Bill 040934, an Ordinance authorizing John Captis, 1407 Melrose Avenue, Sharon Hill, PA 19079, owner of the property 2601 S. Carroll Street, Philadelphia, PA 19142, his successors and assigns, to construct and maintain a garage extension, under certain terms and conditions.
Good morning, Mr. Chairman and members of the Committee. My name is William Watts, and I'm a construction engineer with the Streets Department. I am here to offer the following testimony for Bill Number 040934. This Bill 20 authorizes John Captis, owner of the property 2601 South Carroll Street, to construct and maintain a garage extension encroaching into the south footway of Buist Avenue. The one-story garage extension is approximately 18 foot long, encroaches 107 Streets & Services - 12/7/04 approximately three foot eight inches into the public right-of-way. The remaining clear footway is ten feet four inches. The Streets Department reviewed this encroachment and field verified dimensions. As the encroachment does not adversely affect the public right-of-way, the Streets Department recommends passage of this Bill. COUNCILMAN DiCICCO: Councilman Cohen.
Let me raise again the question of value. Is it going to cost the homeowner anything to encroach on this public way?
Well, again, I think the City ought to go very slowly in doing that. The land has to be worth something. And again, it's a free giveaway, and I think very unfortunate. And there's nothing to back up what the value of the land would be if he had to buy it. There's no 25 appraisal. There's nothing except the 108 Streets & Services - 12/7/04 giveaway by the City. And while it's great to be in the Streets Department, and be able to give everything away for free, especially around Christmas time, I don't think it's to the advantage of the City. I yield to Councilman Rizzo.
Again we're in this issue. Typically... And I think we can look back where there's been some disputes from neighbors where a person built a fence over a foot over, and years later they 14 find out when they go to sell it that there's 15 a mistake, that there's some financial 16 exchange to make it right, and give the land 17 that they encroached on, even though it's not 18 a negative impact on the value on the 19 property that was encroached upon. 20 And I think that, based on the financial condition of the City, that we have to really examine when we... First of all, is this a private garage or is this a business?
It's an awful big garage for a residence. What are the dimensions again?
It's approximately 6 foot in length. This is parallel to the 7 front of the building. And it projects three 8 feet eight inches out into the public 9 right-of-way. 10
Is there a garage 17 there already or is it a new garage that 18 they're adding to a house that doesn't have a garage?
This encroachment currently exists. What they're trying to do is legalize it. And history wise, I don't know anything more about it.
So the garage is already there. 110 Streets & Services - 12/7/04
Well, that puts us in a better position, I think, to --
Well, except it awards illegal conduct over many years by legalizing it. Has every neighbor on the street agreed to it? I mean, there ought to be some kind of record as to why the City gives this land away for nothing.
If I live next door, and I wanted to build the same exact garage, could I do it?
You would need a private interest ordinance like Mr. Captis does. The Streets Department would review the encroachment, in terms of its size and what impact it has on the right-of-way. We would either approve it or disapprove it, recommend approval or disapproval. In terms of actually requiring them 111 Streets & Services - 12/7/04 to purchase that land or possibly lease it, since they, you know, are encroaching to the right-of-way, that's an issue that I can't really answer. The only thing I can tell you is, in terms of history, with private interest ordinances and encroachments, where a building has actually gone out into the right-of-way, it has not been policy of the City to require some sort of lease or payment.
Well, I don't know who developed that policy for the City. May have been developed at a time when we felt very rich. And today when we feel poor, it seems to me that that's where we should be looking for increased revenue. We're looking for it in a lot of different places. And when people get value, they ought to be ready to pay for it or have an awfully good reason why the City has an interest in giving them that for nothing. COUNCILMAN DiCICCO: Do you happen 112 Streets & Services - 12/7/04 to know how long this condition has existed?
I do not. COUNCILMAN DiCICCO: Would you happen to know if Mr. Captis has owned this or how long he has owned this property?
I would need to look at my file to see what -- COUNCILMAN DiCICCO: Okay. I'm just curious if he recently bought it and bought it in a previous condition.
If my memory serves me correctly, this gentleman has owned this property for a while. And I believe that, with some of the correspondence, when he purchased this property, this encroachment actually existed. COUNCILMAN DiCICCO: It was preexisting when he purchased it.
But it seems to me it's such a cavalier way to not have the facts on the case, not have it studied thoroughly, with the full recommendation giving the reasons why it's done. I mean, I 113 Streets & Services - 12/7/04 don't understand that. It seems to me somebody is doing something that's not in the best interests of the City, and making it so easy and attractive. Councilman Rizzo is right. Once he gets it, somebody down the block is going to be interested in it. You're going to change the neighborhood. And when the Streets Department says no to somebody else, they're going to say, hey, that's unfair. You said yes to the other guy. Why not to me? I don't see any good in the policy of making these free disbursements of the land.
From your experience, you described an issue that's a bit different. The person bought the property. There had to be a survey. There 114 Streets & Services - 12/7/04 had to be something. Was there ever a permit pulled on the original construction? I wonder. From your experience, how many of these encroachments do you believe are just violations of the law where people say, I don't think I'm going to get caught. I'm going to build it. And if I get caught, there's an easy way out. You come in, you get an ordinance, and you move on. Times have changed.
The only thing that the ordinance does is grant that person the right to have the encroachment. In terms of any permitting that would be required through L & I, they would still have to meet building code requirements.
No, I'm not talking about that. Did you research to see if there was ever a permit for this garage?
Don't you think some of the research should be whether this 115 Streets & Services - 12/7/04 was ever constructed legally? And where did the mistake happen? I mean, if we have buildings that are encroaching three and a half feet out into the right-of-way, somebody made a terrible mistake there.
A permit would never have been issued by Licenses & Inspections for this work. It always required an ordinance to City Council. The Streets Department isn't empowered to approve that type of encroachment.
I'm not talking about approving encroachment. I'm talking about somebody building a building without a permit, making it as big as they think need it to be, and taking the chance that they're not going to get caught. Do you know -- You already said you don't. Is there any way that we can go back to see if there was ever a permit to build this garage or was it built with the original structure? Was it added on later, and was it a person that just said: I'm taking my shot; 116 Streets & Services - 12/7/04 I'm going to build it as big as I'd like to build it; and if I get caught, there's a way out?
I suppose that would require some research with L & I and the zoning folders to see if possibly a mistake was made where they authorized this encroachment in the right-of-way. My understanding is that's not the case. This gentleman wouldn't be trying to legalize what he has out there if he already had some sort of approval. I mean, that's my --
My gut feeling on a lot of these -- and I'll end it -- is that many of these cases are where people do things. They take their chance. They get caught. Somebody said, you can just go get it legalized. Don't bother getting the permits. Don't bother doing this; don't bother doing that. And here we are. We're like the co-conspirator here by now making it right, 117 Streets & Services - 12/7/04 when they intentionally did something wrong, possibly. And I say possibly. Not this gentleman. Possibly without even a permit. And it would be interesting to use this as a case to go back and look to see. When this building, when this structure was originally built, was that garage there? If they added the garage later, was there a permit to do that? Was there a survey? I think before we grant anything going forward that we should know what we're talking about here. When was this -- When did it occur? COUNCILMAN DiCICCO: I'm going to ask, with the permission of this Committee, that we temporarily recess the public hearing to go into the public meeting. Council member Clarke needs to leave for another appointment. He would like to leave his vote on these bills and amendments. m. - - - BILL 040851 - An Ordinance permitting three traffic lanes on Walnut Street, between 40th Street and Cobbs Creek Parkway, and requiring that the lane markers on Walnut Street be changed to reflect this change.
