Thank you very much. I note that the hour has come and that a quorum of this Council is present. To give our invocation this morning, the Chair welcomes Monseigneur Joseph Tracey. He is here today as my guest. I would ask all members and guests to please rise. MONSEIGNEUR JOSEPH TRACEY: Good morning, everyone. Let's just take a minute and put ourselves in God's presence. Almighty God, we praise You for Your goodness to us, even in the face of our nonchalance and lack of recognition of Your gifts in our lives. We thank You for our families and especially for all of our fathers, living and deceased, as we approach Father's Day this weekend. The stability of the family is a fundamental good of our society. May our legislators and City Council always be mindful INVOCATION - 6/16/05 of the effects of their actions upon families, working always to strengthen them and build them up. We ask that You would give strength and tenderness, courage and wisdom, generosity and faithfulness to all fathers and to those who act as a father in their households. May they find joy in their children, holding in each onto the other in admiration and in confidence. Lord, send Your spirit of wisdom and knowledge upon those who participate in this Council session this day and open the hearts of all of us to be mindful of the poor and the needy, the marginalized and the outcast, the hungry and the desperate. Fill us with confidence in Your power to provide what we need and give us this and every day the joy of Your presence. We ask this in the name of Jesus Christ Our Lord.

On behalf of all members of City Council, I welcome you to our Council session. We appreciate your taking the time to join us as we attend to the legislative affairs of our WELCOME OF GUESTS - 6/16/05 city. We certainly invite you to come again. At this time I recognize Councilwoman Blackwell, who will present a citation recognizing Lester C. Brown on his retirement from city government. Will Mr. Brown please join the Councilwoman at the podium.

Thank you, Madam President. We hope that we did surprise him. The Council of the City of Philadelphia is pleased and proud to honor Lester C. Brown for 18 years of dedicated service to the Council and the City of Philadelphia. Whereas, Lester C. Brown was born during the '20s near Savannah, Georgia, where the harsh racist reality of Jim Crow laws were balanced by the love of his family and close-knit community. He absorbed the successes and challenges of those around him and built an inner strength that is the envy CITATIONS - 6/16/05 of everyone around him; And, whereas, Mr. Brown began his career in journalism at the early age of 16, when he became the first African-American youth to host a radio show called, quote, unquote, Negro History, that aired on WTOC, a CBS affiliate. He later moved to New York City, where he became a reporter for Bam Black Audio News. He was also the first African-American junior executive on Madison Avenue, where he worked as the assistant advertising production manager for Progressive Architecture Magazine; And, whereas, Mr. Brown moved to Philadelphia and became a news person for WHAT radio. He later became the first African-American passenger ticket agent at the Philadelphia International Airport for United Airlines; And, whereas, influenced by the social justice movement of the '70s, Mr. Brown began his career in community service as a youth organizer for the Parents Union in the Philadelphia public school system and CITATIONS - 6/16/05 reorganized the student union. He also became a Board member of a Spirit Advisory Council; And, whereas, in the '80s, Mr. Brown became executive director of Mantua Community Players. In fact, I met him through Tim Spencer. During his tenure, he donated nine houses to members of the Mantua community through the Remove Urban Blight Program; And, whereas, currently Mr. Brown is the Democratic ward leader of the 24th ward. He faithfully worked for Lucien Blackwell and is retiring as Chief of Staff for me. Throughout his 18 years of loyal service on Council, Lester has compassionately helped constituents in need. His hard work and dedication is appreciated by all of us not only in my office, but so many at City Hall, and his presence will surely be missed. Therefore, by virtue of this citation, the Council of the City of Philadelphia honors Lester C. Brown on the occasion of his retirement. We wish him well in any future endeavors and extend to him the sincerest respect and admiration of this CITATIONS - 6/16/05 legislator body. We love you, Les. (Applause.)

It is a surprise by the way. I am surprised. I want to thank everyone, the Councilwoman and the staff we have behind us here. And to start with me walking into Room 408 and asking for a job. And be careful what you ask for because you might get it, and I got it. So I want to thank the Honorable Lucien Blackwell. There are people who were here when I first came, President Joseph Coleman, Beatrice Churnoff, Augusta Clark, Ethel Allen. There are others; I can't remember all of their names right now. Thank you. You know, a lot of you in this room know I love to dance and I love music. So I think it is the most appropriate citation for me to present this morning to an outstanding young lady who is just talented not only as an entertainer, but as a writer. And we are just so pleased today to be able to present this resolution in City Council recognizing all of her contributions CITATIONS - 6/16/05 to her family. And, so, I am pleased to present this resolution declaring June 16, 2005, as Tammi Terrell Day. Whereas, Tammi Terrell was born Thomasine Montgomery, as the oldest daughter of Thomas and Jennie Montgomery, in Philadelphia on April 29, 1945; And, whereas, Tammi Terrell was raised in Germantown and North Philadelphia and attended Emlen Elementary School, Roosevelt Junior High School, and Germantown High School. And by the time she was 15, Ms. Terrell had already become well known in the local sock hop and talent contest scene; And, whereas, in high school, Ms. Terrell sang with Steve Gibson and the Redcaps and was signed to The Scepter Wand Record Label, and at the age of 17 was the featured vocalist in the James Brown Review, and later toured with Jerry Butler; and -

-- whereas, in 1965, Ms. Terrell was discovered in Detroit while doing a show at The 20 Grand with Mr. CITATIONS - 6/16/05 Butler by Motown's Berry Gordy, who signed her to a recording contract and changed her professional name from Tammi Montgomery, to Tammi Terrell; And, whereas, Tammi Terrell was a well-known artist on the Motown label and is fondly remembered for some of the greatest duets of all time with Marvin Gaye, which include "Ain't No Mountain High Enough," "Ain't Nothing Like The Real Thing," "Your Precious Love," and, "You're all I need to get by"; And, whereas, Ms. Terrell collapsed on stage in Mr. Gaye's arms at the age of 22 on March 15, 1970. Tammi Terrell died from a brain tumor at the age of 24; and -

-- whereas, in June 2005, Bank House Books will release, "My Sister Tommie, Tammi Terrell's Biography," the true story of Motown's sweetheart and legend, Ms. Tammi Terrell, as told by her sister, Ludie Montgomery; Now, therefore, resolved by the Council of the City of Philadelphia that we CITATIONS - 6/16/05 declare June 16 Tammi Terrell Day. Further resolved that an engrossed copy of this resolution be presented to Ms. Ludie Montgomery as an expression of the sincere sentiments of this legislative body. And this resolution was supported by all members of City Council. And we thank you for bringing her memories to us and sharing your days with her. And thank you for the books for the members of City Council. You should have made us buy them. But at any cost, we certainly appreciate having this opportunity to recognize an outstanding woman. Whereas, United Parents Against Lead is a national networking organization of and for parents of lead-poisoned children working to end the continuing threat of lead poisoning and other environmental hazards through education, advocacy and, resource referral; Whereas, founded in 1994, at the Second National Conference to End Childhood Lead Poisoning, United Parents Against Lead is committed first and foremost to ensuring the basic right of all children to live in a safe and healthy environment;

Whereas, United Parents Against Lead knows firsthand the CITATIONS - 6/16/05 effects of lead poisoning and the irreparable damage and suffering caused by this preventable epidemic and assists parents in organizing chapters and local and state communities and is committed to assisting effective families; Whereas, accurate information is a crucial element in the campaign to eliminate lead poisoning, United Parents Against Lead promotes proactive steps to prevent children's exposure to lead and early intervention for affected youth; Whereas, United Parents Against Lead advocates that parents have the responsibility to bring their children's voices and experiences into the national dialogue and remind participants that children's health and safety is fundamentally everyone's responsibility. Therefore be it -

Thank you, Madam President. This morning we present this resolution honoring and commending the Health Committee of the NAACP Philadelphia branch on the occasion of National HIV Testing Day. Whereas, June 27, 2005, is the annual observance of National HIV Testing Day, a day where events will occur throughout the nation to encourage its residents to get CITATIONS - 6/16/05 tested and get treated for HIV, the virus that causes AIDS.

Whereas, in Philadelphia, as of December 2004, the total number of reported AIDS cases since 1981 was over 17,000, which represents 61 percent of all reported AIDS cases in Pennsylvania.

Whereas, one of the leaders in raising awareness and promoting prevention education events for National HIV Testing Day in Philadelphia is the Health Committee of the Philadelphia National Association for the Advancement of Colored People, NAACP.

Whereas, the NAACP was formed in 1909 by a multi-racial group of progressive thinkers with the objective of ensuring the political, educational, social, and economic equality of minority groups. The NAACP has as its mission in part the goal of eliminating race prejudice and providing leadership for the protection and enhancement of the civil rights and well-being CITATIONS - 6/16/05 of African-Americans and other people of color. COUNCILMAN DiCICCO: Whereas, the mission of the Philadelphia NAACP Health Committee is to alert and educate its members and the community at-large about the prevention and elimination of health disparities such as the horrible effects of HIV and AIDS, not just on National HIV Testing Day, but every day.

Whereas, the Philadelphia NAACP is joined in its efforts by state representative Joe Williams, AIDS Activities Coordinating Office, Philadelphia Department of Health, Black Women's Health Alliance, Women's Christian Alliance, Philadelphia FIGHT, and a host of other community organizations and leaders.

Whereas, it is fitting that we join the Philadelphia NAACP to express our strong support for National HIV Testing Day and their health initiatives to prevent the spread of HIV AIDS in the Philadelphia community. CITATIONS - 6/16/05 Therefore, be it resolved by the Council of the City of Philadelphia that we hereby honor and commend the Philadelphia NAACP on the occasion of the National HIV Testing Day. Further resolved that an engrossed copy of this resolution be presented to J Whyatt Mondesire, President, and Denise Pride, Health Chair, of the Philadelphia NAACP as evidence of the sincere sentiments of this legislative body. This is a true and correct certified copy of the original resolution and is supported by all members of City Council. (Applause.)

I want to say that we really appreciate the work that the NAACP is doing in this area. And we want to let you know that Denise Pride has presented to the National League of Cities on this issue, and it has become a part of the NBC agenda. And she also participated in half-day hearings we had on HIV AIDS in CITATIONS - 6/16/05 Philadelphia, which was very informative. And we thank her and congratulate her for the hard work that she is doing. (Applause.)

Thank you all for the recognition of the work that NAACP and its health committee is doing around this issue and allowing me to speak today and yesterday at the hearings. I also want to thank the people that are standing with me, John Sulla, Director of AACO, AIDS Activities Coordinating Office, Department of Public Health; Anne Myers, Director of Behavioral Health, Women's Christian Alliance; and Oni Richards, Program Coordinator, HIV Program, for Black Women's Health Alliance; and someone who is in the room who is one of our youth educators for the committee, William Brauner, Support and Education Coordinator for the Office of HIV Planning. There are so many statistics that I CITATIONS - 6/16/05 would love to share with you, but I know that those statistics really don't mean a lot to people unless they are educated as to why this disease is overtaking our world. This is a global issue. Some people still believe that it is a gay, white issue. It is not. Every age group, every ethnic group is being affected and infected by this disease. Senior citizens are being affected. I will give you good news that the last year there were no infants born with HIV. That is a blessing. The medical community is doing awesome work around medications for this. Right here in our city, University of Pennsylvania, there are clinical trials going on for vaccines as well as microbicides -- get used to that term -microbicides that will be inserted, that hopefully will kill viruses and other sexually transmitted diseases and infections. It is on the rise. We are working on it. But, in between time, it is our individual responsibility and certainly my CITATIONS - 6/16/05 responsibility as a certified HIV prevention educator and counselor, to make sure that people understand how to protect themselves. It is your individual responsibility to get educated. We will assist you. There are organizations out there trying to do that. Invite us into your communities. There are challenges around that, but we can work together to get the information to the community. Why are the infections going up? Lack of education, lack of funding to support programs out there that will educate you. I received a letter from the Commissioner yesterday telling me about how much funding has been lost. That affects different programs that exist; but those of us in the community that already know, we are struggling with what we have. The disease is increasing; and, yes, the funding is decreasing. How do we do more with less around this issue when family, friends are dying? Not just in Africa, but here at home. Because CITATIONS - 6/16/05 you will not see or hear exactly what is happening in our communities because everyone has a priority list. I encourage you to meet with your community leaders and I ask the Council, as I did in February around National Black HIV AIDS Awareness Day, to think about holding community meetings in your districts. Invite us in. Because the five-plus years that I have been doing community work, organizing events around this, what I see consistently, people do not want to come out to hear this depressing information. So we need to bring the information to them, and we will need your help to do that. S. That is not new to us that are in the arena, it really isn't. 40,000 a year new infections. A quarter of them did not even know they were infected. This is horrible. But we together can do more about it. CITATIONS - 6/16/05 I am going to close and ask John Sulla to say a few words in support of National HIV Testing Day. This is also AIDS Awareness Month. And I don't want to forget our men. This is also Men's Health Week. So I encourage the men in this room and the women who have men outside of this room, please get a checkup. It is not just prostate cancer; it is HIV, it is heart disease, it is everything. As the Chair of NAACP, it is my responsibility to address all health issues, but at the top of my list is HIV prevention. Thank you. )

Good morning. I just want to say on behalf of Health Commissioner John Domzalski, it is truly an honor to be in City Council today to talk for just a couple of minutes about the HIV AIDS epidemic. It is still an epidemic, despite the apathy that is out there. I want to echo Denise Pride's CITATIONS - 6/16/05 remarks that there is reduced federal funding for HIV AIDS over the last few years. We have been cut over $700,000. Fortunately, the city in its wisdom has not cut us as all; it has added to our dollars. But the federal government is not quite as wise, I suppose. It is still a matter of life and death out there. It has never been more important for persons to get tested for HIV, particularly now when we have medications and we have HIV-specialized medical care out there that can assist persons. Two-thirds of the persons living with HIV AIDS are minority persons. The epidemic is growing disproportionately in the minority community, particularly heterosexual community minority females. So it has never been more important. And I welcome the chance and we welcome the chance in the Department of Public Health to work with organizations like the NAACP and Women's Christian Alliance and other community-based providers because it is important that these services are provided CITATIONS - 6/16/05 through the efforts of community-based providers primarily, because they can offer culturally competent and services that are specialized for the target population that they serve. So, thank you very much. (Applause.)

Thank you, CITATIONS - 6/16/05 Madam President. This resolution is presented on behalf of the President of City Council, President Anna Verna, declaring July 10, 2005, as American Cancer Society Bikeathon Day in the City of Philadelphia. Whereas, the 33rd annual bikeathon from Philadelphia to the Jersey shore will commence on Sunday, July 10, 2005, at 6:30 a.m. at the Benjamin Franklin Bridge. Over 3,000 riders will bike 62 miles to the Jersey shore. Super-cyclists have the option to ride a thrill 100 miles. Whereas, each rider is encouraged to seek sponsors and the public is encouraged to sponsor riders for this most worthy charitable and fun event; And whereas, in 2004, the American Cancer Society Bikeathon raised over $1 million for the fight against cancer; And whereas, the Philadelphia Bar Association teamed with 171 cyclists, raised over $100,000 for the American Cancer Society at last year's bikeathon and were the largest CITATIONS - 6/16/05 single contributing organization for the event. Now therefore, resolved by the Council of the City of Philadelphia that we declare Sunday, July 10, 2005, as American Cancer Society Bikeathon Day in the City of Philadelphia. Further resolved that an engrossed copy of the resolution be presented to Jeffrey Abramowitz, of Weitzman, Klevan & Abramowitz, P.C., on behalf of the Philadelphia Bar Association for their outstanding contributions to this most worthwhile cause, and we wish you a smooth ride. It is certification that this is a true and corrected copy of the original resolution adopted by the Council of the City of Philadelphia on the 9th day of June, 2005, by President Anna C. Verna, and supported by all members of City Council. (Applause.)

The Chair recognizes Mr. Abramowitz for remarks, please.

Thank you CITATIONS - 6/16/05 very much. My name is Jeffrey Abramowitz, and I am Co-Chairperson of the Philadelphia Bar Association American Cancer Society Bikeathon team. In 2004, the Philadelphia Bar Association unanimously passed a resolution sponsoring a team to ride from Philadelphia down to Atlantic City. Last year we had over 171 riders who made this trip, including our Honorable Mayor, judges from the Court of Common Pleas, as well as many lawyers, attorneys, their families and friends. This year, once again on July 10, over 4,000 riders will ride from Philadelphia down to Atlantic City or Egg Harbor, New Jersey, and make the 62-mile ride. We do this for one very good cause, and that's the fight against cancer. There are very few people in this world who go through life not knowing someone that's been touched by this disease in some form or fashion. The Philadelphia Bar Association, CITATIONS - 6/16/05 and more importantly the American Cancer Society, are committed to finding a cure for cancer. We will continue to ride until that cure is found. This July 10 we challenge City Council to get on their bicycles and to ride along with us down to Egg Harbor, New Jersey. It is easier than you think. I would like to thank President Verna and all of City Council for passing this resolution. And a special thanks to both the Philadelphia Bar Association for their commitment to this project, as well as to the American Cancer Society for all that they do for the residents of Philadelphia as well as the residents of our tri-county area and on a national basis. It is regarding Philadelphia Day in Support of Torture Victims. And four individuals are here, and I would like to introduce them and recognize them. Ms. Salvania Gabordelli, who is the case manager at Liberty City for Survivors of Torture; Doctor Elaine Nanna, who is also a case manager at Liberty City for Survivors of Torture and a survivor from Cameroon; Ms. Elaina DiGiovanni, who is with the Mariposa Outreach Project and the School of the Americas Watch; and Ms. Linda Anetta, a photo journalist with Optical Reality Photography and a human rights activist affiliated with the Mariposa Outreach Project and the School of the Americas Watch. They are here, and I would like to recognize them.

I would just like to take this opportunity to thank my colleagues, and in particular my colleague Councilman Nutter who happens to be the Chair of the Pennsylvania Convention Center Authority Board, for the hard work that has gone into finally getting us to that point where this resolution will put us in the position to get to jump-start the long-awaited expansion of the Pennsylvania Convention Center, which will do wonders for our hospitality industry and the City of INTRODUCTION OF BILLS & RESOLUTIONS - 6/16/05 Philadelphia. It is badly needed, we have been working on this a long time. This resolution will hold the city harmless. This resolution will also enable the Commonwealth of Pennsylvania, through the Redevelopment Authority, to act on the condemnation and get this, again, long-awaited expansion of the Pennsylvania Convention Center underway. It is a milestone for our city, it is a great day I think for the Convention Center and the hospitality industry. So I am asking for my colleagues to support this resolution.
