The Committee of Public Works is now in session to hear testimony on a number of bills, the first bill being Bill No. 010349, which is an ordinance authorizing the Commissioner of Public Property to purchase in lieu of condemnation, or to select and appropriate, certain lots or parcels of ground within the area bounded by Lehigh Avenue and 28th Street, Oakdale Street, and 29th Street, for public library purposes, under certain terms and conditions. I'm here in support of Bill No. 010349, which authorizes the Commissioner of Public Property to acquire certain properties in order to assemble a footprint for replacement of the Widener Library. That's a brief summary of a slightly more detailed written testimony with all of the appurtenant details attached to it.

Yes. Thank you, Mr. Chairman. Good morning, Mr. Perez. COMMISSIONER PEREZ: Good morning.

Councilman Clarke

Indeed to the body and to the members present, this particular acquisition allowed us in the Philadelphia library system to build a new facility up on 29th Street, and we'll be replacing a currently undersized and potentially dangerous facility further down the street. And I just wanted to thank the folks from the Library and Capital for allowing us an opportunity to have a much larger and much better facility. COMMISSIONER PEREZ: That's correct. I believe it nearly doubles the size, not to mention that it provides us the opportunity to do state-of-the-art construction and space planning rather than the antiquated, undersized kind of building that the existing one is.

Councilman Clarke

And off-street parking also, which is always a -- 6 6/7/01 PUB. PROP. PUB. WORKS - BILL 010349 COMMISSIONER PEREZ: And plenty of parking, plenty of off-street parking.

Right. COMMISSIONER PEREZ: I also would want to clarify to Council that the footprint includes mostly vacant land. I believe there's only one or two standing properties that are involved in this footprint.

My name is Margaret Norris and I'm a resident of the neighborhood. I live on 27th Street. I'm a member of Mt. Sinai Tabernacle Baptist Church at 28th and Lehigh Avenue. I am also a board member of the Mt. Sinai Community Development Corporation. I am in favor of the relocation of the Widener Branch Library to where it's specified in the bill.

Ms. Norris

I only have two concerns: one is parking and the other is drug activity in that area. But I am in total support of the relocation.

Yes. My name is Judith Robinson. I am a member of Friends of Widener Branch, and we too are very excited about the new Widener Branch Library. However, our concerns are exactly where the library will be positioned. I would like to know the exact addresses for 8 6/7/01 PUB. PROP. PUB. WORKS - BILL 010349 acquisition. We have outlined some perimeters. What we'd like to know is the exact address as to which property will be acquired.

My name is Andrew Brazington. I'm the Director of Community Relations with the School of Hard Knocks, which is located at 2509 Lehigh Avenue. We've been involved in the blight elimination process for -- going on two and a half years now. We converted one vacant lot on Leigh Avenue, 2513 Lehigh Avenue, into a beautiful garden, and we're in total support of this bill for a new library 'cause the residents and the general vicinity deserve a new library. There are some questions in reference to the planning of it that we would like to be abreast of and have involvement in participation in the process also.

Absolutely, absolutely.

Let me just state for the record that it's the purpose of the committee today to bring this out of committee to get it voted on before our beginning-of-summer 9 6/7/01 PUB. PROP. PUB. WORKS - BILL 010349 session next week. So what I would do today is let the bill out, and I'm sure it will be unanimously supported, and I'd direct you to Councilmember Clarke and his staff for details on some of the questions that you have relative to the positioning, the address, the parking, and the other issues. I'd hate not to get it out and have it delayed so --

No, no, we are not interested in having the bill delayed, but want to just be on record that the community has been planning around this library. We've had meetings and we'd very much like to continue to be very much involved. We just want to go on record as stating that, sir. Thank you very much.

Seeing none, we will now move to Bill No. 010382, which is an ordinance 25 authorizing the Commissioner of Public Property to 10 6/7/01 PUB. PROP. PUB. WORKS - BILL 010382 execute and deliver to the Philadelphia Authority for Industrial Development without consideration a deed conveying fee simple title to a certain tract of City-owned land with the buildings and improvements thereon situate at 313, 15, 17, 19, 21, 23, and Race Street, subject to the terms and 8 conditions of the Philadelphia Industrial and 9 Commercial Development agreement between the City, 10 PAID, and the Philadelphia Industrial Development 11 Corporation; and further authorizing PAID, 12 notwithstanding any contrary provisions of the 13 Philadelphia Industrial and Commercial Development 14 agreement to sell this property to a nominee of PIDC 15 for the consideration of $552,238, all under certain 16 terms and conditions. 17 Good morning. Mr. Deegan

Good morning. My name is 20 Paul Deegan and I represent PIDC. I have written 21 testimony submitted. 22 Basically, it's a vacant fire station 23 and police station on Race et Street that's been 24 vacant for a number of years. The City is going to 25 convey this property to PAID and PAID will then sell 11 6/7/01 PUB. PROP. PUB. WORKS - BILL 010382 the property to Don Clendenon Jr., who is the owner of ISUN Networks, Inc., a Philadelphia-based Internet company that develops communications technologies for the higher education market. The City's Police and Fire Departments formally used the property. There's a three-story police station and a two-story vacant fire station, and there's also a parking lot on the eastern end of the parcel. Mr. Clendenon intends to renovate these buildings and occupy them as a corporate headquarters facility, and he also informed me recently that there may be another start-up company moving in here. So we're looking for some job creation at this site in addition to the investment and renovating the buildings.

Councilman Kenney

And as I've read and I'm aware, the company is moving into Philadelphia from where?

Mr. Deegan

He has some people who have moved in from North Carolina from ISUN Networks.

Councilman Kenney

Terrific, great.

Mr. Deegan

The ordinance also authorizes PAID to sell the property to 12 6/7/01 PUB. PROP. PUB. WORKS - BILL 010382 Mr. Clendenon for a consideration of $552,000. This price is less than the appraised value of $1,030,000. The price reduction is based on the extremely deteriorated condition of the existing structures, which has been unoccupied and deteriorating for approximately ten years. The City had an outside engineering consultant go over the buildings, and they estimate that over $500,000 would be needed just to correct dangerous conditions such as a collapsed floor in the former firehouse and a disintegrating and dangerous cornice on the former police facility. And as if you walk by the building, you can see it's fenced off, there's nets around it to protect you from being hit by any of the things falling off the building. The repairs will be needed just to stabilize the buildings and make it feasible to renovate and reuse them. This company, Mr. Clendenon and ISUN Networks and the other companies he's thinking of starting up are the kind of companies that the City's trying to attract. Mr. Clendenon is a resident of Old City and he's very familiar with the properties on Race Street. He intends to make 13 6/7/01 PUB. PROP. PUB. WORKS - BILL 010382 substantial investment in these buildings and to preserve their architectural and historic character. The City's general fund will benefit from receiving over a half million dollars from the sale in addition to the new construction jobs, new permanent jobs, and the taxes created by the company. I ask that the committee consider this bill favorably and that the rules of Council be suspended so as to permit first reading at the next regularly scheduled meeting of Council. I had an opportunity to meet you on a couple of occasions and get an idea of what the project was about, and we want to thank you for having the courage and the foresight to invest in our city and to bring your company up from North Carolina and to make an investment in a great part of Philadelphia. Good morning. 16 6/7/01 PUB. PROP. PUB. WORKS - BILL 010421 COMMISSIONER PEREZ: My name is Andres Perez, Commissioner, Department of Public Property, and I'm here in support of Bill No. 010421. The bill essentially authorizes me to enter into agreements with the Philadelphia Municipal Authority, who will have entered into agreements with an entity of the Temple University Episcopal Hospital Services Group in order to provide space within one of their buildings located at 100 East Lehigh Avenue. And the purpose is to relocate and expand the Special Victims Unit currently located in approximately 8,000 square feat of space. Additional details involving the programming, the background can be supplied by Mr. Tustin from the Capital Program Office. Our role, of course, is to facilitate the real estate agreement and to empower the Capital Program Office to move forward with the planning and relocation on behalf of the Philadelphia Police Department. I'm sorry. My name is Richard Tustin, and I'm the Director of the Capital Program Office for the City of Philadelphia. As Commissioner Perez has already indicated, we've been working with both the Police Department as well as many outside advocacy groups over the past several months to come up with a new plan and a new location for the Special Victims Unit. We were able to find a location that's very convenient and adjacent to Episcopal Hospital, where most of the services are provided for the people that need this type of service. And we think it's going to be a great advantage and also a benefit to the City to have these services in that location. And I believe we also have some support from the advocacy groups that we've been working with over 18 6/7/01 PUB. PROP. PUB. WORKS - BILL 010421 the past several months.

Councilman Kenney

Great. And I'd appreciate it if you could forward to the Chair at your convenience if there's any schematics and layout of what I know during the discussion of -- I guess this is kind of like a collocation of facilities of both advocates and police and other social workers and psychologists to deal with the Special Victims Unit. Some issues that we discussed during the course of the time was separate entrances and holding areas and place facility areas for children and that kind of stuff, so I'd really like to see what it is that's planned. We'd love to move the bill forward, and we will move the bill forward, but I'd like to see what the setup's going to be.

Good morning.

Ms. Tracy

And I've been part of the advocacy effort, and I would just like City Council to know how pleased we are with the new location, that it's in a hospital setting. I'd like to thank City Council, particularly Angel Ortiz and the Public Safety Committee for their leadership in this area. We are -- we have reviewed all of the sites. We went out, first of all, to look at additional sites Episcopal Hospital was certainly the best -- that's where nurse examiners are and it's already a site for the forensic examinations. There are separate entrances for suspects and prisoners and separate, nice waiting room facilities for children and for adult victims, and also, it is furnished appropriately, and we think it's in a neighborhood where, unfortunately, a considerable number of victims are, so it's convenient from that point of view. And we're very pleased. The Children's Alliance is anticipating moving there. We do not yet have a commitment from the Department of Human Services, but I'm hoping that they at least will do joint interviews and 20 6/7/01 PUB. PROP. PUB. WORKS - BILL 010421 Women Organized Against Rape is hoping to be able to locate at least a crisis intervention system there. So all in all, in a relatively short period of time, I think we have gone from a real crisis and scandal to a state-of-the-art facility, so we're very pleased.

And we want to thank Council immensely for their support and their help and the Police Department, of course, as well, and the Capital Program Office.

Yes. Actually, Carol Tracy just answered my very specific questions that I wanted to have for the Capital Office, and that is, why ultimately did this particular location seem best? and you just cited a number of reasons why. So let me just echo the comments of Councilman Kenney. The due diligence that's taken place since those hearings convened by Councilman Ortiz and now, that's a tremendous progress. 21 6/7/01 PUB. Thank you, Mr. Chairman. This is, I think, the fruit of an effort that really comes from the grassroots, from the advocates that are involved in the Special Victims Unit. I think Commissioner Timoney deserves a great deal of praise for a police commissioner, he showed incredible flexibility in bringing, and what we were discussing here over the time that we had these hearings was, in essence, changing the culture within the Police Department so that there would be an openness and a newfound ability to be able to create something like this. And I think now with Carol and all of the other groups and the Police Commissioner and his efforts, they're coming to be, I think once we do this, Philadelphia will be one of the few cities across the nation that will have this type of facility with all of the services that are involved. And I think the women of this city and the children are going to feel much better served by these services that are provided in that building. 22 6/7/01 PUB. PROP. PUB. WORKS - BILL 010421

As the District Councilman up there, I'd just like to take the opportunity to thank Joe Martz, the Managing Director, for his -- I was up there a couple months ago with Joe, and if it wasn't for Joe's determination, you know, since we're thanking everybody, we can't leave Joe out. He was down there, he drove me there like three times, and it's a perfect spot, and I don't see any problems with it. It should be perfect, and everyone should be happy.

And also, this is a perfect example of a project that can move forward. People accuse government of not being able to get it done and done quickly. Seeing none, we will move to Bill No. 010426, which is an ordinance 13 authorizing the Philadelphia Authority for Industrial Development, on behalf of the City, to purchase a certain 16-acre tract of land situate at 9450 Ashton Road for a consideration not to exceed $900,000 under and subject to the terms and conditions of the Philadelphia Industrial and Commercial agreement between the City, PAID, and the Philadelphia Industrial Development Corporation. My name is Paul Deegan, and 24 6/7/01 PUB. PROP. PUB. WORKS - BILL 010426 I represent PIDC and PAID and I'm here to testify in support of Bill No. 010426. This bill authorizes PAID to purchase an approximately 16-acre parcel of vacant land in the vicinity of Ashton Road and Grant Avenue for a consideration of $900,000. This property will be marketed for new industrial development in accordance with the industrial and commercial development agreement between the City, PAID, and PIDC. PAID's inventory of developable industrial land is at its lowest level in over 40 years. Outside of the Naval Business Center, PIDC can offer only 360 acres of land citywide to industrial users. We also suffer from a lack of large, over ten-acre assembled parcels. This shortage of good development sites in attractive areas of the City severely limits our ability to draw and retain businesses in the City. The Ashton Road property is an attractive site in a solid industrial area. It's located adjacent to the former Crown Cork and Seal complex on Ashton Road -- that would be to the south -- which is now the new home of the Frankford Candy 25 6/7/01 PUB. PROP. PUB. WORKS - BILL 010426 Company. On the north is the American Packaging Company at the corner of Ashton and Grant. And in the rear is the Clement Muller Beer Distributorship, the current owner of this vacant. The site zone is L-2 industrial, it's also been included in the City's pending Opportunity Zone application, which should further enhance its value as an industrial site. The purchase price of $900,000 is based on an independent real estate appraisal, and it's consistent with recent sales of industrial land in Northeast Philadelphia.

COMMISSIONER PEREZ: Chairman Kenney, I apologize for the problem that's developed here, but apparently, we learned very late yesterday that there was a -- I guess it's referred to as scrivener's error in the preparation of the legal description behind the acquisitions involved in Bill 24 No. 010349 for the Widener Library. WORKS - PUBLIC MEETING Council to be clear that the ultimate acquisition of the entire group of parcels will include 2837 Oakdale Avenue, which is the piece that was left out of the legal description. Again, it's identical in size to the others. It's the end piece on the Oakdale side of the properties. Appraisals would be approximately the same, and legal descriptions would be actually approximately the, same but in the interest of correctness, that new survey will be supplied to Council.

But the specific amendment is to read, as I understand it: "Exhibit A is subject to a corrected legal description to be submitted." Is that correct? COMMISSIONER PEREZ: To be submitted, including 2837 Oakdale Street.
