding our City. Yet that isn't mentioned. And the reason I'd say it's important is because we will not be able to represent our City if we turn this into a democrat-republican issue. It is going to have to be an issue of who supports our City and who doesn't support our City. We do need funds. We need to have an ability to collect the funds that Stated Meeting February 9, 2017 City, and that has to be on a bipartisan basis, because we just don't have the votes in Harrisburg or in DC on an R versus D basis. I do think that when we look at issues from our own personal perspective, they are very heartfelt to us, but when we don't control the decision-making, we do have to understand the perspectives of people who oppose those opinions that we have and see how we can speak to them in a way they understand. While I don't agree with issues that Mayor Kenney has made decisions on, I do agree that he is the Mayor. I believe he's properly elected. I believe he has certain powers that come with him being the executive, as does the Governor, as does the President. When President Obama made Executive Orders, I thought that was within his realm, although people disagreed. When Governor Wolf makes Executive Orders, the Legislature Stated Meeting February 9, 2017 that is part of the separation of powers that keeps our democracy intact. If there are republicans that support local control, then they need to be on our side as we go into trying to assure that our schools are funded, our City services are funded, and I would not like to make this an issue where republicans that would support us in this process feel excluded from helping us because we have, in rhetoric, made this a republican versus democrat issue. For the democratic response, I agree with my colleague that it's not an R thing, it's not a D thing. It's not democrats versus republicans. An example of that is I was recently in Harrisburg and there was Stated Meeting February 9, 2017 close two prisons. As part of the Justice Reform Committee, we find that as something intriguing. Many of the republicans in the rural counties opposed that. They wanted to keep it open. I won't say because they work there, but maybe some of their interests, I can't speculate why. But what was to your point, Councilman Oh, the republicans from the suburban counties joined with the democrats from Philadelphia in opposing obstructing those closures, because they understood and found common ground on cost reductions. If you have such a large deficit, as they do, you have to do something. And so they came together, worked cross the aisle to make that happen. I believe we do that here in Chambers every day. So they're beginning to catch on. And I agree that that should trickle up to the federal level, and hopefully we can do that. However, we're not always going Stated Meeting February 9, 2017 on the separation of powers. We agree that a duly elected President should be respected, but I don't have to respect their decisions. I can in this country, in a democracy, voice those opinions with whatever rhetoric suits that situation, and I intend to exercise my constitutional right to do so. I wanted to rise, though, on another subject, and I'm going to hug Councilman Oh in the hallway if he lets me, but what I wanted to talk about, Mr. President, was the fact that public safety means different things to different people. As Chair of Public Safety, I realize that more today than ever. Whether a building collapses or there's a senseless shooting in the street or if there are hit-and-runs in the City of Philadelphia, dead is dead. I have personally seen drivers act in callous ways that did not adhere to the Stated Meeting February 9, 2017 the vehicle code. In 2015 -- and we're looking at 2016's numbers -- there were more than 9,000 hit-and-runs. Thirty-five percent of all of those hit-and-runs involved a pedestrian, which was 3,100 hit-and-runs. The District Attorney's Office has prosecuted between 500 and 6,000 cases each year of hit-and-runs. In the Fourth District, there have been several fatalities based on hit-and-runs. A 38-year-old Miriam Wilson was struck by a vehicle as she crossed the street. That vehicle went around a trolley in some type of haste. Jayanna Powell, 8 years old, on November 18th, 2016 was on 63rd Street where she was struck and killed, and the driver fled. Two days ago I attended a vigil for Catherine Brown, who was killed in January, was struck by a trolley when a vehicle went around the trolley. She pushed her 11-year-old grandson to the Stated Meeting February 9, 2017 side, saving his life, and she was drug an entire block, and the driver kept going. All of these victims will never get an opportunity to make their next appointment. They will not see their families again. There are no meetings, no lunch dates, no sporting events so important that we should run a red light, that we should go around a trolley, that we should not yield for an ambulance. I've seen that happen where people are in the back of that truck not breathing or bleeding out and people say, well, let them find their own way, often just to catch the next light. So as Marian Tasco used to say, you can act in haste, but you will repent in your leisure. What I am calling on the state to do is increase the penalties when they do that, because it's $150 or so when they get a ticket. It should be much Stated Meeting February 9, 2017 that has caused catastrophes and fatalities.

So we want to join with the Transportation Committee. We want to seek our colleagues up at the state level who govern the vehicle codes to increase those penalties, to make sure there are consequences when people on the way to a sporting event decide they're going to run a light or violate a mass transportation yield. So we're looking at that, Mr. President. Again, public safety means different things to different people, and in order to keep us all safe, we should adhere to, sometimes with a little patience, these laws. Thank you, Mr. President.

Thank you, Mr. President, and good morning. I Stated Meeting February 9, 2017 many of us tried to listen closely this week when Senator Elizabeth Warren was silenced for reading Coretta Scott King's letter at the hearings for Senator Sessions and the active debate that took place. In fact, I would encourage my colleagues to take a few minutes and read that letter, which is quite eloquent and reminds us in many ways of a time in history that we thought was far behind us, but then we are too often reminded that we're stuck in the mud when it comes to respecting those who have differing of opinion. The bad news of that debate is that her colleagues, Senate republicans, actually rebuked Warren after she read the letter wrote by the civil rights leader many, many years ago, where even 30 years ago they were examining his record. This rare move to silence a United States Senator for simply offering her voice, offering her perspective, Stated Meeting February 9, 2017 an appointment sparked a #LetLizSpeak social media campaign, which is quite exciting to watch and participate in. The good news is that a number of her democratic colleagues stood up the next day and read the letter without -- I repeat, without -- GOP objection. Senator Sanders remarked, and I quote, "It is unconscionable and outrageous that Senator Warren was cut from the debate." So for me it was a woeful reminder of the severe partisanship that exists at the highest level of government in the United States Senate, and further it was an affirmation for me of why I took the risky, bold move to jump and leap and run for elected office 20 years ago, because it's still clear that if women are not at the table, we just might be on the menu. Further the good news for me is that we live and work in this legislative body where all women are given an equal Stated Meeting February 9, 2017 voice, where all of us are given a chance to voice our opposition, where we all many times respectfully agree to disagree on how we feel about public policy matters. The United States Senate might take a page out of our book. In closing, what I know and what I've learned in my work here in City Council is that we listen to what people say, but then ultimately we watch what people do, because it's in what they do that defines who they are. So we will watch to see if Attorney General Jeff Sessions uses his awesome power or the awesome power of his office to exercise the power in a way that's fair and in a way that is just. In the meantime, #LetLizSpeak, Mr. President. Thank you very much.

Stated Meeting February 9, 2017 with what Councilwoman Reynolds Brown has just said, and I want to thank you personally for giving us all a voice and really keeping partisan politics for the most part out of this. I concur also with Councilman Jones in trying to get safety more attentive on the State Legislature. I will work with you tirelessly to get that done, because a life is a life and once someone goes, you cannot bring them back. But I also want to bring some collective institutional knowledge on something that we did which was exceptionally bipartisan, which was really different, and actually the President did what we asked, President Donald Trump. In October we had a resolution, which was fiercely debated again, a federal issue, but it was debated in these Chambers on President Obama's signature issue, the Pacific Trade Stated Meeting February 9, 2017 Agreement, one of his signature things that he wanted to bring forward. Our republicans were in lockstep with President Obama and we voted to defeat that venture. We only had three votes. Conversely, the democratic majority passed a resolution asking the United States government to get out of the Pacific Trade Agreement. Well, President Trump has done what we asked. We are now out of the Pacific Trade Agreement. But that kind of bipartisanship might sound a little comedic. It's not. It's where people have a different viewpoint and they brought it up. It was done in this Chamber. President Trump did what we asked. We are out of the Pacific Trade Agreement. That's all I have to say. Have a great day, and thank you for letting me speak.
