in addition to what's on the first floor of the grocery store that that still stands yeah
i'm just talking about the uh sec the second part would you show that do you have plans for
the second floor where the deck where you're you've enclosed the deck with a we're thinking
that's possibly what it is we we went over this for quite a while yesterday trying to figure out
what was actually at play in here i was under the impression that what was in play was the steps
here are the drawings
this is the area that I'm circling that
council is questioning
the second no no no no go back
that appears to be what was submitted
your plans the stairway from our
understanding talking to Al and I is not part of
what was reviewed
so basically it's an illegal deck with a fence around it
well that's what we think you were trying to include yeah we continue this i think we need
to continue this i think we're going to have to to figure out because if you believe it's the
stairwell that is not what l and i is looking at so do you want this to be a resumptive hearing
i think we need to um do we want to ask is the applicant aware of what's happening or do we just
want to deal with what the lawyer is so why don't we why don't we just get the continuance and then
i can speak to my client right and then we could be in a better position to respond the resumptive
hearing date is 2 2 27 at 9 30 a.m and i think what we have to do is you have to go back to l and i
and be sure about exactly what this case is about okay and to clarify also whether the deck is being
enclosed just so we know that thank you right just one minute calendar wise i may be on trial
let me just so i think what you're going to have to do is you're going to have to go back
and talk to the to our administrators and figure that out okay very well thank you
mr chair we excused you you most certainly are and um thank you for your
thank you all right so number 10 mi2026 001 675 1925 east ontario street charles allen is the
owner applicant. Good morning, sir.
Yeah, just pull that. You can pull it right up next to you, okay? Thank you, guys. Could you
please state and spell your name for the stenographer? Yes, my name is Charles Allen.
That's spelled C-H-A-R-L-E-S-A-L-L-E-N.
You swear or affirm to tell the truth, the whole truth, and nothing but the truth?
Yes, I do.
Mr. Allen, our vice chair, has a few questions for you.
Good morning.
Have you submitted your documents in exhibit 14 days in advance of this hearing?
Yes, ma'am.
And we see here that you're requesting staff assistance during your presentation?
I did.
I just bought my laptop, but I requested staff assistance just in case.
All right. And we understand that you're here for legalization of a two-family household.
Well, right now it's currently known as a RSA 5, so a single family, but it is currently like physically a duplex.
Right, right. Yep. That's why you were introduced. Okay. All right. Thank you.
You can, I guess your assistance will be helping you with your presentation. You can start.
is there something that i plug into or do i have to like join the meeting
ian are we uh are we doing his slides too i am prepared to show the slides chair if that's why
why don't you show the slides and he'll talk he'll do the slides for you okay so the one he would
specifically focus on will be the one that says deed merged to pdf if he could yeah sorry there's
a lot of stuff submitted but that one should have pretty much everything in there yep that would be
the correct one so that's your deed right yep okay so it will start with the deed this is just
It will start with a D. This is just showing proof of ownership, going no further.
showing proof of ownership uh going no further
We have all your documents, so we know that you turned in everything you should have.
Awesome.
So why don't you say what you're trying to do?
Yes, sir. So basically, before I broke the property, it was converted into a duplex.
Yes, ma'am.
So when I bought the property, it was already converted into a duplex.
At some point, I wanted to rent it out.
I found out it wasn't zoned correctly.
It was zoned as an RSA-5.
I also want to make sure everything is done correctly.
When did you buy the property?
I bought it about two years ago.
All right.
So here's the way you want to talk about that, how it's laid out.
Yes, yes.
So the first floor in the basement would be one apartment.
The basement is accessible from the first floor only.
uh then the second floor uh i'm sorry let me be more specific so uh both apartments the first
floor and the second floor have separate entrances uh the red brick side of the building will be the
first floor entrance and the basement is only accessible from that first floor apartment uh
the second floor apartment is only accessible from the on what we call the ontario street side
which would be the white face brick side uh and that goes upstairs into the second floor apartment
to make it easier why don't you show us the photos then we can come back and if we have to okay
Yes, sir.
Ian, could you show the photos?
Want to explain what that is?
Yes, so that is the entrance to the first floor apartment.
And that will be the, when you immediately enter, this is what you're going to see.
This will be like the kitchen area, and immediately to your right would be the living room area.
Immediately to your left would be the entrance to the bathroom, and then the entrance to the bedroom.
Tell me what's in the basement.
The basement is pretty much just empty.
It's just storage, but that's also where both hot water tanks
and the, what do you call it, the electrical meters are.
What's that there?
The second floor?
So this right here is still the first floor.
So when you get to the part of the presentation
where there is a white-faced part of the building,
it will be a separate door.
That will be the entrance to the second floor.
I see that, okay.
that's the backyard that's correct and that's the white face yes all right and that's the
second floor that's correct okay and all this work was done before you you that's correct okay
you did the postings right okay
okay uh this is ian that's the end of the presentation
Is there anything else you want to tell us?
No, that is pretty much it.
Do you rent both or do you live in one?
So I'm going to be moving into the bottom apartment.
The upstairs is not rented because it is not zoned correctly.
I didn't feel comfortable doing that.
Sure, sure.
Okay, questions from the board.
Yeah, what's the configuration of the apartments?
Are there two bedrooms, one bedroom?
No, so they're both one-bedroom apartments.
They're both one-bedroom apartments.
And how did our seal meeting go?
It went well.
I believe they were going to be the ones to send the actual approval here.
I did get their approval.
I just, I never received a letter from them.
Okay, thank you.
I have a question about the layouts for the kitchen.
Where are the refrigerators going to go?
Yes, ma'am.
So if we were to go back to the pictures, I guess it was poorly captured on my end.
So right now on the first floor, it seems like there's a oven facing this way, like
facing you when you first come in.
So basically that's going to be pushed this way and there's going to be a refrigerator
up against the wall for the first floor.
For the second fork of fligoration, there is actually a refrigerator upstairs.
when you come up the stairs
to your left next to the window is where the
refrigerator currently is.
So it wouldn't
be blocking any... Across? Yes.
The way from this photo? Yes.
And then how are the ovens
being... Do you know if they're being...
So they're all electrical
and they all have their own outlets.
Other questions?
Trash. Just trash storage
for both units. What's the trash plan
for the building? Yes, ma'am. So for
the first floor, it will be kept inside that little
back we call patio area
I guess is the best they say backyard area
and the person that would live upstairs would be
responsible for like keeping it upstairs
are you opposed to proviso
that requires interior trash storage
I'm not opposed
buy those okay and just so you know like best practice is to do a vented trash closet so you'd
and just so you know like
best practices to do a vented trash
have to do a little bit of construction to add a closet that could hold it okay and then when you
say a vented class i'm sorry a vented trash closet is that like an exterior thing or is it
an interior thing it's just a it's a closet that has a vent so that the you know get out yeah
exactly um and then my second question is what's the plan for property maintenance
for the second floor if all of their utility connections and meters are in the basement
that they don't have access to uh so when it comes to that i do have a person that i'm gonna
say person a company that kind of helps out when it comes to like picking out the uh the rental
um actually can i ask you a question can you further clarify that question for me please
yes so you said all of the meters for the building are in the basement and so like the
person on the second floor would not have access to their pico meter or their water meter so if
anything needed to be serviced they have no access to the basement because they'd have to go through
the other tenants apartment what is your plan for the property maintenance in those instances where
they need to access that yeah so i do have a property manager that they can actually contact
so if any issue does come up where it's like hey i need to get access to that uh there is a party
that's always going to be available for them to contact to be able to get access to uh downstairs
okay for the first for the first floor unit um you've got that bedroom in the back which is
always an issue um is there uh but you're on the corner it's a corner property is there another
entrance into the backyard other than from the bedroom uh another entrance to the backyard other
than from the bedroom right is there is there a gate to the to the backyard from the sidewalk
Well, right now it's not a gate.
Being that there is no actual physical door,
it was just for, you know, to keep people from trespassing.
There was a wooden board put up,
but that would be where a doorway is.
So that would be the secondary entrance.
Okay, and that's off to the,
and that is to the sidewalk.
That is correct.

Planning commission.
Hold on just a minute, Chair. My computer decided to-
Okay, take a refresh.
Thanks.
All right, Chairman. Good morning, Chair and Board members, David Fecta with the City
planning commission right the comprehensive plan recommends no change to the rsa 5 residential
single-family zoning at this location the city rezoned this neighborhood in 2017 in accord with
recommendations in the comprehensive plan this is a primarily single-family block base this appears to
be a legalization of a pre-existing duplex built without the benefit of permits through no fault of
current owner the city planning commission recommends that the board grant the proposed
