The authorization of variance relief will not alter the character of the neighborhood or district or be detrimental to the public welfare.
The photos reflect that the proposal fits the neighborhood, and the support is greatly appreciated of the coordinating RCO and the most impacted stakeholders.
Proposed variance would represent the minimum variance to afford relief and will represent the least modification possible of the regulation at issue.
The grant of variance relief will not substantially increase congestion in the public streets.
Increase the danger of fire or otherwise in danger of the public health, safety, or general welfare.

Would you adopt and affirm the testimony that I've offered as your own?
Thank you.
Questions from the board.
Questions or comments from our attorney?
The comment is, as counsel, as we discussed, given the fact that they just recently submitted revised plans, that it's going to be a hear and hold.
Is it a hear and hold?
Yeah, we just found that out right before.
So we're going to have to hold the vote, but we're just going to wait for the amended refusal.
That's it.
Give me a timeline.
i uh i am resolved to get this uh accomplished quickly i'd like to ask for two weeks two weeks

Vern Anastasio is the attorney.
We have a letter of unanimous support from Logan Civic Association.
Good afternoon, Mr. Chair.
Vern, you've already been sworn in.
Could you just state your name for the record?
Yes, Vern Anastasio, A-N-A-S-T-A-S-I-O, on behalf of Sonia Nikki Drummond.
Our vice chair has a few questions.
Thank you.
Good afternoon.
Have you submitted your documents and exhibits 14 days in advance of this hearing?
I have.
And do you know your refusal and stipulate to us accuracy?
All right, thank you.
You can share your screen and proceed with your case.
Mr. Chair, I was being brought in when you were talking about the RCO.
Can you update me on what you have from them?
I hear a letter of unanimous support from Logan Civic Association.
Very good.
Six total votes.
Thank you.
That was my understanding.
Thank you.
This is a already existing, this property presents itself as a two-family dwelling, and we just want to legalize it.
So here's the refusal dated 6-11 of 2025.
It is zoned RSA 5 on a block that already has several, you know, multi duplexes and triplexes as well as single family homes.
So it's a good mix on the block.
Let's get to.
There's your basement plan.
It just has storage and mechanicals.
There is a powder room down there.
Your first floor.
It has a nice size living, kitchen area here with a full bath and a bedroom.
And the second floor has this living space with the kitchen.
has this living space with the kitchen living room here and a two-bedroom unit
this is a corner property with at least two entrances and exits you show you the
photos first floor at the top second floor at the bottom the property in
question from the exterior. There's proof
of posting. And
I'll also show you.
Did you say two entrances? Yep. Okay.
As you can see here, that's
the side of the property. As you can see, it's rather large. It's
historically been a two-family for many years. Most of the folks
know that from the community and
given the history of the property, given the
fact that it's on a corner with more than one entrance, actually it's three
entrances, and given that we went to the RCO and they've sent over
unanimous support, I'm respectfully requesting the granting of the
variance. With that I'd like to call Sonia Nikki Drummond
to raise her virtual hand.
Thank you.
Sonya has been promoted.
As far as trash storage is concerned,
I know that's always a concern.
Once the units are occupied,
Well, the plan is to have two containers within the property line along the side here, one container for each unit.
Is the owner on yet?
I tried to promote her. I don't try to get her now.
OK. Are you here?
I'm here. Hi. Could you please state and spell your name for the sonographer?

long has this been a duplex oh well before purchase from my clients uh my clients purchased this in
2017 and uh this has been a duplex separated like this for uh at least 10 years prior to that
questions to the board from the board yes i have a question about the basement um
this is a unique property where both tenants have access to the basement and i was wondering
from a property managed standpoint uh what are they going to both be allowed to sort of utilize
that space for storage i want to defer to miss drummond on that miss drummond did you have a
question yes okay can you please answer it yes both yeah and are they both going to have access
to the side and rear yard since they can enter from the through the fence gate yes okay all the
questions yes uh what are the entrances here we're i'm looking at one where does that where
the steps are here in the back where does that go to this center this center space miss drummond
is it one entrance is that correct yes that's the first floor okay and the second floor entrance is
at the front yes thank you so you go through this gate and then to the well my left here
you walk through this gate you walk to the right and you go up your stairs
and that's the entrance to this unit okay all right thank you questions from our attorney

Thank you, Chairman, and good morning. David Fecta with the City Planning Commission.
the city planning commission
Chairman and board members, the comprehensive plan recommends no change to the RSA2 residential single-family zoning at this location.
The city rezoned this neighborhood in 1975 in a council-supported map change.
This appears to be a legalization of an existing duplex built through no fault of the property owner.
the city planning commission recommends the board grant the proposed use variants for two
dwelling units mi 2025 004 410 500 west dung cannon avenue i vote yes michael johns my vote

Could you identify your client
A relationship to the property?
Yes, my name is Vern Anastasia
And I represent Mr. Michael Ingenito, who is the owner of the property in question.
Thank you. And our vice chair has a few questions.
Thank you.
Good afternoon.
Have you submitted your documents in exhibits 14 days in advance of this hearing?
I did.
Okay. And do you wait the reading of your refusal and stipulate to its accuracy?
All right. Thank you.
Show your screen and proceed with this case.
3539-45 North 8th Street.
We were before this board three years ago for this exact same use.
um it was because it was new we were granted at temporary variance as you can see here
actually it was more than uh 2021 it was granted uh and it expires in a few months so that's why
we're back it's been operating with no incident everywhere we had a community meeting it went
very well the neighbors like the fact that my client keeps the place clean safe and secure
with noise at a minimum so let's go over the exhibit here's the current here's
the current zoning permit for the use that was secured and this is the site in
question as you can see right here despite its underlying zoning
classification this obviously has never been a single-family home there are
homes on either side there become very friendly with my client across the
street we do have some vacancy let's get to we have some drawings just speak to
what's going on there.
We have storage, we have work area,
we have an administrative office,
an additional small storage.
And then we have
photos of the property.
What kind of works in there, Vern?
it break down uh auto automotive stuff yeah that's parts yeah that's exactly what it is
no sales or anything like that coming out of here
it's proof of posting
um because this board has granted this relief in the past
because we've had absolutely uh no incident uh with the community other than uh impacting it
positively especially compared to previous uh operators um respectfully requesting the granting
of this variance um my client is not with us today unfortunately so i will ask that the board
take my presentation as his own.
Questions
to the board.
Do they own 718
Fenango Street?
Also, there's a lot of cars that sort of back up
that are stacked in that
location. I don't know. I don't believe
so. Okay.
All right. Thank you.
Other questions? Yeah. Did the RCO
mention
a temporary variance another temporary variance or they just not this time yeah not this time
we had explained that it was temporary in the past uh they were they seemed to everyone seemed
