And the other thing I'd like to add is that there was a petition that was sent around to all the neighbors in Queen Village at the time this all went on. And I have signed signatures from all of them -- I'd say 85 percent in the neighborhood itself that surrounded Howard Street actually was okay with the whole thing. I have signatures. We had a meeting of 14 Streets & Services - 4/7/05 the zoning committee regarding this project. We generally meet with the area, anything we think will be impacted by the project. On something like this, we're lucky to get two or three people out. We got at least a good dozen people. I would say they were uniformly opposed to the project. They were concerned about height issues and a number of other things. It's been a while since the meeting. We sent a letter to the Zoning Board of Adjustment stating our opposition. When the letter was read into the record for the ZBA, for whatever reason they didn't read the first line of the letter which said that we were opposed to the project. So, when I talked to the clerk at the Zoning Board of Adjustment, I asked her to put our letter right next to the testimony. And she said, yeah, you're right. For whatever reason they didn't read the first line. And the first line is Queen Village Neighbors Association zoning 15 Streets & Services - 4/7/05 committee is opposed to this application at this time. CHAIRMAN DiCICCO: What is the date of that letter?
It's old news. CHAIRMAN DiCICCO: Yeah. I was just going to say, because I have a more recent letter the same day ironically, December 8, 2004.

What I'll do is, I will ask this bill be voted out of committee favorably today. If in the next seven days you find that there's something contrary to what is being testified to by Mr. Penzarella or others, please notify my office in writing. If not, I will proceed with passage of the bill on second and final reading which will be two weeks from today. So if we vote it out today, sir, so you'll understand, the first reading would be next Thursday of the bill. Pechin Street is what is commonly referred to as a paper street. While it is on the City Plan, and portions of it are legally open, it has never been constructed, and there are no plans to construct it in the near future. The proposed action seeks to strike from the City Plan and vacate the legally opened portions of Pechin Street from Cinnaminson to Lamont Street. Since it is a paper street, no one has clear responsibility for the upkeep or security of the area. The adjoining property owners are forced to trim the growth of the strip of land and keep it from looking like a wasteland. 34 Streets & Services - 4/7/05 There are problems are compounded by neighborhood youth who use the area for drinking and other illegal activities, following which they just toss their empty beer cans on the lot. Passage of this ordinance, allowing the striking and vacating of Pechin Street will result in a disappearance of this problem area. This is not an administrative 38 Streets & Services - 4/7/05 ordinance but an ordinance requested by Hopia Seen and Michael Koonce, Redevelopment Authority, 1234 Market Street, 16th Floor, Philadelphia, PA 19107. The request to strike and vacate Carlisle Street from Oxford Street to Cecil B. Moore Avenue was first proposed by Temple University in 1999, Bill Number 990305, but the school failed to meet all the conditions of the ordinance within the one-year time limit imposed by the ordinance. In 2000 the university received a time extension, Bill 000320, but again failed to produce the necessary agreements. This and the previous attempts were to assemble the site for Jump Street Project. Temple now feels the time is right for another attempt to strike and vacate Carlisle Street. The areas is proposed for the development of student housing, retail shops and surface parking area. The proposed student housing and the parking area would be a valuable condition to Temple University. 39 Streets & Services - 4/7/05 The retail shops would be of great benefit of both Temple University, as well as the surrounding community. Good afternoon. My name is Judith Robinson, and I'm here to testify on Bill Number 050142. Everything in decency and in order. Whenever there is a development in any neighborhood, there should be a neighborhood benefit strategy. I think we all can agree on that. It's no way that we should have development of a $75 million development -- correct me if I'm wrong -- without including the people surrounding the development. I think we already agreed on that a couple 41 Streets & Services - 4/7/05 administrations ago. And I don't understand why we have so much a problem with this. This is something I want to put in the record today, because I think we may have a consensus. I'm referring to a Resolution Number 177 -- 17779. This is regarding a service, a community. It's called the Development Service Agreement. It's also known as a community service agreement. And it presents all the details about minority participation, foundations that will be created with millions of dollars, loan programs for our communities. And it referenced the areas from 6th Street on the east, Spring Garden on the south, 33rd Street to the west, and Lehigh Avenue to the north. That's the area I live in. Okay? And it has all kinds of ramifications, as far as the development of our community. I just don't understand why in a City of this size, with the sophistication and education we have, that we can't get these things done. 42 Streets & Services - 4/7/05 Now, I'm referencing this service agreement contract because I went to the Redevelopment Authority. This is where the service agreement contract originated. Mr. Johnny Dougherty is the chairman of the board, okay? Of the Redevelopment Authority. He's also the business manager of union 98. Mr. Mike Ferrer is also on the board. These are two union guys. So, all the obstacles about the union won't allow us and blah, blah, blah, we don't want to hear it. I mean, I think this milestone project right at the corner of Broad and Cecil B. Moore, which according to Redevelopment comments, is one of the choicest piece of -- parcels of real estate in North Philly. And I'm a real estate broker. I say, yeah, yeah. Okay? I live in that area. I would be happy to walk to a movie theater. So, please, don't think I'm trying to stop the development. I want inclusion, respect. Let me make a little adjustment. Just last Friday 43 Streets & Services - 4/7/05 my Councilman, Darrell Clarke, thought it was appropriate to have a groundbreaking service and not invite the people from the community. Well, we came anyway, because we have the service contract agreement, and we wanted to hear it, too. So that was our way of letting the Councilman know that we want this service contract adhered to. We want it done before they get the digging too deep because we got some folks that can handle construction from start to finish. So, we want in. And this is my way of letting you know we're real serious about it. I want this filed copy from the Redevelopment Authority referencing this community service agreement... I want in the future for the Chairman of the Redevelopment Authority to make this document known to the community. This has future ramifications. How would -- I know that this service agreement exists. As an entrepreneur in that community or a homeowner in that community, how would I know about these foundations if they weren't 44 Streets & Services - 4/7/05 publicized? Let's put some sunshine on this crap. Sunshine, they tell me, some smart person said is disinfectant. Let's get some of these germs out of the way, and let's be respectful of each other. Good afternoon, Mr. Chairman, and other members of the Committee of Streets and Services. My name is Francis Healey. I represent Police Commissioner Johnson. I'm a special advisor in his office. I'm here to testify regarding Bill 18 041070, as amended, regarding short dumping. First, on behalf of Commissioner Johnson, let me extend the Commissioner's gratitude for including the department's comments on this legislation. As everyone well knows, illegal dumping clearly undermines the quality of life throughout the entire City. 47 Streets & Services - 4/7/05 And for this reason, the Philadelphia Police Department fully supports the efforts of City Council to address this issue. It's long been recognized that the potential profits from illegal dumping far outweigh the cost or fines. In fact, the fines for dumping were often viewed by unscrupulous contractors or vendors or operators as merely the cost of doing business. Until recently the City was powerless to change this mind set. Despite aggressive enforcement, short dumping continues. It's a matter of dollars and cents, not right or wrong. However, with the recent amendments from Harrisburg, the City now has the power to truly make a difference to affect the money. Despite all the enforcement initiatives, affecting the bottom line is truly the only way to defer this type of activity. This amendment does just that. It 48 Streets & Services - 4/7/05 will affect the bottom line of those contractors or operators caught illegally dumping. Specifically, this amendment will not only increase the monetary fines up to $5,000, but also authorize the seizure of any vehicle used in the commission of the dumping, regardless of value. This is significant and worthy of the offense. With this legislation, the cost of illegal dumping will finally exceed the benefit. And I'm sure -- And actually, I'm sure it will have an immediate and dramatic impact throughout City. In fact, I'm certain that after the first brand new 150 gets seized, it will have a nice effect for the rest, the other would be's. For this reason alone, the Police Department fully supports this amendment, and again applauds City Council's efforts to address this issue. That concludes the testimony. Thank you, Mr. Chairman. Good afternoon, gentlemen. Currently... My understanding is currently there is no forfeiture procedure, as it relates to illegal dumping of vehicles at all.
The forfeiture procedures that do exist are under Title 11 of the Crimes Code. And I believe -- I 12 haven't -- I'm not an expert on that code 13 section, but I believe after the second 14 offense is when the forfeiture provision 15 kicks in. 16 And I think the crime's also 17 upgraded from summary to a misdemeanor of the 18 third degree at that point. But on the City level and under Title 75 there has not been a forfeiture provision. That's recently enacted, through Harrisburg gave us the authority to do that. As you know, previously we can only forfeit something no more than $300.
So now this actually gives us the opportunity to take the truck regardless of value.
For construction violation, I believe it's a first-time offense. The vehicle can be seized.

Good afternoon, Councilman DiCicco and members of the Streets and Services Committee. My name is Frank Leo, and I'm the Program Administrator for the Sanitation Division of the Streets Department. 51 Streets & Services - 4/7/05 I'm here today to present testimony in support of Bill 041070. Bill 041070 amends Chapter 10-700 of The Philadelphia Code, entitled Refuse and Littering, by increasing the fines and penalties for the dumping of debris, providing for the forfeiture of any property used in such dumping, and making certain technical changes, all under certain terms and conditions. Essentially this bill amends The Philadelphia Code, in order to implement recent changes in state law, that will allow the City to adopt increased penalties for short dumping. Under these provisions, the City would seek fines of up to $5,000, plus forfeiture penalties for any vehicle used in connection with short dumping. Short dumping, the illegal dumping of trash and other refuse, such as construction debris, tires, used furniture, and all sorts of hazardous materials, is a serious problem in the City of Philadelphia. 52 Streets & Services - 4/7/05 Short dumping poses a direct and significant impact on the health, safety and welfare of all who live, work and visit the City. Many of our streets, sidewalks and parking lots and vacant lots have become chronic dumping grounds for thousands of tons of illegally dumped trash and debris. Illegal dumping creates breeding grounds for rodents and disease, safety hazards to children, and pollution and contamination via soil and stormwater runoff. Also, in many cases where a concentration of chronic dumping exists, there are also higher rates of crime, graffiti, and other conditions of blight that contribute to the progressive degradation of the area. The effects of such degradation are far-reaching and negatively impact upon the overall aesthetic value and economy of the City. Such conditions raise the cost of doing business and ultimately bring about the 53 Streets & Services - 4/7/05 demise of many other businesses, and the commerce and jobs they provide. The Streets Department spends over a million dollars per year on illegal dump sites. A 1995 study by the Pennsylvania Economy League estimated direct costs of illegal dumping, spread over a variety of City agencies, to be $5.4 million. Without the new measures contained in this bill, the maximum penalty that can be applied to a party found guilty of illegal dumping that contributes to these costs is $300. Consequently, the Streets Department endorses and recommends passage of this bill. Enforcement of the provisions of this bill will be applied by the Police Department and any other authorized personnel, including those in the Departments of Streets and Licenses and Inspections. Penalties for violations of 10-710, subsection two, shall be a fine of up to $5,000, the forfeiture of any property used 54 Streets & Services - 4/7/05 in the conduct of this violation, and/or such equitable remedy as the court may deem proper, including, without limitation, an order to clean up the location at which the violation occurred. Good afternoon. Judith Robinson, testifying regarding Bill 16 Number 041070. I think this is a great bill. Thank you all very much. However, my concerns are about enforcement. I live in the heart of North Philadelphia where people think, with all the vacant lots, that we like dumping. And we don't. We are trying to be following -- trying to follow all the litter laws, et cetera. So, we would really like to have this law enforced, those laws on the 55 Streets & Services - 4/7/05 books and this one, too. We're concerned about our sanitation officers. What is the role of the sanitation officer in finding out who are these folks dumping in our neighborhood. It looks to be that they are contractors, et cetera. We see construction debris. At times we see, like, a whole house of furniture. It looks, too, some members of our community for some of our community meetings as through the City has a relationship with short dumpers because some of these lots that are cleaned off within a week or less, they are filled up again with debris. So, we would like to know about enforcement of this law. We think it's a great thing, but we want to know how are you all going to work differently to enforce this law. Thank you. CHAIRMAN DiCICCO: Could either of you gentlemen comment briefly on what you do in regards to enforcement, and will there be 56 Streets & Services - 4/7/05 any level of increased enforcement going forward.
I'll comment. From the Police Department's perspective, we currently do aggressively enforce short dumping. We have several... I believe several thousand arrests for citations for short dumping over the last several years. There is a dedicated unit through Neighborhood Services that does investigate short dumping locations and tries to identify the dumpers or the short dumpers, and then goes back and tries to cite the illegal operators. So with this bill in effect, what it does is, our enforcement level may not change very much, but the impact it will have on the violators is much more severe versus a mere summary citation, in some cases where they do come back two and three days later. In this situation, the vehicle that they had originally dumped with would be seized. Therefore, that should abate a great deal of this type of behavior. 57 Streets & Services - 4/7/05 CHAIRMAN DiCICCO: Thank you.

In earlier testimony about... I don't know if it's the Streets Department, there was a mention of surveillance by... I don't know if it was by police officers, as it related to locations that were known dump sites.
That's done primarily by the Neighborhood Services Unit when they identify a specific location that's constantly targeted. They will set up a surveillance. But I'd rather not tell you which locations right now.
Please don't tell me where it is. 58 Streets & Services - 4/7/05
Right. They do -- When they receive information and under their own initiative will start an undercover operation for those surveillance; actually, sometimes multiple locations at one time. There's a lot of these dumpers actually will divvy up the load between two or three spots, so it's not completely obvious at one time. We found that out from experience. So usually there's a route that they'll pick, especially during certain times of the year when certain type of construction is more popular.
Do we or have we entertained using video surveillance, as opposed to...
We haven't. The whole issue of video surveillance is actually coming for a hearing next week.
As a Police Department 59 Streets & Services - 4/7/05 we're fully -- we'd accept looking into anything that could help. Absolutely.

Yeah. Police Department through the Neighborhood Services Unit. CHAIRMAN DiCICCO: I understand the necessity and the importance of the large scale short dumping, people pulling up with a dump truck or pickup truck. But I also -- and I know I've talked about this in the past. I think it's just as important, where people just bring a bag or two of household trash. And it's always like in a certain location. 60 Streets & Services - 4/7/05
Correct. CHAIRMAN DiCICCO: 10th and Federal, southeast corner, which is on the perimeter of Capitola Playground. It's a commonly used short dumping -- not in the sense of the big trucks pulling up, but people who either live in apartments or live in houses a few blocks away, walk their dog and whatever, and then they drop a bag of trash. And then at the end of the weekend, in particular, there is a significant amount of trash. Similarly we have problems on South Broad Street. The debate is to whether or not we want to remove the trash receptacles or leave them in place. But the trash receptacles is a mixed blessing, if you will, because there's a large number of rental units in and around the South Broad Street corridor. There's a new immigrant population that may not be familiar with the sanitation codes from wherever they come from. These things may be more appropriate because they expect regular pickup. 61 Streets & Services - 4/7/05 But Broad Street on most days, especially on a -- by Monday -- Sunday night or Monday, it's horrible. It's the gateway into the City from the south. What, if anything, are we doing about that? Again, it's not the big trucks that are pulling up or the pickup truck. Individual property owners, households or tenants who live in apartments. Cumulatively it adds up to a lot of trash. Is there any enforcement with that? People have gotten educated. They no longer leave an envelope with their name inside. I'm sure they don't do that. The surveillance. Do we do anything like that?
What we do is... Regrettably -- I understand what you're saying. A lot of times individuals will start using a site after a commercial dumper has dumped something. Like, there's a pile there, they start adding on to it. So I think addressing the commercial operators is the first step. But we don't lax enforcement on the individuals as well. 62 Streets & Services - 4/7/05 We'll seize on an individual car. We'll take action against an individual person who's dumping. When we pick up the sites, we don't pick and choose who comes and dumps on them. We'll cite or arrest anybody shows up at that site, whether it's an individual with one bag of trash or a pickup truck with a load of bricks. CHAIRMAN DiCICCO: See, I think that... It's just a thought. I'm not certain that it will turn out the way I suspect it will, but if we can make examples of people, individuals who live in apartments, houses, wherever, and take the liberty of dumping their trash at a particular site -- And they do this with regularity. This isn't just once in a while. Not that it makes it right to do it once in a while, but this is like almost a daily occurrence, you know, a process for them to leave their house at a certain time of the night and drop it off. If we were able to enforce that and 63 Streets & Services - 4/7/05 get some publicity as a result of that, especially in the neighborhood papers -- I'm using South Philadelphia as an example. South Philadelphia Review would show a photograph or do a commentary about certain people who were fined $300, I think word will begin to get out. I just think that the problem is -- And it's not being critical of the Streets Department, the police. We're kind of used to these things. It's like the abandoned car that no 14 one pays attention to. The first couple of days it's a nuisance. By the end of the week, well, you know, it's still there. And all of a sudden, if it doesn't get removed, people -- it just becomes part of the landscape. People just kind of get used to it. And I think that would really be important for quality of life issues throughout the City if you had a more -- And I actually think that if we did this -- I know cost is always a concern -- that the 64 Streets & Services - 4/7/05 revenues from the fines would far outweigh the cost of the enforcement. I truly believe that that would be the case.
Under the current bill 6 I agree. What we can do, if you want, Councilman, I could talk to you after. You can give me some specific locations and times where different activity occurs, and I'll relay it back to community services -- or not community. I'm sorry. To neighborhood services. And then once, if we do get a significant number of arrests or citations, we could -- CHAIRMAN DiCICCO: I appreciate that. And if we're successful with the arrest and citation, I certainly want to give credit where credit is due and publicize it.

Our Neighborhood Services actually covers, in addition to this 65 Streets & Services - 4/7/05 type of activity, as well as the abandoned auto. So everything plays in. CHAIRMAN DiCICCO: Thank you very much.

I'll be glad as well to get any locations, and we can address them. CHAIRMAN DiCICCO: Well, I can tell you right now. 10th and Federal on the southeast corner is pretty notorious. Broad and Tasker, especially on the east side which would be the north -- I'm sorry. The west side. The northwest corner of Broad and Tasker, is horrible. Up and down Broad Street. That seems to be one of the primary locations for short dumping. And I suspect it's from people who live in apartments. And unfortunately for them, you know, these are properties that 66 Streets & Services - 4/7/05 were converted into multi-family dwellings many years ago, didn't provide access to the yard but for the first floor tenant. And there really is no place for them to put trash. But the landlord should be responsible for providing daily or every other day trash removal.
