I'm sure they'd rather be here than there, but if they don't show up, they'll be in trouble. So it's unfortunate. Good morning, Chairman and Members of the Committee. My name is Charles Denny. I'm the Assistant Traffic Engineer. I'm here to testify on Bill No. 030217. The Streets Department has no objections to this bill. However, we previously posted Whitaker Avenue from Godfrey to Harbison Street. We will post Whitaker Avenue to Harrison to Adams Avenue no truck parking under a trial ordinance. We can have these signs posted within three weeks.

My name is Tom McLaughlin. I'm President of Whitaker Mills Civic Association. The street in question is in our area. Whitaker Avenue from Godfrey Avenue south to Adams Avenue is a major route from north to the Roosevelt Boulevard. These areas include Lawndale, Fox Chase, Jenkintown, Rydal, Abington and Huntington Valley. Most of that stretch is bordered on the east by the Northeast Howard Shopping Center which has approximately 15 stores, including Home Depot, Staples, Pep Boys, PetSmart, Old Navy, Dollar Tree, among others. These stores at the present time are generating much traffic along Whitaker Avenue, especially between 3:00 and 9:00 p.m., the peak time. With the additional of the new Wal-Mart in a few weeks, we will anticipate a major increase in the traffic in the area. We would like all truck parking banned on Whitaker Avenue from Harrison Street in the north south to Adams Avenue. Truck parking is a 6 04/30/03 - STREETS - BILL 030219 major problem in that stretch, as parking on both sides of the street reduces the street from to lanes of driving room. There is entrance of the Tower Center just north of Foulkrod Street. Cars turing east onto the entrance usually have a back-up of four to five cars, and the traffic going south try to maneuver around the traffic in the two available lanes creating a major problem. The trucks also block the view of cars trying to turn onto Whitaker Avenue from Harrison Street and Foulkrod Street. Cars use Whitaker Avenue as a speedway and take their lives in their hands every time. The Whitaker Mills Civic Association and the neighbors thanks for any consideration you may give this bill. Good morning again. My name is Charles Denny. I'm the Assistant Chief Traffic Engineer. I'm here to testify on Bill No. 9 030219. The Streets Department has no objection to this bill. We are posting it under a trial ordinance. We can have the signs posed within three weeks.
Foulkrod Street between Howland and Whitaker Avenue is a main artery that people coming from Oak Lane and areas to the west use to get to the shopping center, the Sears Tower Shopping Center. The trucks park on one side of the street and sometimes on the other. It's a narrow street, and traffic turning into Foulkrod Street from Whitaker Avenue, it's obstructed, there's an obstruction of view. Also, at Howland Street, the trucks block the view of the traffic coming up Howland Street across Foulkrod Street. So we feel 8 04/30/03 - STREETS - BILL 030199 that this in conjunction with the other bill would be good for the area.

My name is William Mautz, and I'm a Construction Engineer with the Streets Department. I'm here to offer testimony for Bill 24 No. 030199 on behalf of the Streets Department. This bill authorizes David Dinh, 1122 9 04/30/03 - STREETS - BILL 030199 South 10th Street, to construct own and maintain a one-story vestibule addition on the south footway of Washington Avenue and a dumpster enclosure on the east footway of South 10th Street, adjacent to the property 932 Washington Avenue. The encroachment descriptions are as follows: The vestibule addition is feet in 9 length, 12 foot high, and encroaches 6 feet 5 inches 10 onto the south footway of Washington Avenue, leaving 11 7 feet 7 inches of clear unobstructed footway. 12 The trash enclosure is 6 feet in length, 13 10 feet high and encroaches 5 feet onto the east 14 footway of South 10th Street, leaving 7 feet of 15 clear, unobstructed footway. 16 The Streets Department has reviewed the 17 construction plans for this project and has no 18 objection to the passage of the bill.

Bill No. 020385, an 10 04/30/03 - STREETS - BILL 030385 ordinance amending Chapter 11-600 of the Philadelphia Code, entitled "Construction, Encroachments and Projections Over, On and Under Streets," by adding Section 11-610, entitled "Construction Equipment," to require anyone placing any form of construction equipment, including dumpsters, trailers, fences and scaffolding, within the public right-of-way to obtain a permit; providing for conditions for obtaining permits; and authorizing the Department of Streets to establish conditions for obtaining such permits; all under certain terms and conditions.
Good morning, Chairman and Members of the Committee. My name is William Mautz and I'm Construction Engineer with the Streets Department. I'm here to offer the following testimony for Bill No. 020285 on behalf of the Streets Department. This bill will amend Chapter 11-600 of the Philadelphia Code, entitled "Construction Encroachments and Projections Over, On and Under Streets," by adding a new section entitled "Construction Equipment." This bill will require that permits be 11 04/30/03 - STREETS - BILL 030385 obtained from the Streets Department for anyone placing any form of construction equipment within the public right-of-ways. In addition, this bill 5 mandates that reflector or similar warning devices be affixed to construction equipment which are designed to alert drivers and pedestrians of the presence of such equipment. The Streets Department supports the passage of this bill and proposed amendments.
Good day, Councilman DiCicco and Members of the Committee. I am Otis Haigler, Jr., Legislative and Regulatory Affairs Manager for the Department of Licenses and Inspections. Today, I'm here to provide testimony on Bill 020385 which, if enacted, will add section 18 11-610 to the Philadelphia Code to regulate construction equipment located within the public right-of-way. In light of amendments to Bill 020385 which were drafted and approved by the Law Department on February 7, 2003, the Department of Licenses and Inspections fully support the enactment of this bill with the aforementioned amendments. 12 04/30/03 - STREETS - BILL 030385 The bill, as amended, will limit Licenses and Inspections' role regarding construction equipment located within the public right-of-way to the licensing of dumpsters which are placed temporarily for the removal of debris. This is in line with current regulatory responsibilities of Licenses and Inspections governing the licensure of other types of dumpsters which are located on private property or within the public right-of-way and is required for waste storage in construction with business activity. The enactment of Bill 020385 will also allow the City to fully regulate dumpsters used for the collection of construction debris which is currently exempted from regulatory oversight by Section 9-604, Subsection 10, Subsection C of the Philadelphia Code. Thank you for the opportunity to provide the Department's testimony on Bill 030385. I'll be happy to answer any questions at this time.
Thank both of you gentleman. Mr. Haigler, how does this or does it affect in any way -- I apologize, I didn't get a 13 04/30/03 - STREETS - BILL 030385 chance to read the amendments or bill in its entirety -- the situation with existing dumpsters that are used for, say, restaurants.
No, sir. As a matter of fact, the bill itself indicates that -- well the amendments, I believe. The amendments that we have indicates in the amendments that dumpsters that are regulated under 10-722 of the Philadelphia Code or any other section of the Philadelphia Code would not come under these requirements. They're already separately regulated under those sections.
Explain to me, if you can, the mechanics of how this will work. If someone's taking out a building permit, would that be part of the permitting application where the contractor would have to identify --
No. What would happen is, once this bill is enacted, the companies that own these types of dumpsters that are placed in the public right-of-way for debris, any types of debris, they would have to license all of their dumpsters, register their dumpsters with the Department of Licenses and Inspections. And the Streets Department, their responsibility would be to 14 04/30/03 - STREETS - BILL 030385 individually issue a permit for the company to place that dumpsters at a particular location. But the company itself would have to license all of their dumpsters annually with the Department of Licenses and Inspections. At one time, on an annual basis, whatever the date that's established, they would have to license all their dumpsters that they propose to put at some point in the public right-of-way.
So the permit would be issued to the company more or less, because the dumpsters can change sometimes daily. I mean, it may not be the same quote/unquote dumpster.
The license will be issued to the company. Each dumpster would have to licensed by that company prior to their placement in the public right-of-way. The Streets Department would issue a specific permit for the location.
We currently have no regulation in terms of scaffolding? I mean, if somebody's building and they put scaffolding -- there's scaffolding going around this building today. Are they not licensed today for that?
Well, scaffolding comes 15 04/30/03 - STREETS - BILL 030385 under the jurisdiction -- L&I, we don't regulate scaffolding. That comes under the jurisdiction of OSHA, Occupational Safety and Health Administration. It doesn't come under the City requirements because it's on the public right-of-way, No. 1. And No. 2, there are certain guidelines that you would have to follow related to the federal guidelines und OSHA for that type of structure.

No. I just wanted a point of clarification. I think Mr. Haigler explained it correctly, that it would only apply to the dumpsters that the vendor would place in the right-of-way. And, obviously, we all remember the fact that a dumpster was left in the right-of-way unlighted with no reflector material on it that was involved in a very serious vehicle accident. So I just wanted to make it clear that it would only affect the dumpsters that are left in the public right-of-way. 16 04/30/03 - STREETS - BILL 030385
Thank you, Mr. Chairman. I just wanted to ask a question with respect to the permit. I'm assuming there's an additional fee additional associated with the new permit, or is that --
No, sir. There's a licensing fee for the license. The permits are issued by the Streets Department and the permits are to place the dumpster in a particular location. But the license covers all of the administrative costs that's associated with both departments and what they have to do to act.
An additional point of information is that it would not affect all of the dumpsters that a company would put at a particular site. It would only affect, let's say, the 40 cubic yard dumpsters that they would physically use for the right-of-way application. So they would only have to license the dumpsters that 17 04/30/03 - STREETS - BILL 030161 they plan to place in the right-of-way. It would not affect their entire inventory.

The purpose of this ordinance is to provide sufficient street frontage for new residential construction. This action is consistent with the Redevelopment Proposal and Urban Renewal Plan for the West Mill Creek Urban Renewal Area that the Planning Commission approved at its on meeting December 17, 2002.
