being used i mean it's just our standard hvac system down there it's not there's actually a
lock on the basement door that prevents any entry into the basement you're it looks like you're
already set up are you already utilizing it as a program no not currently we you
know I submitted the zoning back in February so we got set up and stuff we
can license at three that we can license at three so I'm doing the I set up for
that licensing process to go through that licensing process as I zone this as
well, kind of doing this in parallel. For your, I know we mentioned that the children being
integrated into the life skills and the cooking. What is the, just the everyday plan for their
meals? So you have a meal service or the staff expected to grocery shop and cook. Is it ran
like a normal household or is there a certain, like a meal plan? Well, it's twofold. Yes,
there's a meal plan. There's going to be a menu for everything, but no, this is just ran like a
Also, staff will be expected to cook.
Grocery shopping, I have a supervisor who's going to be dealing with a lot of the menus and grocery shopping while staff prep all the meals for the children.
Is this the only property you're running?
Right.
And so you have a supervisor, up to two other people working at any given time and yourself?
That's correct.
And five people would support all those people, money-wise?
Oh, no.
well so it's going to be i mean so it's 24 7 staffing so there's a minimum of five full-time
employees right but of the two people at any given time supporting five children myself
But up to two people at any given time, supporting five children, myself and a supervisor.
That's correct.
Right.
All right.
And this is going to be your only job?
I mean, full time.
You have other part time jobs?
Yeah, I do other work.
Yes, that's correct.
But this is going to be like my full time.
Once this starts, this is going to be full time.
All right.

The comprehensive plan recommended a change to the previous RM1 residential multifamily zoning at this location.
In 2014, this property was remapped from RM1 to its current RSA 5 residential single-family attached zoning.
the appellate has demonstrated that the proposed use would not cause detrimental impacts
beyond what might otherwise be expected at this location therefore the city planning
commission recommends the board grant the requested variance for personal care home use

Do you swear or affirm to tell the truth, the whole truth, and nothing but the truth?
Our voice share has just a few questions.
Good evening.
Have you submitted your documents and exhibits five days in advance of this hearing?
Yes, I have.
And is your application, are you trying to erect a structure for single-family household living?
Correct.
It's already done.
No, it's vacant land.
Okay. Okay. All right. And you know, you've been refused, um, for, you have several refusals for
height and as well as, uh, the parking. Correct. Okay. You can share your screen and, uh, tell us
what you'd like to do. I am going to pass it to my brother, which is the architect on the project.
Uh, he can, he'll present everything and show you the exhibit and floor plans.
sir sir yes can you hear me okay no no listen to me sir you're the owner you have to testify
you can call your brother if there's certain things you want to point out but you're the
owner you're the one oh sure sure sure i can he share the screen uh he has all the exhibits
he's the architect on on the project just uh i understand but let him share the screen and you
can we have by the way we have all your paperwork wonderful so all the paperwork so what i would
recommend you do is go to photos and plans and show us the property can you see the screen okay
now you can you get can you see the screen okay now
we can see make you might want to make it a little bit bigger
Okay, so this is a vacant land that I owned for many years.
okay why don't you start so so this is a vacant land that i own
It was actually previously approved for a three-unit building.
I live in the neighborhood at 1319 North 6th Street.
And unfortunately, I contributed to some of the development in the area and felt like
multifamily is not needed anymore due to density in the neighborhood.
So I decided to make a single family. And again, the refusal is just for two feet higher than the 38 and accessory parking. And if you can see in the picture right next door, there are garages and many other houses on the street have garages.
um the backyard is pretty large uh it's a three-bedroom house um and if you want i can go
over the plans why don't you go over the plans go ahead bar if you can give me the
floor plans uh show me the picture of uh actually bar if you can go down show me the picture of the
of the streets from different angles so if you can see that's uh north 7th and jefferson street
uh many multi-families uh in the area and you see the bottom right picture
the garages on the adjacent homes to the lot now if you can go down to the floor plans
okay so uh supposedly basement and for and uh first floor kind of thing it's the
the parking is going to be on grade and then the rear will have a bedroom um bar can you
can you tell me what's uh how much we're going down in the base three feet one inch uh we're
down for this uh that's not gonna be the entrance to the house you can see the entrance to the house
uh is different going up to the first floor it's a pretty interesting and unique layout uh split
level on this floor uh living room and kitchen in the living living room dining room in the rear
And you see the rear yard is 36 feet, which is very big for a rear yard.
Then going up to second floor, two bedrooms, bathroom.
And it's actually not a bedroom in the back.
it's a more like an office bathroom in the middle washer and dryer side by side and going up to the
third floor it's the master suite so pretty straightforward design for Philadelphia houses
again we're asking for front load parking that it's covered so we're not really
showing a lot of setback if you can show the renderings bar
Yeah. Yeah. So that's basically what it is.
Okay. Um, questions from the board.
Is there a section?
Thank you.
I do just want to point out this is a four-bedroom house.
While I understand what you have listed on the second floor,
that is going to be considered a bedroom.
We won't consider it as a bedroom.
It doesn't have a...
It's not about you. It's about L&I.
It will get appraised as a bedroom because of its size
and because it has a window and it has a closet.
Okay, but what was the how did the community of their RCO meeting go?
And was there any opposition to the the parking?
No, no, we we had support. We met. We met with APM and and Moss from old Kensington was also there, and she was perfectly fine with that.
We didn't have any opposition.
should have it here oh there it is yeah houses on the block have front loaded parking yes
how many houses on the block oh how many houses um parking
well there's garages not uh well we'll call that garages how many have garages garages
well there's garages not uh well we'll call that garages how many have
i don't exactly i know that the two right next to us have it or do you have pictures of the of the
block uh that will show more i i didn't count this is kind of an attorney thing to do but there is
there are quite a few i want to say all right all right all right so both places next door have
correct rogers okay questions from the board
questions from our attorney no questions at this time questions or comments from the virtual audience
to chair i do not see any hands planning commission in the salamonic the planning
commission the comprehensive plan recommended a change to the previous rm1 residential
multifamily zoning at this location in 2014 this property was remapped from rm1 to its current rsa
5 residential single-family attach there's no unique circumstance or condition of this property
that would prevent it from being used in strict conformity with the zoning code therefore the city
planning commission recommends the board deny the requested variances for accessory parking
and maximum height.

Hello. I'm Stacey Barton, STA. Do me a favor. Listen, why don't you state your name,
state your name and spell it for the stenographer. Yep. Stacey Barton, S-T-A-C-I-E,
Barton, B-A-R-T-O-N. Do you swear or affirm to tell the truth, the whole truth and nothing but
the truth? Yes. Our vice chair has a few questions for you. Okay. Okay. Hi. Good evening.
have you submitted your documents and exhibits five days in advance of this hearing yes i have
and do you understand that you're here for visitor accommodations yes that's correct okay and that you
do you understand you were refused because it was the visitor accommodations are prohibited in
nestona district yes all right thank you you can share your screen and show us what you'd like to
do okay um just to make this go as quickly for you guys as possible do you want me to just go
take your time okay i think i'm like the last one right so i'm like get y'all out of here
um okay so let me share my screen okay um okay so uh here is my notice of refusal um
do you guys want me to just run through all my documents then so we have all of your documents
So what I would recommend you do is go to photos of what their property looks like, okay?
Okay, sure.
And then tell us, you know, just say what you're trying to do.
Yeah, so basically, this is my home.
I have lived in Philly for a long time, specifically on this house since 2021.
at the time when I purchased it, I did not anticipate moving, but I do travel a lot for
my job. And so about a year and a half ago, I started doing short-term rentals when I would
be away from home. Now, fast forward, we have since moved in my dad and my sister with special
needs. And now my fiance, we're getting married next year. So we need to figure out different
housing. We couldn't live here. And so now, but my business is still based primarily out of
Philadelphia. I run my own business. And so I travel back and forth and come up to Philly
several times throughout the year. So I would like to be able to keep it as a short-term rental.
the reason i'm applying for the visitor accommodations is because based on the rules
with philadelphia it has to be your primary residence and we actually purchased a home
it has to be your primary residence and we actually purchased a home at the
beginning of the year that I have now made my primary residence and so hence
the change of use request I can show you do you guys want to see pictures I
of the shows the photos okay sure um here is the outside of the house um and then
uh these are just all the ones that are up on my airbnb
um here's uh the living room area and then
bedroom
And then there is a second bedroom, but it's so tiny.
So it's really just primarily an office.
And then where's my kitchen?
My kitchen and the bathroom is right here.
